ShouldthebuyersforitsownsakefailtoopentheLetterofCreditontimestipulatedinthecontract,thebuyersshallpayapenaltytothesellers.Thepenaltyshallbechargedattherateof1%oftheamountoftheletterofCredit.However,thepenaltyshallnotexceed10%ofthetotalvalueoftheLetterofCreditwhichthebuyersshouldhaveopened.Anyfractionaldayslessthantendaysshallbedeemedtobetendaysforthecalculationofpenalty.
