GeneralProvisions

Article1ThisLawisenactedforthepurposeofensuringfoodhygiene,preventingfoodcontaminationandharmfulsubstancesfrominjuringhumanhealth,safeguardingthehealthofthepeopleandimprovingtheirphysicalfitness.

Article2TheStateinstitutesasystemoffoodhygienesupervision.

Article3TheadministrativedepartmentofpublichealthundertheStateCouncilshallbeinchargeofsupervisionandcontroloffoodhygienethroughoutthecountry.

OtherrelevantdepartmentsundertheStateCouncilshall,withinthescopeoftheirrespectivefunctionsandduties,beresponsibleforcontroloffoodhygiene.

Article4WhoeverengagesinfoodproductionormarketingwithintheterritoryofthePeople'sRepublicofChinamustobservethisLaw.

ThisLawappliestoallfoodsandfoodadditivesaswellascontainers,packagings,utensilsandequipmentusedforfood,detergentsanddisinfectants;italsoappliestothepremises,facilitiesandenvironmentassociatedwithfoodproductionormarketing.

Article5TheStateencouragesandprotectsthesocialsupervisionexercisedbypublicorganizationsandindividualsoverfoodhygiene.

AnypersonshallhavetherighttoinformtheauthoritiesandlodgeacomplaintaboutanyviolationofthisLaw.

ChapterII

FoodHygiene

Article6Foodshallbenontoxicandharmless,conformtopropernutritiverequirementsandhaveappropriatesensorypropertiessuchascolour,fragranceandtaste.

Article7PrincipalandsupplementaryfoodsintendedspeciallyforinfantsandpreschoolchildrenshallconformtothenutritiveandhygienicstandardspromulgatedbytheadministrativedepartmentofpublichealthundertheStateCouncil.

Article8Intheprocessoffoodproductionormarketing,therequirementsforhygienestatedbelowshallbeconformedto:

(1)Theenvironmentinsideandoutsideanyfoodproductionormarketingestablishmentshallbekeptcleanandtidy;measuresshallbetakentoeliminateflies,rodents,cockroachesandotherharmfulinsectsandtoremoveconditionsfortheirpropagation;andaprescribeddistanceshallbekeptfromanytoxicorharmfulsite;

(2)Anenterpriseengagedinfoodproductionormarketingshallhaveworkshopsorotherpremisesforthepreparationofrawmaterialsandforprocessing,packingandstoragethatarecommensuratewiththevarietiesandquantitiesoftheproductshandled;

 

(3)Appropriatefacilitiesshallbemadeavailablefordisinfection,changingclothes,toilet,naturalandartificiallight,ventilation,preventionofspoilage,protectionagainstdust,eliminationoffliesandrodents,washingofequipment,sewagedischargeandthecontainmentofgarbageandotherwastes;

(4)Thelayoutofinstallationsandtheapplicationoftechnologicalprocessesshallberationalinordertopreventcontaminationbetweenfoodstobeprocessedandready-to-eatfoods,andbetweenrawmaterialsandfinishedproducts;foodmustnotbeplacedincontactwithanytoxicsubstanceorfilth;

(5)Tableware,kitchenwareandcontainersforready-to-eatfoodsmustbecleanedanddisinfectedpriortouse;cookingutensilsandotherutensilsmustbewashedafteruseandkeptclean;

(6)Anycontainers,packagings,utensilsandequipmentusedforthestorage,transportation,loadingandunloadingoffoodaswellastheconditionsunderwhichtheseoperationsarecarriedoutmustbesafe,harmlessandkeptcleaninordertopreventfoodcontamination;

(7)Ready-to-eatfoodsshallbekeptinsmallpacketsorinnontoxic,cleanpackagingmaterials;

(8)Allpersonsinvolvedinfoodproductionormarketingshallmaintainaconstantstandardofpersonalhygiene,takingcaretowashtheirhandsthoroughlyandwearcleanworkclothesandheadgearwhilepreparingorsellingfood;also,properutensilsmustbeusedwhensellingready-to-eatfoods;

(9)Anywaterusedmustconformtothenationalhygienestandardsfordrinking-waterinurbanandruralareas;

(10)Thedetergentsanddisinfectantsusedshallbesafeandharmlesstohumanhealth.

ThehygienicrequirementsforfoodproductionormarketingundertakenbyfoodvendorsandpersonsengagedinthefoodbusinessinurbanandruralmarketsshallbeformulatedspecificallyaccordingtothisLawbythestandingcommitteesofthepeople'scongressesintheprovinces,autonomousregions,ormunicipalitiesdirectlyundertheCentralGovernment.

Article9Theproductionandmarketingoffoodsinthefollowingcategoriesshallbeprohibited:

(1)foodsthatcanbeinjurioustohumanhealthbecausetheyareputridordeteriorated,spoiledbyrancidoilorfat,moulded,infestedwithinsectsorworms,contaminated,containforeignmatterormanifestotherabnormalitiesinsensoryproperties;

(2)foodsthatcontainorarecontaminatedbytoxicordeleterioussubstancesandcanthusbeinjurioustohumanhealth;

(3)foodsthatcontainpathogenicparasites,microorganismsoranamountofmicrobialtoxinexceedingthetoleranceprescribedbytheState;

(4)meatandmeatproductsthathavenotbeeninspectedbytheveterinaryhealthserviceorhavefailedtopasssuchinspection;

(5)poultry,livestock,gameandaquaticanimalsthathavediedfromdisease,poisoningorsomeunknowncause,aswellasproductsmadefromthem;

(6)foodscontaminatedbyuseoffilthyorseriouslydamagedcontainersorpackages,orfilthymeansofconveyance;

(7)foodsthatimpairnutritionorhealthbecausetheyareadulteratedormisbranded;

(8)foodsprocessedwithnon-foodrawmaterials;foodsmixedwithnon-foodchemicalsubstances,ornon-foodstuffsusedasfood;

(9)foodsthathasexpiredthedateforguaranteedquality;

(10)foodsofwhichthesalehasbeenspecificallyprohibited,forthepreventionofdiseasesorotherspecialreasons,bytheadministrativedepartmentofpublichealthundertheStateCouncilorbythepeople'sgovernmentsoftheprovinces,autonomousregions,ormunicipalitiesdirectlyundertheCentralGovernment;

(11)foodsthatcontainadditivesnotapprovedforusebytheadministrativedepartmentofpublichealthundertheStateCouncilorresiduesofpesticidesexceedingthetoleranceprescribedbytheState;and

(12)otherfoodsthatdonotconformtothestandardsandrequirementsforfoodhygiene.

Article10Foodmustnotcontainmedicinalsubstances,withtheexceptionofthosematerialsthathavetraditionallyservedasbothfoodandmedicamentsandareusedasrawmaterials,condimentsornutritionfortifiers.

ChapterIII

HygieneofFoodAdditives

Article11Theproduction,marketinganduseoffoodadditivesmustconformtothehygienestandardsforuseoffoodadditivesandthehygienecontrolregulations;thefoodadditivesthatdonotconformtothehygienestandardsandthehygienecontrolregulationsmaynotbemarketedandused.

ChapterIV

HygieneofContainers,Packagings,UtensilsandEquipmentUsedforFood

Article12Containers,packagings,utensilsandequipmentusedforfoodmustconformtothehygienestandardsandthehygienecontrolregulations.

Article13Therawmaterialsformakingcontainers,packagings,utensilsandequipmentusedforfoodmustmeethygienerequirements.Thefinishedproductsshouldbeeasytocleananddisinfect.

ChapterV

FormulationofFoodHygieneStandardsandRegulations

forFoodHygieneControl

Article14TheadministrativedepartmentofpublichealthundertheStateCouncilshallformulateorapproveandpromulgatethenationalhygienestandards,hygienecontrolregulationsandinspectionproceduresforfood,foodadditives,thecontainers,packagings,utensilsandequipmentusedforfood,thedetergentsanddisinfectantsusedforwashingfoodorutensilsandequipmentusedforfood,andthetolerancesforcontaminantsandradioactivesubstancesinfood.

Article15IftheStatehasnotformulatedhygienestandardsforacertainfood,thepeople'sgovernmentsoftheprovinces,autonomousregions,ormunicipalitiesdirectlyundertheCentralGovernmentmayestablishlocalhygienestandardsforthatfoodandreportthemtotheadministrativedepartmentofpublichealthundertheStateCouncilandthecompetentstandardizationadministrationdepartmentundertheStateCouncilfortherecord.

Article16NormsofsignificancetothescienceofhealthtobeincludedinthenationalqualitystandardsforfoodadditivesmustbeexaminedandapprovedbytheadministrativedepartmentofpublichealthundertheStateCouncil.

Appraisalsonthesafetyforuseofagriculturalchemicals,suchaspesticidesandchemicalfertilizers,shallbeexaminedandapprovedbytheadministrativedepartmentofpublichealthundertheStateCouncil.

VeterinaryhygieneinspectionproceduresforslaughteredlivestockandpoultryshallbeformulatedjointlybytherelevantadministrativedepartmentsundertheStateCouncilandtheadministrativedepartmentofpublichealthundertheStateCouncil.
