三、租赁范围及用途:
Tenancy:
甲方同意将其所有的位于市路号腾源九星公寓酒店_______号房屋及设施在良好及可租赁的状态下租给乙方居住使用,出租房的面积共计约________平方米。
PartyAherebyagreestoleaseitspropertylocatedat(Rm.),TownyardHotelJNineStar【Apartment】,No.,Road)andtherelatedfacilities(includingfurnitureandappliances)ingoodandtenantableconditiontoPartyBforresidentialuse.Thesizeoftheleasedpropertyisapproximately()M2.
四、租赁期:
TermofTenancy:
a)租赁期为_____个月,自______年_____月_____日至______年____月____日。
Theabovepropertyisherebyleasedforatermof()months,commencingon()andexpiringon().
b)租赁期满,甲方有权收回全部出租房屋,乙方应如期交还。
乙方如需要续租,须在本合同期满日一个月前向甲方提出书面申请,再由双方另行协商续租事宜。
Onexpiryofthetenancy,PartyAhastherighttotakebacktheentireleasedpropertyandPartyBshalldelivertheleasedpropertytoPartyA.ProvidedalwaysthatPartyBshallhavetheoptiontorenewthisAgreementupongivingonemonthpriorwrittennoticetoPartyAbeforetheexpirationofthisAgreement,termsandconditionsofthenewagreementtobediscussed.
五、租金:
Rent:
a)双方确认租金为每月()人民币元,租金包括房费、服务费、管理费、上网费和一周两次的室内清洁。
TherentagreedtobybothpartiesisRMB()permonthincludingrental-fee、managementfeeandhousekeepingtwiceaweek.
b)乙方提前支付甲方每月的租金,应在()前汇至甲方指定的银行帐号,支付租金日期以乙方汇出日期为准。
PartyBhereundershallpayeachmonth,srentbefore()eachtenancymonth,bytransferringtheamountofsuchrenttoabankaccountdesignatedbyPartyA.Thedateoftransfershallbethedateofpayment.
c)如租金到期后七天仍未支付,乙方须按日加付租金0.5%的滞纳金。
如超过三十天未付则视为乙方自动退租,构成违约,甲方有权收回出租房屋,并追加乙方违约责任。
Iftherentshallbeunpaidforseven(7)daysafterthetermshallbecomedueandpayable,partyBshallbeliabletopayalatepenaltyteeequalto0.5%oftherentperday.Iftherenthasnotbeenpaidmorethan30daysaftertheduedate,PartyBwillbedeemedtohaveautomaticallyterminatedthetenancyresultinginabreachofthisAgreement.PartyAwillthenbeentitledtotakebacktheleasedpropertyandhaverecourseagainstPartyBforbreachofcontract.
六、保证金:
SecurityDeposit:
a)为确保出租房屋及其设施之安全与完好及租赁期内相关费用之如期结算,乙方应在签订本租赁合同后三天内,支付给甲方()个月租金额的租赁押金计()人民币元,作为乙方确保合同履行之保证金。
Toensurethewelfareandgoodconditionoftheleasedpropertyaswellasthepromptpaymentandsettlementofallrelatedchargesduringthetermofthetenancy,PartyBagreestopayPartyAsecuritydepositwithinthreedaysaftersigningofthistenancyagreementequalto()month,srentintheamountofRMB()assecurityforPartyB,sperformingofthisagreement.
b)除合同另有约定之外,甲方应于租赁期满或双方确认此合同提前终止之日且交房方迁空、清点当天保证金全额无息退还乙方。
在甲方退还保证金之前,乙方有权保留房屋钥匙。
UnlessotherwiseprovidedinthisAgreement,partyAshallreturntoPartyBtheentiresecuritydepositwithoutinterestthereonuponexpirationofthetenancyorearlierterminationofthisAgreementagreedbybothpartiesandatthetimewhenbothpartieshaveconfirmedthereturnofthepremises.PartyBhastherighttoretainthekeystothepremisesuntilPartyAreturnsthesecuritydeposit.
c)甲方因乙方违反本合同的规定而受到损失,可在保证金中扣抵合理数目,不足部分乙方必须在接到甲方付款通知后十天内补足。
PartyAmaydeductareasonableamountofsecuritydeposittowardspaymentofanyactualdamagesPartyAshallhaveincurredorsufferedasaresultofPartyB,sbreachofthisagreement.Ifthesecuritydepositisnotsufficienttocoversuchamounts,PartyBmustpaythedeficiencywithin10daysofthereceiptofademandfromPartyA.
七、其他费用:
Othercharges:
a)乙方应承担租赁期内的()等杂费并按甲方提供的通知单如期缴纳。
PartyBisresponsibleforpaying()miscellaneouschargesontimeeverymonth.
八、出租人的责任:
Landlord,sobligations:
a)甲方须按时将出租房屋以良好状态交付乙方使用。
PartyAshalldeliveronscheduletoPartyBtheleasedpropertyforPartyB,suse.
b)租赁期内甲方不得无故收回出租房屋。
(除非本合同另有规定)
PartyAshallnottakebacktheleasedproperty,withoutcauseduringthetermofthetenancy(unlessotherwisestipulatedinthisagreement).
c)房屋基本设施和结构(不包括乙方损坏的家私和器具)损坏时,甲方有修缮的责任并承担有关的费用,并对其作定期保修。
PartyAisresponsibleforrepairingandmaintainingthebasicfacilities(excludingfurnitureandappliancesdamagedbyPartyB),thestructureoftheleasepropertyandforbearingallcostsrelatedthereto.
d)如有租赁期内,租赁房屋发生所有权全部或部分转移、和其它影响乙方权益的事情时,甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本合同的所有条款。
如乙方于本合同下的权益受此等所有权人或第三者所影响或损害,甲方须负责补偿乙方的所有损失、损害、支出及费用。
Ifduringthetermofthetenancy,allorpartoftheleasedpropertyistransferredorPartyB,srighttouseleasedpropertyisaffected,PartyAshallensurethattransfereeorthirdpartyhavingeffectonPartyB,srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisAgreement.PartyAshallalsobeliabletokeepPartyBbefullyindemnifiedagainstanylosses,damages,costsandexpensesifanyofPart
