企业环境信息公开是企业为促进与公众的环境交流，履行企业社会责任，通过一
定形式定期向社会披露企业运营过程中对自然环境等造成影响的有关信息。
企业环境
信息公开制度是一种全新的企业环境管理制度，它的产生以可持续发展、企业社会责
任和环境知情权等理论为基础。
通过对美国、欧盟、日本、印度尼西亚和菲律宾等国
企业环境信息公开制度的发展状况以及我国企业环境信息公开制度的立法和实践状
况的分析，发现我国企业环境信息公开制度在立法上与实践中存在以下问题:
法律体
系不完整、相关规定的不具体、企业环境信息公开的内容、程序、责任与救济不完善;
公开环境信息的企业数量少、企业篡改伪造环境信息、公众参与积极性不高。
我国应借鉴国外经验，结合基本国情，完善我国企业环境信息公开制度:
首先，
应明确环境权、环境知情权的法律地位，确立环境信息公开的权利基础，把公开环境
信息作为企业的法律义务。
其次，应制定环境信息公开法和企业环境信息公开指南，
明确企业环境信息自愿与强制相结合的原则，在此基础上根据企业环境影响程度的不
同对企业进行分类，再规定共同但有区别的公开内容;
在公开的程序方面，可以设立
公害防止管理员制度，引进美国企业环境信息公开的第三方认证制度;
在公开形式方
面，可以学习日本制定企业环境报告指南，统一公开环境信息的形式;
在公开途径方
面，可以效仿德国和美国建立统一环境信息数据库并结合G工S等技术公开环境信息;
法律法规中与责任和救济相关的规定也必不可少，因为责任与救济机制是任何法律制
度得以顺利实施的重要保障。
