Article3Legallyestablishedaccountingfirms,lawfirmsandotherpartnershipsandfoundationsareemployersdefinedintheEmploymentContractLaw.
ChapterIIConclusionofEmploymentContracts
Article4AbranchofficeestablishedbyanemployerasdefinedintheEmploymentContractLawwhichhasobtaineditsbusinesslicenseorregistrationcertificateaccordingtolawmayconcludeemploymentcontractswithemployeesinthenameofanemployer;
ifithasfailedtoobtainedabusinesslicenseorregistrationcertificate,itmayconcludeemploymentcontractswithemployeesonlyupontheauthorizationoftheemployer.
Article5Whereanyemployee,afterbeingnotifiedbytheemployerinwriting,failstoconcludeawrittenemploymentcontractwiththeemployerwithinonemonthfromthedaywhenheisemployed,theemployershallterminatetheemploymentrelationshipwiththeemployeeandnotifytheemployeeinwriting,inwhichcase,theemployerisnotrequiredtomakeanyeconomiccompensationtotheemployee,butshallpaytheemployeeforhisactualworkingtime.
Article6Whereanemployerfailstoconcludeawrittenemploymentcontractwithanemployeeafterthelapseofmorethanonemonthbutlessthanoneyearfromthedatewhentheemployeeisemployed,itshallpaytotheworkerhismonthlywagesindoubleamountaccordingtoArticle82oftheEmploymentContractLaw,andshallconcludeawrittenemploymentcontractwiththeemployee.Whereanemployeerefusestoconcludeawrittenemploymentcontractwithhisemployer,theemployershallterminatetheemploymentrelationship,notifytheemployeeinwriting,andmakeeconomiccompensationstotheemployeeaccordingtoArticle47oftheEmploymentContractLaw.
Thestarttimeoftheperiodwhenanemployerisrequiredtopayanemployeehismonthlywagesindoubleamountshallbethedayfollowingthefullmonthfromthedaywhentheemployeeisemployed,andtheendtimeshallbethedaybeforethedaywhenthewrittenemploymentcontractisconcluded.
Article7Whereanemployerfailstoconcludeawrittenemploymentcontractwithanemployeeafterthelapseofonefullyearfromthedaywhentheemployeeisemployed,underArticle82oftheEmploymentContractLaw,theemployershallpayhismonthlywagesindoubleamountfromthedaynexttothelapseofafullmonthtothedaybeforeitisafullyearsincetheemployee’semployment,anditshallbedeemedthattheemployerhasconcludedanemploymentcontractwithoutafixedtermwiththeemployeeonthedaywhenitisafullyearsincetheemployee’semployment,andawrittenemploymentcontractwithoutafixedtermshallbeconcludedwiththeemployeeimmediately.
Article8TherosterofemployeesasmentionedinArticle7oftheEmploymentContractLawshallcontaintheemployees’name,gender,citizen’sidentitynumber,registeredpermanentresidenceaddressandcurrentaddress,contactinformation,formofemployment,starttimeofemployment,andtermoftheemploymentcontract,etc.
Article9Thestarttimeoftheterm“10consecutiveyears”asmentionedinParagraph2ofArticle14oftheEmploymentContractLawshallbethedaywhentheemployerhiredtheemployee,includingthetimeofemploymentbeforetheEmploymentContractLawcameintoforce.
Article10Whereanemployeeistransferredtoanewemployerforreasonsnotattributabletohimself,hisworkingtimewiththeoriginalemployershallbeconsolidatedintohisworkingtimewiththenewemployer.Iftheoriginalemployerhasmadeeconomiccompensationsforhisworkingtimewiththeoriginalemployer,thenewemployershallnotconsidertheemployee’sworkingtimewiththeoriginalemployerwhencalculatingeconomiccompensationsmadetosuchemployeefordissolvingorterminatingtheemploymentcontractwithhim.
Article11WhereanemployeeproposestheconclusionofanemploymentcontractwithoutafixedtermwiththeemployerunderParagraph2,Article14oftheEmploymentContractLaw,theemployershallconcludeanemploymentcontractwithoutafixedtermwithhim,unlessitisotherwiseagreedtobybothparties.Thecontentsofanemploymentcontractshallbedeterminedbybothpartiesundertheprinciplesoflegality,equity,freewill,consensusandgoodfaith.AnydisputeoverthecontentsshallbesettledaccordingtoArticle18oftheEmploymentContractLaw.
Article12Forthepublicwelfarepostsarrangedbythelocalpeople’sgovernmentsatvariouslevelsandtherelevantdepartmentsofthelocalpeople’sgovernmentatorabovethecountylevelforpeoplewithemploymentdifficultieswhichenjoypost-basedsubsidiesandsocialinsurancesubsidies,theprovisionsoftheEmploymentContractLawwithrespecttoemploymentcontractswithoutafixedtermandeconomiccompensationsarenotapplicabletotheemploymentcontractsforthoseposts.
Article13AnemployerandanemployeemaynotagreeonanyothertermfortheterminationoftheemploymentcontractbeyondthecircumstancesfortheterminationofemploymentcontractsasprescribedinArticle44oftheEmploymentContractLaw.
Article14Wheretheplaceofperformanceofanemploymentcontractisnottheplaceofregistrationoftheemployer,suchmattersabouttheemployeeasthemaximumwagelevel,laborprotection,workconditions,preventionagainstoccupationalharmandthelocalaveragemonthlywagesinthelastyearshallbegovernedbytherelevantprovisionsoftheplaceofperformanceoftheemploymentcontract.Iftherelevantstandardsattheplaceofregistrationoftheemployerarehigherthanthoseattheplaceofperformanceoftheemploymentcontractandboththeemployerandtheemployeehaveagreedonfollowingtherelevantprovisionsoftheplaceofregistrationoftheemployer,therelevantprovisionsoftheplaceofregistrationoftheemployershallapply.
Article15Aemployee’wagesduringprobationshallnotbelessthan80%oftheminimumwagesforthesamepostoftheemployeror80%ofthewagesstipulatedintheemploymentcontract,andshallnotbelessthantheminimumwageleveloftheplacewheretheemployerislocated.
Article16ThetrainingexpensesasmentionedinParagraph2,Article22oftheEmploymentContractLawincludethetrainingexpensesspentbytheemployeronprovidingprofessionaltechnicaltrainingsforanemployee,thetravelexpensesduringthetraining,andotherdirectexpensesspentontheemployeeasaresultofthetraining.
Article17WhereanemploymentcontractexpireswhenthetermofservicestipulatedbytheemployerandtheemployeeaccordingtoArticle22oftheEmploymentContractLawhasnotexpiredyet,theemploymentcontractshallperformeduntilatleasttheexpirationofthetermofservice,unlessitisotherwisestipulatedbybothparties.
ChapterIIIDissolutionandTerminationofEmploymentContract
Article18Underanyofthefollowingcircumstances,anemployeemay,accordingtotheconditionsandproceduresprescribedintheEmploymentContractLaw,dissolveanemploymentcontractwithafixedterm,anemploymentcontractwithoutafixedtermoranemploymentcontractthatsetsthecompletionofaspecifictaskasthetermofthecontractconcludedwiththeemployer:
1.aagreementbetweentheemployeeandtheemployerthroughconsultationandnegotiation;
2.theemployeehasnotifiedtheemployerofthedissolutioninwritingatleast30daysinadvance;
3.theemployeehasnotifiedtheemployerofthedissolutionthreedaysinadvanceduringprobation;
4.theemployerfailstoprovidelaborprotectionorworkconditionsasithaspromisedintheemploymentcontract;
5.theemployerfailstopaylaborremunerationsonscheduleorinfullamount;
6.theemployerfailstopaysocialinsurancepremiumsfortheemployeeasrequiredbylaw;
7.someoftheemployer’srulesorprocedureshavecontravenedthelawanddamagedtherightsandinterestsoftheemployee;
8.theemployer,bymeansofdeceptionorcoercionorbytakingadvantageoftheemployee’sdifficulties,forcestheemployeetoconcludeorchangetheemploymentcontractagainsttheemployee’struewill;
9.theemployerdisclaimsitslegalliabilityordeniestheemployee’srightsintheemploymentcontract;
10.theemployerviolatesthemandatoryprovisionsofanylaworadministrativeregulation;
11.theemployercompelstheemployeetoworkbyforce,threatorillegallyrestrictingthepersonalfreedomoftheemployee;
12.theemployergivesordersinviolationofthesafetyregulationsorforcestheemployeetoriskhislife;
or
13.othercircumstancesunderwhichtheemployeecandissolvetheemploymentcontractassetforthinlawsoradministrativeregulations.
Article19Underanyofthefollowingcircumstances,anemployermay,accordingtotheconditionsandproceduresprescribedintheEmploymentContractLaw,dissolveanemploymentcontractwithafixedterm,anemploymentcontractwithoutafixedtermoranemploymentcontractthatsetsthecompletionofaspecifictaskasthetermofthecontractconcludedwithanemployee:
