Theparcel/consignmentinquestionwasstowedinNo.2lowerholdandtweendeckwhich,priortoloading,werethoroughlyexaminedbytheLloyd’sSurveyoratYokohama.Thecoolnessandventilationinthecompartmentscameupfullytothestandardsoftransit,whichwastotheentiresatisfactionoftheSurveyorandshipper.

Duringthevoyage,wealsopaidspecialattentiontotheeffectiveventilationofthesaidcargo.Fromtheabove,wemayconcludethattheallegeddamagetoorangesmusthavebeencausedbytheirinherentnatureandthisisamatterbeyondourcontrol.Therefore,wearenottobeheldresponsibleforthisdamage.

Inaddition,wewouldtakethisopportunitytobringittoyournoticethattherecurrenceofsuchdamagewillbeinevitableinthefutureunlesstheshipperimprovesthepackingthereof.
