Wedonotemployanypersonbelowtheageof15*orbelowthelegalminimumage(wherethisishigher)inthecountriesinwhichweoperate.(*indevelopingcountrieslistedinILOConvention138,weacceptchildworkersof14orover).
Reason
Childlabour,i.e.thecommercialexploitationofchildrenisabreachoftheirbasichumanrightsandcanseverelyinhibittheirphysicalandmentaldevelopment.Workingpreventsschoolattendanceandsoreduceseducationalattainment.Thisinturnsecuresasimilarfuturewithoutprospectsforsuccessivegenerations,fuellingapovertytrapwherebyearningpotentialisconsistentlyreducedanddependencyontheincomefromfuturechildrencontinues.Unscrupulousemployerscanexploittheimmaturemind,whichcanbelessabletoassessriskandvoiceconcernsoropinionswithintheworkingenvironment.Theareaisasensitiveone:
itiswidelyagreedthatWesterncompaniescannotsimplydictateminimumagelimitswithouttakingintoaccountlocalcustoms.Norshouldcompaniessimplyrefusetotradewithcompaniesinbreachoftheseprinciples,sincethatactioncandisadvantagetheverychildrentheysetouttohelp.
CodeofPractice
1.Weinsistthatoursuppliercompaniesdonotengageinorsupporttheuseofchildlabour.Wedefine‘childlabour’as:
∙anyfull-timeworkconductedbyachildlessthan15yearsofage,excepting….
∙anyfulltimeworkconductedbyachildlessthan14yearsofage(indevelopingcountryexceptionslistedunderILOConvention138);
∙anychildren,ofwhateverage,workinginbreachoflocalminimumageforworkormandatoryschooling;
∙anychildrenunder18engagedinhazardousorhigh-riskwork.
2.Outsideofthesedefinitionswediscouragetheuseofchildrenworkingasoutworkers,pieceworkersorpart-timelightworkers.However,weunderstandthatinmanycasesthisisacceptedpracticeandwherethisissowecanacceptchildrenbeingemployedundertheageslistedin
(1)above.Weinsistthatthislabourshouldbesubjecttothefollowingconditions:
∙Thecompanymustbeabletodemonstratethatworkdoesnotinterferewiththeeducationthatwouldotherwisebeavailabletothechildren(see(4)below);
∙Nochildmustbeemployedinanycapacitywhoismorethantwoyearsyoungerthantheagelimitsdescribedin
(1)above.
3.Weinsistcompaniestohaveconsideredtheirresponseintheeventthattheydohavechildrenintheirworkforce.Specificallyweaskthatthecompanyshallestablishdocumentedpoliciesandproceduresforremediationofchildrenfoundtobeworkinginsituationswhichfitthedefinitionsofchildlabourabove.Thesepoliciesandproceduresshouldbeuptodate,andeffectivelycommunicatedwithinthecompanyandtootherinterestedparties.Thecompanyshouldalsoprovideadequatesupporttoenablesuchchildrentoattendandremaininschooluntilnolongerachildasdefinedabove.
4.Webelievethateverychildhasarighttoeducation.Wethereforeaskthatthecompanyshallestablishdocumentedpoliciesandproceduresforthepromotionofeducationforchildren.BythiswemeanchildrencoveredunderILORecommendation146andyoungworkerswhoaresubjecttolocalcompulsoryeducationlawsorareattendingschool.Thesepoliciesandproceduresshouldbeuptodateandeffectivelycommunicatedwithinthecompanyandtootherinterestedparties.Weexpectthesepoliciestostateexplicitlythatnochildoryoungworkeristobeemployedduringschoolhoursandthatthecombinedhoursofdailytransportation(toandfromworkandschool),school,andworktimedoesnotexceed10hoursaday.
5.Weinsistthatthecompanyshallnotexposechildrenoryoungworkers(definedasanypersonundertheageof18)tosituationsinoroutsideoftheworkplacethatarehazardous,unsafe,orunhealthy.
Standard2:
Wedonotuseforcedlabourinanyform(prison,indentured,bondedorotherwise)andstaffarenotrequiredtolodgepapersordepositsonstartingwork.
Affectingmillions,therangeofforcedlabourpracticesvariesgreatlybuttheyallhavetwothingsincommon–
(1)Theycontraveneinternationallabourtreatiesandpractices,and
(2)Theytrappeopleagainsttheirwillinworkingenvironmentswhichshowlittleornoconcernfortheirmentalandphysicalwelfare.Issuesofchildlabourandforcedlabouroftenco-existandisthereforeunacceptableonthesamegroundsquotedin1.Theretentionofidentitydocumentsorpayisacommontacticofthoseresponsibleforforcedlabourconditions.
1.Weinsistthatoursuppliersdonotengageinorsupporttheuseofforcedlabour.
2.Weincludeinthisdefinitionthefollowingpractices:
∙Requiringpersonneltolodgeanythingofvalueuponstartingwork,whichmaybesubsequentlyforfeited.Thismightincludeidentitypapersorothere
