Article

(2)WheneverthefollowingactivitiesarecarriedoutintheterritoryofthePeople'

sRepublicofChinathisLawmustbeobserved:

1)Foodproductionandprocessing(referredtoas“FoodProduction”hereafter);

fooddistributionandcateringservice(referredtoas“FoodTrading”hereafter);

2)Productionandtradingoffoodadditives;

3)Productionandtradingofpackingmaterials,vessels,detergentsanddisinfectantsforfood

aswellasutensilsandequipmentusedinfoodproductionandtrading(referredtoas“Food-

RelatedProducts”hereafter);

4)Foodadditivesandfood-relatedproductsusedbyfoodproducersandtraders;

5)Safetymanagementoffood,foodadditivesandfood-relatedproducts.

Thequalityandsafetymanagementofprimaryagriculturalproductsforconsumption(hereinafterreferredtoas“EdibleAgriculturalProducts”)shallbeinaccordancewiththeQualityandSafetyofAgriculturalProductsLaw.However,thisLawmustbeobservedindevelopingqualityandsafetystandardsforedibleagriculturalproductsandreleasingsafetyinformationonedibleagriculturalproducts.

Thesafetymanagementofgeneticallymodifiedfoodshallalsobeinaccordancewithrelevant

administrativerulesandregulations.

Article(3)FoodproducersandtradersshallstrictlyfollowthisLawandotherrelevantlawsandregulationsandfoodsafetystandardsintheirfoodbusinessactivities,andshallnotproduceandtradeunsafefoodproducts.WhoeverproducesortradesunsafefoodproductsmustbearlegalliabilityunderthisLaw.

Article(4)Localpeople'

sgovernmentsatandabovecountylevelshalltakeoverallresponsibilityfortheinspectionandmanagementoffoodsafetyintheirjurisdiction,leadandcoordinatetheinspectionandmanagementoffoodsafetyintheirjurisdiction;

establishandhonefoodsafetycoordinationmechanismsfortheinspectionandmanagementoffoodsafety,taketheleadingandcommandingroleindealingwithfoodsafetyemergencies,developa

foodsafetyaccountabilitysystem,andreviewandevaluatetheperformanceoffoodsafetyregulatoryagencies.

Thesubordinateadministrativedivisionssetupbelowahigherlevelpeople'

sgovernmentmustbeundertheunifiedcoordinationofthelowerlevelgovernmentincarryingouttheirfoodsafetyinspectionandmanagement.

Article(5)Theregulatoryagenciesforfoodproduction,distributionandcateringservicesatandabovecountylevelwillinspectandmanagefoodproductionandtradingactivitiespursuanttothisLawandobligationsassignedbytheStateCouncil.Foodsafetyriskassessment,safetystandardsdevelopment,informationdissemination,investigation

of,andresponseto,foodsafetyincidents,aswellasthedevelopmentofqualificationcriteriaforfoodtestingagenciesandtestspecificationaretheresponsibilityoftheagenciesauthorizedbytheStateCouncil.

ThefoodsafetyregulatorysystemmaybemodifiedbytheStateCouncilinlinewithactual

needs.

Article(6)Therelatedfoodindustryassociationsshallstrengthentheirself-discipline,strengthendisseminationoffoodsafety,andguideconsumerstopurchasefoodproducedbylegitimateproducersandfoodwithlegitimatelabels.

Article(7)Civilsocietyandcommunitygroupsareencouragedtoconductfoodsafetyeducationalactivitiesonunderstandingfoodsafety,laws,regulationsandstandards,toadvocatehealthydietsandtoraiseconsumerawarenessoffoodsafetyandlookingaftertheirhealth.Foodsafetyinformation,laws,regulationsandstandardsshallbepublicizedbythemediafreeofcharge.

Article(8)TheStateencouragesandsupportsbasicandappliedfood-relatedresearch,and

encouragesandsupportsfoodproducersandtraderstoapplyadvancedtechnologiesandgoodmanagementpracticesinordertoimprovefoodsafety.Localpeople'

sgovernmentsatalllevelsshalltakemeasurestoencouragelargerscalefoodproductionandchaindistributionandtrade.

Article(9)Consumershavetherighttoreportandindictbehaviourharmfultotherightsand

interestsofconsumers,torequestinformationfromrelevantagencies,andtoproposecommentsandsuggestionsonfoodsafetyinspectionandmanagement.Consumersalsohavetherighttodemandcompensationaccordingtolawforanyphysicalandpropertydamagecausedbyconsumptionoffood,foodadditivesorfood-relatedproducts.Anyinstitutionorindividualhastherighttoreportanyviolationoflawsorcriminalactivitiesinfoodproductionandtradebusiness.Oncethereportingisverified,therelevantfoodregulatoryagencyshall

rewardthereportinginstitutionorindividual.

Chapter2:

SurveillanceandAssessmentof

FoodSafetyRisks

Article(10)Asurveillancesystemforfoodsafetyshallbeestablishednationwideforsurveillanceoverfood-bornedisease,foodcontaminationandotherfood-relatedhazardstohumanhealth.TheadministrativedepartmentsauthorizedbytheStateCouncilshallestablishandimplementplansforthesurveillanceofnationalfoodsafetyinconjunctionwithotherdepartmentsoftheStateCouncil.Theadministrativedepartmentsdesignatedbygovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernmentshallestablishandimplement,accordingtothenationalplansforfoodsafetysurveillanceandtakingintoconsiderationregionalparticularities,theplansandschemesforthesurveillanceoffoodsafetywithintheirrespectivejurisdictions.

Article(11)Amechanismtoassessfoodsafetyrisksshallbeestablishednationwidetoassessrisksofbiological,chemicalandphysicalhazardsinfood.Theassessmentoffoodsafetyriskshallbetheresponsibilityofafoodsafetyriskassessmentcommitteecomposingexpertsintechnicalhealth,agricultureandotherfieldsinvitedbytheStateCouncilauthorisedadministrativedepartmentinconjunctionwithotherrelevantdepartmentsoftheStateCouncil.RelevantdepartmentsoftheStateCouncilshallbeentitledtoproposesuggestionsonrisk

assessmentandproviderelevantinformationtotheadministrativedepartmentforassessmentoffoodsafetyrisksauthorizedbytheStateCouncil.TheStateCouncilauthorisedadministrativedepartmentforassessmentoffoodsafetyriskshallpromptlyinformrelevantdepartmentsoftheStateCounciloftheresultsoffoodsafetyriskassessments.

Article(12)Thefoodsafetyriskassessmentcommitteesshallassessfoodsafetyrisksusing

scientificmethodsandaccordingtoinformationonsurveillanceoffoodsafetyrisks,scientificdata,andotherrelevantinformation.

Article(13)Foodsafetyriskassessmentresultsshallbethescientificbasisfordevelopingandmodifyingfoodsafetystandards,andoverseeingandadministeringfoodsafety.

Iftheresultofafoodsafetyriskassessmentprovesfoodtobeunsafeandtheneedtoamendordevelopanyfoodsafetystandard,theadministrativedepartmentresponsibletodevelopfoodsafetystandardsauthorizedbytheStateCouncilshallpromptlyamendordeveloptheappropriatefoodsafetystandard.Beforetheamendedornewlydevelopedfoodsafetystandardisreleasedandimplemented,theStateCounciladministrativedepartmentforsupervisionandadministrationoffoodproduction,distributionandprovisionofcateringservices,shallorderfoodproducersortraderstosuspendorceasetradingofsuchfood

accordingtotheirrespectivedutiesandresponsibilities.

TheStateCouncilauthorizedadministrativedepartmentresponsibleforassessmentoffood

safetyriskshall,inconjunctionwithrelevantStateCouncildepartments,conductcomprehensiveanalysesofthefoodsafetysituationanddrawattentiontofoodsafetyrisksinhighriskfood.ThisinformationwillbepublicizedbytheadministrativedepartmentresponsibleforpublicizingfoodsafetyinformationauthorizedbytheStateCouncil,accordingtotheresultoffoodsafetyriskassessmentsandfoodsafetysupervisionandadministrationinformation.

Article(14)Expertsfromthefoodsafetyriskassessmentcommitteeshallbeinvitedto

participateinthesafetyassessmentofpesticide,fertilizer,growthregulator,veterinarymedicine,feedandfeedadditives.TheinspectionproceduresforslaughteringlivestockandpoultryshallbedevelopedbythecompetentadministrativedepartmentoftheStateCouncilinconjunctionwiththeStateCouncilauthorizedadministrativedepartmentresponsibleforfoodsafetyriskassessment.

Chapter3:

FoodSafetyStandards

Article(15)Foodsafetystandardsaremandatoryandconsistofnationalstandardsandlocal

standards.Localstandardsmaybedevelopedifnonationalstandardisavailable.Exceptforthefoodsafetystandards,noothermandatorystandardsforfoodshallbedeveloped.

Article(16)Thefoodsafetystandardsshallspecify:

1)Thelimitstothecontentorconcentrationofpathogenicmicroorganisms,pesticideresidues,veterinarymedicineresidue,heavymetals,contaminants,andothersubstancesthatmaybehazardoustohumanhealthinfood;

2)Thetype,scopeofapplicationanddoseofallowedfoodadditives;

3)Thenutritionalingredientsrequirementsforstapleandsupplementaryfoodexclusivelyfor

babies;

4)Therequirementsforlabels,identificationandinstructionsrelevanttofoodsafetyandnutrition;

5)Thehealthrequirementsforfoodproductionandtradingprocesses;

6)Thequalityrequirementsrelatedtofoodsafety;

7)Themethodsandproceduresforfoodinspectionandtesting;

and

8)Otherparticu
