meansthepersonentitledtotakedeliveryofthegoods.

Goods"
includesliveanimals;
wherethegoodsareconsolidatedina
container,palletorsimilararticleoftransportorwheretheyarepacked,

includessucharticleoftransportorpackagingifsuppliedbythe
shipper.
6."
Contractofcarriagebysea"
meansanycontractwherebythecarrier
undertakesagainstpaymentoffreighttocarrygoodsbyseafromoneportto
another;
however,acontractwhichinvolvescarriagebyseaandalsocarriageby
someothermeansisdeemedtobeacontractofcarriagebyseaforthepurposes
ofthisConventiononlyinsofarasitrelatestothecarriagebysea.

Billoflading"
meansadocumentwhichevidencesacontractofcarriageby
seaandthetakingoverorloadingofthegoodsbythecarrier,andbywhichthe
carrierundertakestodeliverthegoodsagainstsurrenderofthedocument.A
provisioninthedocumentthatthegoodsaretobedeliveredtotheorderofa
namedperson,ortoorder,ortobearer,constitutessuchanundertaking.

Writing"
includes,interalia,telegramandtelex.
Article2
Scopeofapplication
1.TheprovisionsofthisConventionareapplicabletoallcontractsofcarriage
byseabetweentwodifferentStates,if:
(a)theportofloadingasprovidedforinthecontractofcarriagebyseais
locatedinaContractingState,or
(b)theportofdischargeasprovidedforinthecontractofcarriagebyseais
(c)oneoftheoptionalportsofdischargeprovidedforinthecontractof
carriagebyseaistheactualportofdischargeandsuchportislocatedina
ContractingState,or
(d)thebillofladingorotherdocumentevidencingthecontractofcarriageby
seaisissuedinaContractingState,or
(e)thebillofladingorotherdocumentevidencingthecontractofcarriageby
seaprovidesthattheprovisionsofthisConventionorthelegislationofany
Stategivingeffecttothemaretogovernthecontract.
2.TheprovisionsofthisConventionareapplicablewithoutregardtothe
nationalityoftheship,thecarrier,theactualcarrier,theshipper,the
consigneeoranyotherinterestedperson.
3.TheprovisionsofthisConventionarenotapplicabletocharter-parties.
However,whereabillofladingisissuedpursuanttoacharter-party,the
provisionsoftheConventionapplytosuchabillofladingifitgovernsthe
relationbetweenthecarrierandtheholderofthebilloflading,notbeingthe
charterer.
4.Ifacontractprovidesforfuturecarriageofgoodsinaseriesofshipments
duringanagreedperiod,theprovisionsofthisConventionapplytoeach
shipment.However,whereashipmentismadeunderacharter-party,the
provisionsofparagraph3ofthisarticleapply.
Article3
InterpretationoftheConvention
IntheinterpretationandapplicationoftheprovisionsofthisConvention
regardshallbehadtoitsinternationalcharacterandtotheneedtopromote
uniformity.
PARTII
LIABILITYOFTHECARRIER
Article4
Periodofresponsibility
1.TheresponsibilityofthecarrierforthegoodsunderthisConventioncovers
theperiodduringwhichthecarrierisinchargeofthegoodsattheportof
loading,duringthecarriageandattheportofdischarge.
2.Forthepurposeofparagraph1ofthisarticle,thecarrierisdeemedtobe
inchargeofthegoods
(a)fromthetimehehastakenoverthegoodsfrom:
(i)theshipper,orapersonactingonhisbehalf;
or
(ii)anauthorityorotherthirdpartytowhom,pursuanttolaworregulations
applicableattheportofloading,thegoodsmustbehandedoverforshipment;
(b)untilthetimehehasdeliveredthegoods:
(i)byhandingoverthegoodstotheconsignee;
(ii)incaseswheretheconsigneedoesnotreceivethegoodsfromthecarrier,
byplacingthematthedisposaloftheconsigneeinaccordancewiththecontract
orwiththelaworwiththeusageoftheparticulartrade,applicableatthe
portofdischarge;
(iii)byhandingoverthegoodstoanauthorityorotherthirdpartytowhom,
pursuanttolaworregulationsapplicableattheportofdischarge,thegoods
mustbehandedover.
3.Inparagraphs1and2ofthisarticle,referencetothecarrierortothe
consigneemeans,inadditiontothecarrierortheconsignee,theservantsor
agents,respectivelyofthecarrierortheconsignee.
Article5
Basisofliability
1.Thecarrierisliableforlossresultingfromlossofordamagetothegoods,
aswellasfromdelayindelivery,iftheoccurrencewhichcausedtheloss,
damageordelaytookplacewhilethegoodswereinhischargeasdefinedin
article4,unlessthecarrierprovesthathe,hisservantsoragentstookall
measuresthatcouldreasonablyberequiredtoavoidtheoccurrenceandits
consequences.
2.Delayindeliveryoccurswhenthegoodshavenotbeendeliveredattheport
ofdischargeprovidedforinthecontractofcarriagebyseawithinthetime
expresslyagreeduponor,intheabsenceofsuchagreement,withinthetime
whichitwouldbereasonabletorequireofadiligentcarrier,havingregardto
thecircumstancesofthecase.
3.Thepersonentitledtomakeaclaimforthelossofgoodsmaytreatthegoods
aslostiftheyhavenotbeendeliveredasrequiredbyarticle4within60
consecutivedaysfollowingtheexpiryofthetimefordeliveryaccordingto
paragraph2ofthisarticle.
4.(a)Thecarrierisliable
(i)forlossofordamagetothegoodsordelayindeliverycausedbyfire,if
theclaimantprovesthatthefirearosefromfaultorneglectonthepartofthe
carrier,hisservantsoragents;
(ii)forsuchloss,damageordelayindeliverywhichisprovedbytheclaimant
tohaveresultedfromthefaultorneglectofthecarrier,hisservantsor
agents,intakingallmeasuresthatcouldreasonablyberequiredtoputoutthe
fireandavoidormitigateitsconsequences.
(b)Incaseoffireonboardtheshipaffectingthegoods,iftheclaimantor
thecarriersodesires,asurveyinaccordancewithshippingpracticesmustbe
heldintothecauseandcircumstancesofthefire,andacopyofthesurveyor'
s
reportshallbemadeavailableondemandtothecarrierandtheclaimant.
5.Withrespecttoliveanimals,thecarrierisnotliableforloss,damageor
delayindeliveryresultingfromanyspecialrisksinherentinthatkindof
carriage.Ifthecarrierprovesthathehascompliedwithanyspecial
instructionsgiventohimbytheshipperrespectingtheanimalsandthat,inthe
circumstancesofthecase,theloss,damageordelayindeliverycouldbe
attributedtosuchrisks,itispresumedthattheloss,damageordelayin
deliverywassocaused,unlessthereisproofthatallorapartoftheloss,
damageordelayindeliveryresultedfromfaultorneglectonthepartofthe
carrier,hisservantsoragents.
6.Thecarrierisnotliable,exceptingeneralaverage,whereloss,damageor
delayindeliveryresultedfrommeasurestosavelifeorfromreasonable
measurestosavepropertyatsea.
7.Wherefaultorneglectonthepartofthecarrier,hisservantsoragents
combineswithanothercausetoproduceloss,damageordelayindeliverythe
carrierisliableonlytotheextentthattheloss,damageordelayindelivery
isattributabletosuchfaultorneglect,providedthatthecarrierprovesthe
amountoftheloss,damageordelayindeliverynotattributablethereto.
Article6
Limitsofliability
1.(a)Theliabilityofthecarrierforlossresultingfromlossofordamageto
goodsaccordingtotheprovisionsofarticle5islimitedtoanamount
equivalentto835unitsofaccountperpackageorothershippingunitor2.5
unitsofaccountperkilogrammeofgrossweightofthegoodslostordamaged,
whicheveristhehigher.
(b)Theliabilityofthecarrierfordelayindeliveryaccordingtothe
provisionsofarticle5islimitedtoanamountequivalenttotwoandahalf
timesthefreightpayableforthegoodsdelayed,butnotexceedingthetotal
freightpayableunderthecontractofcarriageofgoodsbysea.
(c)Innocaseshalltheaggregateliabilityofthecarrier,underboth
subparagraphs(a)and(b)ofthisparagraph,exceedthelimitationwhichwould
beestablishedundersubparagraph(a)ofthisparagraphfortotallossofthe
goodswithrespecttowhichsuchliabilitywasincurred.
2.Forthepurposeofcalculatingwhichamountisthehigherinaccordancewith
paragraph1(a)ofthisarticle,thefollowingrulesapply:
