ChapterIGeneralProvisions

Article1Forthepurposesofstrengtheningtheadministrationofurbanlivinggarbageandimprovingthecityappearanceandenvironmentalsanitation,theseMeasuresareformulatedinaccordancewiththeLawofthePeople’sRepublicofChinaonthePreventionandControlofEnvironmentalPollutionbySolidWastes,theRegulationontheAdministrationofCityAppearanceandEnvironmentalSanitationandotherlawsandadministrativeregulations.

Article2TheseMeasuresshallapplytotheclearing,collection,transport,disposalofurbanlivinggarbageandtherelevantadministrativeactivitieswithintheterritoryofthePeopleRepublicofChina.

Article3Theprinciplesofminimization,reclamationandenvironmentallyfriendlytreatmentandthatwhoeverproducesgarbageshallbeartheresponsibilityforthedisposalthereofshallbeobservedinthecontrolofurbanlivinggarbage.

Thestateshalladopteconomicandtechnologicalpoliciesandmeasureswhicharehelpfultothecomprehensiveutilizationofurbanlivinggarbage,enhancethescientificandtechnologicallevelofcontrolofurbanlivinggarbageandencouragethefullrecoveryandreasonableutilizationofurbanlivinggarbage.

Article4Theentitiesandindividualsproducingurbanlivinggarbageshallpayfeesforthedisposalthereofaccordingtothecriterionsdeterminedbyurbanpeople’sgovernmentongarbagedisposalfeesandotherrelevantprovisions.

Theurbangarbagedisposalfeesshallbeexclusivelyusedforthecollection,transportanddisposalofurbanlivinggarbageandarestrictlyforbiddentobeusedforanyotherpurpose.

Article5TheconstructionadministrativedepartmentoftheStateCouncilshallberesponsiblefortheadministrationofurbanlivinggarbagethroughoutthecountry.

Theconstructionadministrativedepartmentofthepeople’sgovernmentofeachprovinceorautonomousregionshallberesponsiblefortheadministrationofurbanlivinggarbagewithinitsadministrativearea.

Theconstruction（environmentalsanitation）administrativedepartmentofthepeople’sgovernmentofamunicipalitydirectlyundertheCentralGovernment,ofacityoracounty,shallberesponsiblefortheadministrationofurbanlivinggarbagewithinitsadministrativearea.

Article6AnyentityorindividualshallcomplywiththerelevantprovisionsontheadministrationofurbanlivinggarbageandmayexposeandchargeagainstanyentityorindividualinviolationoftheseMeasures.

ChapterIIControlPlanningandFacilitiesConstruction

Article7Theconstruction（environmentalsanitation）administrativedepartmentofthepeople’sgovernmentofamunicipalitydirectlyundertheCentralGovernment,ofacityorofacounty,shall,jointlywiththerelevantdepartmentssuchasthecityplanningdepartment,workoutaplanonthecontrolofurbanlivinggarbageanduniformlyarrangethedistributionof,landtobeusedforandscaleoffacilitiesforthecollectionanddisposalofurbanlivinggarbage.

Theopinionsofthegeneralpublicshallbewidelyconsultedintheformulationofaplanonthecontrolofurbanlivinggarbage.

Article8Thelandtobeusedforthefacilitiesofcollectionanddisposalofurbanlivinggarbageshallbeintegratedintotheurbanyellowlineprotectionrange.Noentityorindividualmayillegallyoccupyitorchangeitspurposeofuse.

Article9Theconstructionoffacilitiesofcollectionanddisposalofurbanlivinggarbageshallbeinlinewiththeurbanlivinggarbagecontrolplanandthepertinentnationaltechnicalstandards.

Article10Anentityengaginginthedevelopmentofanewarea,rebuildingofanoldareaorconstructionanddevelopmentofaresidentialarea,orthebusinessmanagemententityofanairport,port,station,storeorofanyotherpublicfacilitiesorplacepreparefacilitiesforthecollectionofurbanlivinggarbageundertheurbanlivinggarbagecontrolplanandthecriterionsonthesetupofenvironmentalsanitationfacilities.

Article11Therelevantlaws,regulationsandtechnicalstandardsofthestateshallbestrictlyfollowedinthesurvey,design,constructionandsupervisionofconstructionofprojectsoffacilitiesforthecollectionanddisposalofurbanlivinggarbage.

Article12Afterthecompletionofaprojectofconstructionoffacilitiesforthecollectionordisposalofurbanlivinggarbage,theconstructionentityshallorganizeacompletion-basedcheckandshall,within3monththereafter,submittotheconstructionprojectarchivestotheconstructionadministrativedepartmentandtheenvironmentalsanitationadministrativedepartmentofthelocalpeople’sgovernment.Ifnocompletion-basedcheckismadefortheprojectoriftheprojectfailstopassthecheck,itshallnotbedeliveredforuse.

Article13Noentityorindividualmayillicitlyclosedownordismantleanyfacilitiesorsiteforthedisposalofurbanlivinggarbageorleavethemidle.Ifitisreallynecessarytodoso,suchentityorindividualshallbesubjecttotheexaminationandapprovaloftheconstruction（environmentalsanitation）administrativedepartmentofthelocalpeople’sgovernmentatthecountyleveloraboveandshalltakemeasurestopreventenvironmentalpollution.

Article14Anapplicantshallsubmitthefollowingmaterialsifit（he）appliesforclosingdownordismantlinganyfacilitiesorsiteforthedisposalofurbanlivinggarbageorleavingthemidle:

1.Awrittenapplication;

2.Theownershipcertificationmaterials;

3.Acertificationforitslossoffunctionsorforthereplacementofitsfunctionsbyotherfacilities;

4.Aplanonthepreventionofenvironmentalpollution;

5.Adrawingofthepresentstateofandaplanonthedismantlementofthefacilitiestobecloseddown,tobeleftidleortobedismantled;

6.Adesignmapofthenewfacilitiestobebuilt;

7.Foranyfacilitiestobeleftidle,becloseddownordismantledduetotheutionofacityplan,theapprovaldocumentsoftheplanningandconstructionadministrativedepartmentshallbeprovidedaswell.

#ChapterIIIClearing,CollectionandTransport

Article15Classifieddumping,collectionandtransportofurbanlivinggarbageshallbegraduallyrealized.Thedetailedmeasuresshallbeformulatedbytheconstruction（environmentalsanitation）administrativedepartmentofthepeople’sgovernmentofamunicipalitydirectlyundertheCentralGovernment,orofacounty,accordingtothenationalstandardsandthelocalactualsituation.

Article16Anentityorindividualshall,accordingtotheprescribedplaceandtime,dumpthelivinggarbagetothegarbagecontainersorcollectionplaceasdesignated.Thewastefurnitureandotherlargepiecesofgarbageshall,attheprescribedtime,beputinthecollectionplaceasdesignated.

Foranareafortheclassifiedcollectionofurbanlivinggarbage,theentitiesandindividualsshall,accordingtotheclassificationrequirementsasprescribed,putthelivinggarbageintothecorrespondinggarbagebagandthenputitintothedesignatedgarbagecontainerorcollectionplace.

Hotels,restaurants,governmentorgans,universities,collegesandotherentitiesshall,undertherelevantprovisions,separatelycollectandkeepthekitchengarbageproducedbythemselvesanddeliversuchgarbagetoanenterpriseofcollectionandtransportofurbanlivinggarbage,whichsatisfiestherequirementsoftheseMeasures,fortransporttoprescribedplaceofdisposalofurbanlivinggarbage.

Itisforbiddentodump,throw,spillorpileupurbanlivinggarbageatwill.

Article17Anenterpriseengagingincommercialclearing,collectionandtransportofurbanlivinggarbageshallobtainalicenseforthecommercialserviceofclearing,collectionandtransportofurbanlivinggarbage.

Anyenterprisefailingtoobtainalicenseforthecommercialserviceofclearing,collectionandtransportofurbanlivinggarbageshallnotengageinactivitiesofclearing,collectionandtransportofurbanlivinggarbage.

Article18Theconstruction（environmentalsanitation）administrativedepartmentofamunicipalitydirectlyundertheCentralGovernment,orofacityorcounty,shall,bywayofbidtenderingoranyotherfaircompetitionmeans,makealicensingdecisionaboutthecommercialserviceofclearing,collectionandtransportofurbanlivinggarbageandissuetothebid-winneraserviceofcommercialclearing,collectionandtransportofurbanlivinggarbage.

Theconstruction（environmentalsanitation）administrativedepartmentofamunicipalitydirectlyundertheCentralGovernment,orofacityorcounty,shallsignwiththebid-winneranagreementonthebusinessofclearing,collectionandtransportofurbanlivinggarbage.

Theagreementonthebusinessofclearing,collectionandtransportofurbanlivinggarbageshallstatethetimelimit,servicestandardsandotheritemsandshallserveasanattachmenttothelicensefortheserviceofclearing,collectionandtransportofurbanlivinggarbage.

Article19Anenterprisetoprovidetheserviceofclearing,collectionandtransportof
