AcollisionoccurredonthehighseasbetweenaFrenchsteamerandaTurkishcollierinwhichsomeTurkishcrewmembersandpassengerslosttheirlives.WhentheFrenchshipdockedinaTurkishport,theTurkishgovernmentbegancriminalproceedingsagainsttheFrenchofficersonwatchatthetimeofthecollision.TheFrenchappealedtothepermanentCourtsofInternationalJusticearguingthatTurkeyhadviolatedinternationallaw,because,Francesaid,onlytheflagstatehasjurisdictionovercriminalincidentsonthehighseas.

ThePCIJsaidthatthefewcasesFrancecitedforthisproposition“merelyshowthatstateshadoften,inpractice,abstainedfrominstitutingcriminalproceedings,andnotthattheyrecognizedthemselvesasbeingobligedtodoso;

foronlyifsuchabstentionswerebasedontheirbeingconsciousofadutytoabstainwoulditbepossibletospeakofaninternationalcustom.”

Conclusion:

Turkeywasallowedtocontinuewithitscriminalprosecution.
