CONSCIOUSofthemajorcontributionwhichefficientandtimelysalvageoperationscanmaketothesafetyofvesselsandotherpropertyindangerandtotheprotectionoftheenvironment,
CONVINCEDoftheneedtoensurethatadequateincentivesareavailabletopersonswhoundertakesalvageoperationsinrespectofvesselsandotherpropertyindanger,
HAVEAGREEDasfollows:
CHAPTERI
GENERALPROVISIONS
Article1
Definitions
ForthepurposeofthisConvention:
(a)"
Salvageoperation"
meansanyactoractivityundertakentoassistavesseloranyotherpropertyindangerinnavigablewatersorinanyotherwaterswhatsoever.
(b)"
Vessel"
meansanyshiporcraft,oranystructurecapableofnavigation.
(c)"
Property"
meansanypropertynotpermanentlyandintentionallyattachedtotheshorelineandincludesfreightatrisk.
(d)"
Damagetotheenvironment"
meanssubstantialphysicaldamagetohumanhealthortomarinelifeorresourcesincoastalorinlandwatersorareasadjacentthereto,causedbypollution,contamination,fire,explosionorsimilarmajorincidents.
(e)"
Payment"
meansanyreward,remunerationorcompensationdueunderthisConvention.
(f)"
Organization"
meanstheInternationalMaritimeOrganization.
(g)"
Secretary-General"
meanstheSecretary-GeneraloftheOrganization.
Article2
ApplicationoftheConvention
ThisConventionshallapplywheneverjudicialorarbitralproceedingsrelatingtomattersdealtwithinthisConventionarebroughtinaStateParty.
Article3
Platformsanddrillingunits
ThisConventionshallnotapplytofixedorfloatingplatformsortomobileoffshoredrillingunitswhensuchplatformsorunitsareonlocationengagedintheexploration,exploitationorproductionofsea-bedmineralresources.
Article4
State-ownedvessels
1.Withoutprejudicetoarticle5,thisConventionshallnotapplytowarshipsorothernon-commercialvesselsownedoroperatedbyaStateandentitled,atthetimeofsalvageoperations,tosovereignimmunityundergenerallyrecognizedprinciplesofinternationallawunlessthatStatedecidesotherwise.
2.WhereaStatePartydecidestoapplytheConventiontoitswarshipsorothervesselsdescribedinparagraph1,itshallnotifytheSecretary-Generalthereofspecifyingthetermsandconditionsofsuchapplication.
Article5
Salvageoperationscontrolledbypublicauthorities
1.ThisConventionshallnotaffectanyprovisionsofnationallaworanyinternationalconventionrelatingtosalvageoperationsbyorunderthecontrolofpublicauthorities.
2.Nevertheless,salvorscarryingoutsuchsalvageoperationsshallbeentitledtoavailthemselvesoftherightsandremediesprovidedforinthisConventioninrespectofsalvageoperations.
3.TheextenttowhichapublicauthorityunderadutytoperformsalvageoperationsmayavailitselfoftherightsandremediesprovidedforinthisConventionshallbedeterminedbythelawoftheStatewheresuchauthorityissituated.
Article6
Salvagecontracts
1.ThisConventionshallapplytoanysalvageoperationssavetotheextentthatacontractotherwiseprovidesexpresslyorbyimplication.
2.Themastershallhavetheauthoritytoconcludecontractsforsalvageoperationsonbehalfoftheownerofthevessel.Themasterortheownerofthevesselshallhavetheauthoritytoconcludesuchcontractsonbehalfoftheownerofthepropertyonboardthevessel.
3.Nothinginthisarticleshallaffecttheapplicationofarticle7nordutiestopreventorminimizedamagetotheenvironment.
Article7
Annulmentandmodificationofcontracts
Acontractoranytermsthereofmaybeannulledormodifiedif:
(a)thecontracthasbeenenteredintounderundueinfluenceortheinfluenceofdangeranditstermsareinequitable;
or
(b)thepaymentunderthecontractisinanexcessivedegreetoolargeortoosmallfortheservicesactuallyrendered.
CHAPTERII
PERFORMANCEOFSALVAGEOPERATIONS
Article8
Dutiesofthesalvorandoftheownerandmaster
1.Thesalvorshalloweadutytotheownerofthevesselorotherpropertyindanger:
(a)tocarryoutthesalvageoperationswithduecare;
(b)inperformingthedutyspecifiedinsubparagraph(a),toexerciseduecaretopreventorminimizedamagetotheenvironment;
(c)wheneve
