2、Creditdoesnotsostipulate,bankswillacceptsuchdocumentsaspresented,providedthattheirdatacontentisnotinconsistentwithanyotherstipulateddocumentpresented.Article22.IssuanceDateofDocumentsv.CreditDateUnlessotherwisestipulatedintheCredit,bankswillacceptadocumentbearingadateofissuancepriortothatoftheCredit

3、,subjecttosuchdocumentbeingpresentedwithinthetimelimitssetoutintheCreditandintheseArticles.Article23.Marine/OceanBillofLadinga.IfaCreditcallsforabillofladingcoveringaport-to-portshipment,bankswill,unlessotherwisestipulatedintheCredit,acceptadocument,howevernamed,which:i)appearsonitsfacetoindicatethe

4、nameofthecarrierandtohavebeensignedorotherwiseauthenticatedby:-thecarrieroranamedagentfororonbehalfofthecarrier,or-themasteroranamedagentfororonbehalfofthemaster.Anysignatureorauthenticationofthecarrierormastermustbeidentifiedascarrierormaster,asthecasemaybe.Anagentsigningorauthenticatingforthecarri

5、erormastermustalsoindicatethenameandthecapacityoftheparyt,i.e.carrierormaster,onwhosebehalfthatagentisacting,andii)indicatesthatthegoodshavebeenloadedonboard,orshippedonanamedvessel.Loadingonboardorshipmentonanamedvesselmaybeindicatedbypre-printedwordingonthebillofladingthatthegoodshavebeenloadedonb

6、oardanamedvesselorshippedonanamedvessel,inwhichcasethedateofissuanceofthebillofladingwillbedeemedtobethedateofloadingonboardandthedateofshipment.Inallothercasesloadingonboardanamedvesselmustbeevidencedbyanotationonthebillofladingwhichgivesthedateonwhichthegoodshavebeenloadedonboard,inwhichcasethedat

7、eoftheonboardnotationwillbedeemedtobethedateofshipment.Ifthebillofladingcontainstheindicationintendedvessel,orsimilarqualificationinrelationtothevessel,loadingonboardanamedvesselmustbeevidencedbyanonboardnotationonthebillofladingwhich,inadditiontothedateonwhichthegoodshavebeenloadedonboard,alsoinclu

8、desthenameofthevesselonwhichthegoodshavebeenloaded,eveniftheyhavebeenloadedonthevesselnamedastheintendedvessel.Ifthebillofladingindicatesaplaceofreceiptortakinginchargedifferentfromtheportofloading,theonboardnotationmustalsoincludetheportofloadingstipulatedintheCreditandthenameofthevesselonwhichtheg

9、oodshavebeenloaded,eveniftheyhavebeenloadedonthevesselnamedinthebilloflading.Thisprovisionalsoapplieswheneverloadingonboardthevesselisindicatedbypre-printedwordingonthebilloflading,andiii)indicatestheportofloadingandtheportofdischargestipulatedinthecredit,notwithstandingthatit:(a)indicatesaplaceofta

10、kinginchargedifferentfromtheportofloading,and/oraplaceoffinaldestinationdifferentfromtheportofdischarge,and/or(b)containstheindicationintendedorsimilarqualificationinrelationtotheportofloadingand/orportofdischarge,aslongasthedocumentalsostatestheportsofloadingand/ordischargestipulatedintheCredit,and

11、iv)consistsofasoleoriginalbilloflading,orifissuedinmorethanoneoriginal,thefullsetassoissued,andv)appearstocontainallofthetermsandconditionsofcarriage,orsomeofsuchtermsandconditionsbyreferencetoasourceordocumentotherthanthebilloflading(shortform/blankbackbilloflading),bankswillnotexaminethecontentsof

12、suchtermsandconditions,andvi)containsnoindicationthatitissubjecttoacharterpartyand/ornoindicationthatthecarryingvesselispropelledbysailonly,andvii)inallotherrespectsmeetsthestipulationsoftheCredit.b.ForthepurposeofthisArticle,transhipmentmeansunloadingandreloadingfromonevesseltoanothervesselduringth

13、ecourseofoceancarriagefromtheportofloadingtotheportofdischargestipulatedintheCredit.c.UnlesstranshipmentisprohibitedbythetermsoftheCredit,bankswillacceptabillofladingwhichindicatesthatthegoodswillbetranshipped,providedthattheentireoceancarriageiscoveredbyoneandthesamebilloflading.d.EveniftheCreditpr

14、ohibitstranshipment,bankswillacceptabillofladingwhich:i)indicatesthattranshipmentwilltakeplaceaslongastherelevantcargoisshippedinContainer(s),Trailer(s)and/orLASHbarge(s)asevidencedbythebilloflading,providedthattheentireoceancarriageiscoveredbyoneandthesamebilloflading,and/orii)incorporatesclausesst

15、atingthatthecarrierreservestherighttotranship.Article24.Non-NegotiableSeaWaybilla.IfaCreditcallsforanon-negotiableseawaybillcoveringaport-to-portshipment,bankswill,unlessotherwisestipulatedintheCredit,acceptadocument,howevernamed,which:i)appearsonitsfacetoindicatethenameofthecarrierandtohavebeensign

16、edorotherwiseauthenticatedby:-thecarrieroranamedagentfororonbehalfofthecarrier,or-themasteroranamedagentfororonbehalfofthemaster.Anysignatureorauthenticationofthecarrierormastermustbeidentifiedascarrierormaster,asthecasemaybe.Anagentsigningorauthenticatingforthecarrierormastermustalsoindicatethename

17、andthecapacityoftheparty,i.e.carrierormaster,onwhosebehalfthatagentisacting,andii)indicatesthatthegoodshavebeenloadedonboard,orshippedonanamedvessel.Loadingonboardorshipmentonanamedvesselmaybeindicatedbypre-printedwordingonthenon-negotiableseawaybillthatthegoodshavebeenloadedonboardanamedvesselorshi

18、ppedonanamedvessel,inwhichcasethedateofissuanceofthenon-negotiableseawaybillwillbedeemedtobethedateofloadingonboardandthedateofshipment.Inallothercasesloadingonboardanamedvesselmustbeevidencedbyanotationonthenon-negotiableseawaybillwhichgivesthedateonwhichthegoodshavebeenloadedonboard,inwhichcasethe

19、dateoftheonboardnotationwillbedeemedtobethedateofshipment.Ifthenon-negotiableseawaybillcontainstheindicationintendedvessel,orsimilarqualificationinrelationtothevessel,loadingonboardanamedvesselmustbeevidencedbyanonboardnotationonthenon-negotiableseawaybillwhich,inadditiontothedateonwhichthegoodshave

20、beenloadedonboard,includesthenameofthevesselonwhichthegoodshavebeenloaded,eveniftheyhavebeenloadedonthevesselnamedastheintendedvessel.Ifthenon-negotiableseawaybillindicatesaplaceofreceiptortakinginchargedifferentfromtheportofloading,theonboardnotationmustalsoincludetheportofloadingstipulatedintheCre

21、ditandthenameofthevesselonwhichthegoodshavebeenloaded,eveniftheyhavebeenloadedonavesselnamedinthenon-negotiableseawaybill.Thisprovisionalsoapplieswheneverload,ingonboardthevesselisindicatedbypre-printedwordingonthenon-negotiableseawaybill,andiii)indicatestheportofloadingandtheportofdischargestipulat

22、edintheCredit,notwithstandingthatit:(a)indicatesaplaceoftakinginchargedifferentfromtheportofloading,and/oraplaceoffinaldestinationdifferentfromtheportdischarge,and/or(b)containstheindicationintendedorsimilarqualificationinrelationtotheportofloadingand/orportofdischarge,aslongasthedocumentalsostatest

23、hepot;tsofloadingand/ordischargestipulatedintheCredit,andiv)consistsofasoleoriginalnon-negotiableseawaybill,orifissuedinmorethanoneoriginal,thefullsetassoissued,andv)appearstocontainallofthetermsandconditionsofcarriage,orsomeofsuchtermsandconditionsbyreferencetoasourceordocumentotherthanthenon-negot

24、iableseawaybill(shortformlblankbacknon-negotiableseawaybill);bankswillnotexaminethecontentsofsuchtermsandconditions,andvi)containsnoindicationthatitissubjecttoacharterpartyand/ornoindicationthatthecarryingvesselispropelledbysailonly,andvii)inallotherrespectsmeetsthestipulationsoftheCredit.b.Forthepu

25、rposeofthisArticle,transhipmentmeansunloadingandreloadingfromonevesseltoanothervesselduringthecourseofoceancarriagefromtheportofloadingtotheportofdischargestipulatedintheCredit.c.UnlesstranshipmentisprohibitedbythetermsoftheCredit,bankswillacceptanon-negotiableseawaybillwhichindicatesthatthegoodswil
