Article1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadministrationofemploymentofforeignersinChina

ArticleTheterm“foreigners”intheseRulesreferstothepersons，whoundertheNationalityLawofthePeople’sRepublicofChina,donothaveChinesenationality.Theterm“employmentofforeignersinChina”intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewiththelaws.

ArticleTheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.TheseRulesshallnotapplytoforeignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates，ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.

ArticleThelabouradministrativeauthoritiesofthepeople’sgovernmentoftheprovinces，autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersinChina.

ChapterIIEmploymentLicense

ArticleTheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople’sRepublicofChinaEmploymentLicenseforForeigners（hereinafterreferredtoasthe“EmploymentLicense”）.

ArticleTheposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed，apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulations.Noemployershallemployforeignerstoengageincommercializedentertainingperformance，exceptforthepersonsqualifiedunderArticle（3）oftheseRules.

ArticleAnyforeignersseekingemploymentinChinashallmeetthefollowingconditions：

（1）1yearsofageorolderandingoodhealth

（2）withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;

（3）withnocriminalrecord;

（4）aclearly-definedemployer;

（5）withvalidpassportorotherinternationaltraveldocumentinlieuofthepassport（hereinafterreferredtoasthe“TravelDocument”）.

ArticleForeignersseekingemploymentinChinashallholdtheEmploymentVisasfortheirentry（Incaseofagreementformutualexemptionofvisas，theagreementshallprevail.）,andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner（hereinafterreferredtoasthe“EmploymentPermit”）andtheforeignerresidencecertificate.

Foreignerswhohavenotbeenissuedresidencecertificate（i.e.holdersofF，L，CorG-typesvisas），andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina.Inspecialcases，employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceproceduresundertheseRules.ForeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentPermitandresidencecertificate.

TheemploymentinChinaofthespousesofthePersonnelofforeignembassies,consulates，representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationsinChinashallfollowtheProvisionsofMinistryofForeignAffairsofthePeople’sRepublicofChinaConcerningtheEmploymentoftheSpousesofthePersonnelofForeignEmbassies，ConsulatesandtheRepresentativeOfficesoftheUnitedNationsSysteminChinaandbehandledinaccordancewiththeclearanceproceduresprovidedforinthesecondparagraphofthisarticle.

TheEmploymentLicenseandtheEmploymentPermitshallbedesignedandpreparedexclusivelybytheMinistryofLabour.

ArticleForeignersmaybeexemptedfromtheEmploymentLicenseandEmploymentPermitwhentheymeetanyofthefollowingconditions：

（1）foreignprofessionaltechnicalandmanagerialpersonnelemployeddirectlybytheChinesegovernmentorthosewithseniortechnicaltitlesorcredentialsofspecialskillsrecognizedbytheirhomeorinternationaltechnicalauthoritiesorprofessionalassociationstobeemployedbyChinesegovernmentorgansandinstitutionsandforeignersholdingForeignExpertCertificateissuedbyChina’sBureauofForeignExpertAffairs;

（2）foreignworkerswithspecialskillswhowokinoffshorepetroleumoperationswithouttheneedtogoashoreforemploymentandhold“WorkPermitforForeignPersonnelEngagedintheOffshorepetroleumOperationsinthePeople’sRepublicofChina”;

（3）foreignerswhoconductcommercializedentertainingperformancewiththeapprovaloftheMinistryofCultureandhold“PermitforTemporaryCommercializedPerformance”.

Article10ForeignersmaybeexemptedfromtheEmploymentLicenseandmayapplydirectlyfortheEmploymentPermitbypresentingtheirEmploymentVisasandrelevantpapersaftertheirentrywhentheymeetanyofthefollowingconditions:

（1）foreignersemployedinChinaunderagreementsoraccordsenteredintobytheChinesegovernmentwithforeigngovernmentsorinternationalorganizationsfortheimplementationofSino-foreignprojectsofcooperationandexchange;

（2）chiefrepresentativesandrepresentativesofthepermanentofficesofforeignenterprisesinChina.

ChapterIIIApplicationandApproval

Article11Theemployerwhenintendingtoemployaforeigner，shallfillouttheApplicationFormfortheEmploymentofForeigners（hereinafterreferredtoasthe”ApplicationForm”）andsubmitittoitscompetenttradeauthoritiesatthesamelevelasthelabouradministrativeauthoritiestogetherwiththefollowingdocumentations：

（1）thecurriculumvitaeoftheforeignertobeemployed;

（2）theletterofintentionforemployment;

（3）thereportofreasonsforemployment;

（4）thecredentialsoftheforeignerrequiredfortheperformanceofthejob;

（5）thehealthcertificateoftheforeignertobeemployed;

（6）otherdocumentsrequiredbyregulations.ThecompetenttradeauthoritiesshallexamineandapprovetheapplicationinaccordancewithArticlesandoftheseRulesandrelevantlawsanddecrees.

Article1Aftertheapprovalbythecompetenttradeauthorities，theemployershalltaketheApplicationFormtothelabouradministrativeauthoritiesoftheprovince，autonomousregionormunicipalitydirectlyundertheCentralGovernmentorthelabouradministrativeauthoritiesattheprefectureandcitylevelwherethesaidemployerislocatedforexaminationandclearance.

Thelabouradministrativeauthoritiesdescribedaboveshalldesignateaspecialbody（hereinafterreferredtoasthe”CertificateOffice”）totakeuptheresponsibilityofissuingtheEmploymentLicense.TheCertificateOfficeshouldtakeintoconsiderationoftheopinionsofthecompetenttradeauthoritiesandthedemandandsupplyoflabourmarket，andissuetheEmploymentLicensetotheemployerafterexaminationandclearance.

Article1EmployersattheCentrallevelorthosewithoutthecompetenttradeauthoritiesmaysubmittheirapplicationdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense.

Theexaminationandapprovalbythecompetenttradeauthoritiesisnotrequiredforforeign-fundedenterprisestoemployforeigners，andsuchenterprisesmaysubmittheirapplicationsdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense，bringingwiththemthecontract,articlesofassociation,certificateofapproval,businesslicenseandthedocumentsreferredtoinArticle11oftheseRules.

Article1EmployerswithpermissiontoemployforeignersshallnotsendtheEmploymentLicensenortheletterofvisanotificationdirectlytotheforeignerstobeemployedandtheymustbesentbytheauthorizedunit.

Article1ForeignerswithpermissiontoworkinChinashouldapplyforEmploymentVisasattheChineseembassies，consulatesandvisaoffices,bringingwiththemtheEmploymentLicenseissuedbytheMinistryofLabour，theletterortelexofvisanotificationsentbytheauthorizedunitandthevalidpassportorTravelDocument.

PersonnelreferredtoinArticle

（1）oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunit;

personnelreferredtoinArticle

（2）shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheChinaNationalOffshoreOilCorporation;

personnelreferredtoinArticle9（3）shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheforeignaffairs,officeunderthepeople’sgovernmentofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmentandtherelevantdocumentsofapprovaloftheMinistryofCulture（addressedtotheChineseembassies，consulatesorvisaoffices）.

PersonnelreferredtoinArticle10

（1）oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunitandthedocumentationonprojectsofcooperationandexchange;

（2）shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbytheauthorizedunitandtheregistrationcertificationissuedbytheadministrativeauthoritiesofindustryandcommerce

Article1Theemployershould，withinfifteendaysaftertheentryoftheemployedforeigner,taketotheoriginalCertificateOfficetheEmploymentLicense,
