inthevicinityoftheBeachEndbuoyinHarwichChannel.Tugandtowwerepartofadredgingprogramme.Duringthedredgingcontract,thepracticewasforthedredgingcraft,Vegesack,tonominatethepassingsideforvessels.Thebargewasdifficulttocontrolintidalandtrafficconditions,andthemasterneededtoexerciseconsiderableskillandanticipation,aswellashavingtoliaisecloselywithVTSandpassingvessels.TheGermanmasterhadbeenissuedwithapilotageexemptioncertificateandhadbeenoperatinginthechannelfornearlytwomonthsbeforetheincident.
TheferryDanaAngliawasoutboundfromHarwichindaylightandgoodvisibility.WhenshewasclosetoNorthShelfbuoy,VTScalledVegesackandagreedthatVegesack,whowasinthemiddleofthechannel,wouldmovetothenorthside.ThiswouldenablebothDanaAngliaandBencomo,aninboundvesselcurrentlypassingNo5buoy,topasstothesouth.VTSgavethispassinginformationtothetwovessels.
