　　ChapterlGeneralProvisions

　　Article1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadmiministrationofemploymentofforeignersinChina

　　Article2Theterm"

foreigners"

intheseRulesreferstothepersons，whoundertheNationalityLawont1ePeople'

sRepublicofChina,donothaveChinesenationality.Theterm"

employmentofforeignersinChina"

intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewithitlaws.

　　Article3TheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.TheseRulesshallnotapplyt。

　　foreignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates，ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.

　　Article4Thelabouradministrativeauthoritiesofthepeople'

sgovemmer1toftheprovinces，autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersChina.

　　ChapterIIEmploymentLicense

　　Article5TheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople'

sRepublicofChinaEmploymentLicenseforForeigners（hereinafterreferredtoasthe"

EmploymentLicense"

）.

　　Article6Theposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed，apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulationsNoemployershallemployforeignerstoengageincommercializedentertainingperformance，exceptforthepersonsqualifiedunderArticle9（3）oftheseRules.

　　Article7AnyforeignersseekingemploymentinChinashallmeetthefollowingconditions：

（1）18yearsofageorolderandingoodhealth

（2）withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;

（3）withnocriminalrecord;

（4）aclearly-definedemployer;

（5）withvalidpassportotherinternationaltraveldocumentinlieuofthepassport（hereinafterreferredtoasthe"

TravelDocument"

　　Article8ForeignersseekingemploymentinChinashallholdtheEmploymentVisasforthewentry（Incaseofagreementformutualexemptionofvisas，theagreementshallprevail.）,andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner（hereinafterreferredtoasthe"

EmploymentPermit"

）andtheforeignerresidencecertificateForeignerswhohavenotbeenissuedresidencecertificate（i.e.holdersofF，L，CorG-typesvisas），andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina.Inspecialcases，employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceprocedures1undertheseRulesforeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentpermitandresidencecertificate.TheemploymentinChinaofthespousesofthePersonnelofforeignernbassies,consulates，representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationinChinashallfollowtheProvisionsofMinistryofForeignAffairsofthePeople'

sRepublicofChinaConcerningtheEmploymentoftheSpousesofthePersonnelofForeignEmbassies，ConsulatesandtheRepresentativeOfficesoftheUnitedNationsSysteminChinaandbehandledinaccordancewiththeclearanceproceduresprovidedforinthesecondparagraphofthisarticle.TheEmploymentLicenseandtheEmploymentPermitshallbedesignedandpreparedexclusivelybytheMinistryofLabour.

　　Article9ForeignersmaybeexemptedfromtheEmploymentLicenseandEmploymentpermitwhentheymeetanyofthefollowingconditions：

（1）foreignprofessionaltechnicalandmanagerialpersonnelemployeddirectlybytheChinesegovernmentorthosewithseniortechnicaltitlesorcredentialsofspecialskillsrecognizedbytheirhomeorinternationaltechnicalauthoritiesorprofessionalassociationstobeemployedbyChinesegovernmentorgansandinstitutionsandforeignersholdingForeignExpertCertificateissuedbyChina'
