3、islocatedArticle89Whenasettlementagreementthroughconciliationisreached,thepeoplescourtshalldrawupaconciliationstatement.Theconciliationstatementshallclearlysetforththeclaims,thefactsofthecase,andtheresultoftheconciliation.Theconciliationstatementshallbesignedbythejudgeandthecourtclerk,sealedbythepeo

4、plescourt,andservedonbothparties.Onceitisreceiptedbythetwopartiesconcerned,theconciliationstatementshallbecomelegallyeffective.Article90Thepeoplescourtneednotdrawupaconciliationstatementforthefollowingcaseswhenasettlementagreementisreachedthroughconciliation:(1)divorcecasesinwhichbothpartieshavebeco

5、mereconciledafterconciliation;(2)casesinwhichadoptiverelationshiphasbeenmaintainedthroughconciliation;(3)casesinwhichtheclaimscanbeimmediatelysatisfied;and(4)othercasesthatdonotrequireaconciliationstatement.Anysettlementagreementthatneedsnoconciliationstatementshallbeenteredintothewrittenrecordandsh

6、allbecomelegallyeffectiveafterbeingsignedorsealedbybothpartiesconcerned,bythejudgeandbythecourtclerk.Article91Ifnoagreementisreachedthroughconciliationorifeitherpartybacksoutofthesettlementagreementbeforetheconciliationstatementisserved,thepeoplescourtshallrenderajudgmentwithoutdelay.ChapterIXProper

7、tyPreservationandAdvanceExecutionArticle92Inthecaseswheretheexecutionofajudgmentmaybecomeimpossibleordifficultbecauseoftheactsofeitherpartyorforotherreasons,thepeoplescourtmay,attheapplicationoftheotherparty,ordertheadoptionofmeasuresforpropertypreservation.Intheabsenceofsuchapplication,thepeoplesco

8、urtmayofitself,whennecessary,ordertheadoptionofmeasuresforpropertypreservation.Inadoptingpropertypreservationmeasures,thepeoplescourtmayenjointheapplicanttoprovidesecurity;iftheapplicantfailstodoso,hisapplicationshallberejected.Afterreceivinganapplication,thepeoplescourtmust,ifthecaseisurgent,makean

9、orderwithin48hours;iftheorderfortheadoptionofpropertypreservationmeasuresismade,theexecutionthereofshallbeginimmediately.Article93Anyinterestedpartywhoselawfulrightsandinterestswould,duetourgentcircumstances,sufferirretrievabledamagewithoutimmediatelyapplyingforpropertypreservation,may,beforefilinga

10、lawsuit,applytothepeoplescourtfortheadoptionofpropertypreservationmeasures.Theapplicantmustprovidesecurity;ifhefailstodoso,hisapplicationshallberejected.Afterreceivinganapplication,thepeoplescourtmustmakeanorderwithin48hours;ifthecourtorderstheadoptionofpropertypreservationmeasures,theexecutionthere

11、ofshallbeginimmediately.Iftheapplicantfailstobringanactionwithin15daysafterthepeoplescourthasadoptedthepreservationmeasures,thepeoplescourtshallcancelthepropertypreservation.Article94Propertypreservationshallbelimitedtothescopeoftheclaimsortothepropertyrelevanttothecase.Propertypreservationshallbeef

12、fectedbysealingup,distraining,freezingorothermethodsasprescribedbythelaw.Afterthepeoplescourthasfrozentheproperty,itshallpromptlynotifythepersonwhosepropertyhasbeenfrozen.Thepropertythathasalreadybeensealeduporfrozenshallnotbesealeduporfrozenforasecondtime.Article95Ifthepersonagainstwhomtheapplicati

13、onforpropertyreservationismadeprovidessecurity,thepeoplescourtshallcancelthepropertyreservation.Article96Ifanapplicationforpropertypreservationiswrongfullymade,theapplicantshallcompensatethepersonagainstwhomtheapplicationismadeforanylossincurredfrompropertypreservation.Article97Thepeoplescourtmay,up

14、onapplicationofthepartyconcerned,orderadvanceexecutioninrespectofthefollowingcases:(1)thoseinvolvingclaimsforalimony,supportforchildrenorelders,pensionforthedisabledorthefamilyofadecedent,orexpensesformedicalcare;(2)thoseinvolvingclaimsforremunerationforlabour;and(3)thoseinvolvingurgentcircumstances

15、thatrequireadvanceexecution.Article98Casesinwhichadvanceexecutionisorderedbythepeoplescourtshallmeetthefollowingconditions:(1)therelationshipofrightsandobligationsbetweenthepartiesconcernedisclearanddefinite,anddenialofadvanceexecutionwouldseriouslyaffectthelivelihoodorproductionoperationsoftheappli

16、cant;and(2)thepersonagainstwhomtheapplicationforadvanceexecutionismadeiscapableoffulfillinghisobligations.Thepeoplescourtmayenjointheapplicanttoprovidesecurity;iftheapplicantfailstodoso,hisapplicationshallberejected.Iftheapplicantlosesthelawsuit,heshallcompensatethepersonagainstwhomtheapplicationism

17、adeforanylossofpropertyincurredfromtheadvanceexecution.Article99Ifthepartyconcernedisnotsatisfiedwiththeordermadeonpropertypreservationorexecution,hemayapplyforreconsiderationwhichcouldbegrantedonlyonce.Executionoftheordershallnotbesuspendedduringthetimeofreconsideration.ChapterXCompulsoryMeasuresAg

18、ainstObstructionofCivilProceedingsArticle100Ifadefendantisrequiredtoappearincourt,but,havingbeenservedtwicewithsummons,stillrefusestodosowithoutjustifiedreason,thepeoplescourtmayconstrainhimtoappearincourtbyaperemptorywrit.Article101Participantsandotherpersonsinthecourtproceedingsshallabidebythecour

19、trules.Ifapersonviolatesthecourtrules,thepeoplescourtmayreprimandhim,ororderhimtoleavethecourtroom,orimposeafineonordetainhim.Apersonwhoseriouslydisruptscourtorderbymakinganuproarinthecourtorrushingatit,orinsulting,slandering,threatening,orassaultingthejudicialofficers,shallbeinvestigatedforcriminal

20、responsibilitybythepeoplescourtaccordingtothelaw;iftheoffenceisaminorone,theoffendermaybedetainedorafineimposedonhim.Article102Ifaparticipantoranyotherpersonintheproceedingscommitsanyoneofthefollowingacts,thepeoplescourtshall,accordingtotheseriousnessoftheact,imposeafineonhimordetainhim;iftheactcons

21、titutesacrime,theoffendershallbeinvestigatedforcriminalresponsibilityaccordingtolaw.(1)forgingordestroyingimportantevidence,whichwouldobstructthetrialofacasebythepeoplescourt;(2)usingviolence,threatsorsubordinationtopreventawitnessfromgivingtestimony,orinstigating,suborning,orcoercingotherstocommitp

22、erjury;(3)concealing,transferring,sellingordestroyingpropertythathasbeensealedupordistrained,orpropertyofwhichaninventoryhasbeenmadeandwhichhasbeenputunderhiscareaccordingtocourtinstruction,ortransferringthepropertythathasbeenfrozen;(4)insulting,slandering,incriminatingwithfalsecharges,assaultingorm

23、aliciouslyretaliatingagainstjudicialofficersorpersonnel,participantsintheproceedings,witnesses,interpreters,evaluationexperts,inspectors,orpersonnelassistinginexecution;(5)usingviolence,threatsorothermeanstohinderjudicialofficersorpersonnelfromperformingtheirduties;or(6)refusingtocarryoutlegallyeffe

24、ctivejudgmentsorordersofthepeoplescourt.Withrespecttoaunitthatcommitsanyoneoftheactsspecifiedabove,thepeoplescourtmayimposeafineonordetainitsprincipalheadsorthepersonswhoareheldactuallyresponsiblefortheact;iftheactconstitutesacrime,investigationsforcriminalresponsibilityshallbemadeaccordingtothelaw.

25、Article103Whereaunitwhichisunderanobligationtoassistininvestigationandexecutioncommitsanyoneofthefollowingacts,thepeoplescourtmay,apartfromenjoiningittoperformitsobligation,alsoimposeafine:(1)refusingorobstructingtheinvestigationandcollectionofevidencebythepeoplescourt;(2)refusingbybanks,creditcoope

26、rativesorotherunitsdealingwithsavingsdeposit,afterreceivinganoticeforassistanceinexecutionfromthepeoplescourt,toassistininquiringinto,freezingortransferringtherelevantdeposit.(3)refusingbytheunitconcerned,afterreceivinganoticeforassistanceinexecutionfromthepeoplescourt,toassistinwithholdingtheincomeofthepartysubjecttoexecution,ingoingthroughtheformalitiesoftransferringtherelevantcertificatesofpropertyrightsorintransferringtherelevantnegotiableinstruments,c
