（1）Alllawspreviouslyinforceshallbeconstruedwithsuchmodifications,adaptations,limitationsandexceptionsasmaybenecessarysoasnottocontravenetheBasicLawandtobringthemintoconformitywiththestatusofHongKongasaSpecialAdministrativeRegionofthePeople'

sRepublicofChina.

（2）Withoutprejudicetothegeneralityofsubsection

（1）,inanyOrdinance-

（a）provisionsrelatingtoforeignaffairsinrespectoftheHongKongSpecialAdministrativeRegionwhichareinconsistentwithanynationallawappliedintheHongKongSpecialAdministrativeRegionshallbeconstruedsubjecttothatnationallawandshallbesoconstruedastobeconsistentwiththeinternationalrightsandobligationsoftheCentralPeople'

sGovernmentofthePeople'

sRepublicofChina;

（b）provisionsconferringprivilegesontheUnitedKingdomorotherCommonwealthcountriesorterritories,otherthanprovisionsgivingeffecttoreciprocalarrangementsbetweenHongKongandtheUnitedKingdomorotherCommonwealthcountriesorterritoriesshallhavenofurthereffect;

（c）provisionsrelatingtotherights,exemptionsandobligationsofmilitaryforcesstationedinHongKongbytheUnitedKingdomshall,subjecttotheprovisionsoftheBasicLawandtheGarrisonLawoftheHongKongSpecialAdministrativeRegionofthePeople'

sRepublicofChina,continuetohaveeffectandapplytothemilitaryforcesstationedintheHongKongSpecialAdministrativeRegionbytheCentralPeople'

（d）provisionsrelatingtothesuperiorlegalstatusoftheEnglishlanguageascomparedwiththeChineselanguageshallbeconstruedasprovidingthatboththeEnglishandChineselanguagesaretobeofficiallanguages;

and

（e）provisionsapplyinganyEnglishlawmaycontinuetobeapplicablebyreferencetheretoasatransitionalarrangementpendingtheiramendmentbytheHongKongSpecialAdministrativeRegionthroughtheLegislaturethereof,providedthattheyarenotprejudicialtothesovereigntyofthePeople'

sRepublicofChinaanddonotcontravenetheprovisionsoftheBasicLaw.

（3）InalllawspreviouslyinforcewordsandexpressionslistedinSchedule8shallbeconstruedaccordingtothatSchedule.

（1）所有原有法律均须在作出为使它们不抵触《基本法》及符合香港作为中华人民共和国的特别行政区的地位而属必要的变更、适应、限制及例外的情况下，予以解释。

（2）在不损害第

（1）款的一般性原则下，在任何条例中─

（a）关于与香港特别行政区有关的外交事务的法律如与在香港特别行政区实施的任何全国性法律不一致，须在以全国性法律为准，并符合中华人民共和国中央人民政府享有的国际权利和承担的国际义务的规限下，予以解释；

（b）任何给予英国或英联邦其他国家或地区特权待遇的规定，除实施香港与英国或英联邦其他国家或地区的互惠性安排的规定者外，不再有效；

（c）有关英国驻香港军队的权利、豁免及义务的规定，凡不抵触《基本法》和《中华人民共和国香港特别行政区驻军法》的规定，继续有效，并适用于中华人民共和国中央人民政府派驻香港特别行政区的军队；

（d）有关英文的法律效力高于中文的规定，须解释为中文及英文都是正式语文；

及

（e）引用的英国法律的规定，如不损害中华人民共和国的主权和不抵触《基本法》的规定，在香港特别行政区通过其立法机关对其作出修订前，作为过渡安排，可继续参照适用。

（3）在所有原有法律中出现的列于附表8的字和词句，须按照该附表解释。

（4）在本条中─

“原有法律”（lawspreviouslyinforce）指在紧接1997年7月1日之前属有效并已被采用为香港特别行政区法律的普通法、衡平法、条例、附属法例（亦指附属立法）及习惯法；
