　　PartyaforbuildingnationalhighwayG104areaandwiringofthelargebridgepavementengineeringofthehuaiheriver,thesitenowneedgravelseveral（finalquantitywillbesubjecttopartyatheactualacceptancenumber）,throughthebiddingevaluation,feedconditionsrequiredbythepartybwithpartya,bymutualagreement,reachedthefollowingagreement:

　　I.qualityandquantity

　　1.Qualityrequirements:

　　1）meettherequirementsofdesignandtechnicalspecificationstomeettherequirementsofconstructionmixlevelofpartya.

　　2）thegravelprovidedbypartybtopartyashallbecertifiedbypartya'

slaboratoryandapprovedtomeetorexceedthetechnicalqualitystandardsandtechnicalspecificationsofthebiddingdocuments.

　　3）supplyofgravelwithpartyatopartya,partybqualityinspectionandtechnicalappraisalastheydonotconformtotherequirementsofthetechnicalqualityofproducts,partyashallrefuseacceptance,partybshallkeepclearofunqualifiedproductsfrompartyaconstructionsite,theresponsibilityandalleconomiclosscausedtherefromshallbebornebypartyb.

　　4）partybshallberesponsibleforthequalityofthestoneproductssuppliedtopartya.

　　2.Quantityrequirements:

　　1）partyashallbepartofthelithotripsyandstonepowderusedintheroadsurfaceoftheproject.

　　Theamountofgravelusedbypartyamaybesubmittedtopartybaccordingtotheprogressoftheproject.Partybshall,inaccordancewithpartya'

sdosageplan,betransportedtothedesignatedplaceintheconstructionsiteofpartyaasscheduled.

　　3）thequantityofcrushedstoneshallbesettledaccordingtotheactualquantity.

　　Ii.Thepriceofgravelandpaymentmethod

ssupplyquantityisupto500,000yuan,thenpartybshallsettlethesettlementwithpartya'

sministryofcommerce.Ifpartybisnotabletohandlethesettlementwithpartya'

sministryofcommerce,partybshallberesponsibleforthedelay.Afterthesettlementhasbeencompleted,thefinancedepartmentshallhandlethepaymentprocedures.Thepaymentshallbemadeafterthecompletionofthefinancialpaymentprocedures.

　　Iii.Purchaseandsaletime

　　Thepurchasetimeofthecrushedstoneshallbefromthedateofthemonthuntilpartyarequirespartybtostopsupply.

　　Four,theacceptancemethod

　　1.Siteofacceptance:

partybshallsupplythecrushedstonesitetopartyaconcrete,asphaltconcrete,waterstablemixingmaterialsmixingplantsite,andotherlocationsdesignatedbypartya.

　　2.Methodofacceptance:

partyashallnotberesponsibleforthelossintransit,thegravelwillbetransportedtothemixingstationandatthesite,andtheweightshallbeissuedafterthesignatureofthetwoparties.Aspartyb'

spaymentoftheoriginalattachment.

　　3.Partyb'

ssupplyofgravelshallnotexceedtherelevantprovisions,andiftherelevantprovisionsareexceeded,theweightshallbedeterminedafterdeductingthecorrespondingmoisture.

　　Partyarefusestoacceptthematerialsuppliedbypartyb,andpartyarefusestoacceptit,andifitisnotfoundthatthequantityofthematerialisexcessive,thematerialofthiscarshallbeinvalidatedandpartybshallcleanuptheappearancebyhimself.

　　V.rightsandobligationsofpartyaandpartyb

　　1.Rightsandobligationsofpartya:

　　A）partyashallhavetherighttoselectothersuppliersifpartybfailstomeetpartya'

srequirements,technicalindicatorsnotmeettherequirementsorthesupplypriceexceedspartya'

stolerance.

　　B）responsiblefortherequirementofthequalityofthecrushedstone,thequalityoftheproducts,etc.

　　C）responsiblefortimelyorganizingacceptance,measurementandvisaforproductqualityrequirements,timelyhandlingpaymentsettlementandpayment.

　　D）timelyreporttopartybtheamountofcrushedstone.

　　2.Rightsandobligationsofpartyb:

　　A）partybagreestopartyainthepartybsupplyquantitycannotmeetthepartya'

srequirements,technicalindicatorscannotmeetthedemandorsupplyexceedswithinthescopeofpartyatobear,partyatochooseothersuppliers.

　　B）partybshallcomplywithpartya'

smanagementandstrictlyobservethetermsanddutiesofthiscontract.Organizethegoodsupplyofgoodsandensurethattherubbleoftheconstructionsiteofpartyashallbeinplaceintimeaccordingtotheamountofgravelusedbypartya.Thegravelprovidedbypartybmustbeaqualifiedproductthroughqualityinspectionandtechnicalappraisalbypartya'

slaboratory.Partybshallnotforanyreasontostop,slowrock,otherwise,causedtopartyabypartybisresponsibleforthecompensationofstopworkduringallexpensesandeconomiclosses（inadditiontotheforcemajeureofnaturaldisasters,suchasfloods,warandotherfactors）,andimposeafinerangingfromRMB1000/timebypartyb,lossandfinedbypartyafrompartybtodeductthepaymentforthemonth.

　　C）arenotyetreceivedbypartybtopartyabeforethedeliveryplan,partybshallnot,withoutthematerialshippedtothesiteofpartya,otherwise,partyarefuseacceptance,theresultingalleconomiclossesshallbebornebypartyb.

　　D）partybshallstrengthenthewholeprocessmanagementoftherubblesupply,dowellintheworkofcivilizeddistribution,andhandleallkindsofpersonalinsuranceandvehicleequipmentinsurancebeforedistribution,andtheexpensesshallbebornebypartyb.

　　E）partybisnotinaccordancewiththerequirementsofpartya'

sproductqualityortheprovisionofunqualifiedproducts,causestheengineeringqualityaccidentcausedbypartya,partybmustbearalleconomicandlegalresponsibility,andrelatedcosts.

　　F）partybintheprocessoffeedingtransportation,bothontheroadandintheconstructionareaofpartya,asaresultofallsafetyaccidents（including,tothethirdpartycausedbyinjuryandresidual,death,etc.）ofthepropertylossandlegalresponsibilityshallbebornebypartyb.

　　1,thequalityofgravelprovidedbypartybmustbeatorabovetherequestofpartya,ifpartybsupplyofgravelqualityisunqualified,partyahastherighttoselectsuppliersseparately,partybshallnotbeanyobjection.
