5、 As legal requirements.三、劳动保护、劳动条件、工作时间和休假 Work Protection, Condition, Time and Leaves第四条 甲方安排乙方执行8小时/日工作制,甲方依法保证乙方的休息权利。乙方在劳动合同履行期间依法享受法定节假日以及探亲假、婚丧假、产假、带薪年假等休假权利。 甲方安排乙方每日工作时间不超过8小时,每周工作5天,平均每周不超过40小时。甲方保证乙方每周休息二天。因特殊原因需要延长工作时间的,在保障乙方身体健康的条件下,甲乙双方友好协商执行,原则上每月不超过24小时。 There are 8 working hours per

8、安排乙方加班的,应安排乙方同等时间补休或依法支付加班工资;加点的,甲方应付加点工资。If party A requires party B to do overtime work, Party A should give the equal time leave in some other time or give overtime payment according to law; if party B needs to work in extension hours, Party A should pay for the extension hours.第六条甲方为乙方提供必要的劳动条件和

9、劳动工具,建立健全的生产工艺流程,制定操 作规程、工作规范和劳动安全卫生制度及其标准。Party A should provide the necessary work conditions and tools, build up complete production process and make operation regulations, rules and safety system and standards.第七条 甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的教育和培训。 Party A should arrange to give the ne

10、cessary training for Party B about political thoughts, professional morality, operation skills and operation safety and regulations.四、劳动报酬 Work payment第八条 乙方应按照甲方的要求完成相应的工作,甲方应根据按劳分配、效率优先、兼顾公平的原则,按照国家规定和甲方依法制定的工资分配办法等规章制度按月以货币形式支付乙方的工资,公司每月7日前为员工支付上月工资(遇节假日则顺延)。甲方支付乙方的工资标准为: 元/月。工资额度必须对第三者保密,甲乙双方都应严

Both parties must keep the salary as a confidential matter to third party. 第九条 由于甲方生产任务不足,使乙方待岗的,甲方保证乙方的月生活费不低于日照市最低生活保障。 If Party A doesnt have enough work task and Party B have no work to do, Party A should gives Party B

13、the living allowance which should not be less than Rizhao Minimum living guarantee. 五、保险福利待遇 Insurance and welfare第十条 甲乙双方应按国家和山东省社会保险的有关规定交纳职工养老、失业和大病医疗统筹及其他社会保险费用。乙方应缴纳的部分按照法律法规应有甲方代扣代缴的,由甲方从乙方工资中代为扣缴。甲方应为乙方填写职工养老保险手册。双方解除、终止劳动合同后,职工养老保险手册按有关规定转移。Party A and Party B should pay endowment insurance,

14、 unemployment insurance and serious illness insurance and other social insurance as national and province regulations about insurance. The Part which should be paid by Party B should be withheld from salary by Party A. Party A should fill in Employee Endowment Insurance Handbook for Party B. After t

15、he termination of the contract, Employee Endowment Insurance Handbook should be handed over according to relevant regulations.第十一条 乙方患病或非因工负伤,其工资按照国家已经制定相关规定执行。 If Party B gets ill or gets hurt not because of work, then his/her salary should be calculated according to relevant national regulations.

16、第十二条 乙方患职业病或因工负伤的工资和医疗保险待遇按照国家和山东省有关规定执行。 If Party B gets occupational disease or gets hurt because of work, then his salary and medical insurance should be calculated as relevant national and province regulations.六、劳动纪律 Work Disciplines第十三条 乙方应遵守甲方依法制定的规章制度,严格遵守劳动安全卫生、生产工艺、操作规程和工作规范,以及劳动合同附件及职工保密协议

17、书,爱护甲方的财产,遵守职业道德;积极参加甲方组织的培训,提高思想觉悟和职业技能。 Party B should follow Party As disciplines and rules, following close to the line of operation safety requirements, process, operation rules and regulations, Appendix to Labor Contract and Employee Secret-Keeping Agreement. Party B should protect companys pr

18、operty, follow professional morality; Party B should be active to attend the training organized by Party A to increase professional skills.第十四条 乙方违反劳动纪律,甲方可依据本单位规章制度,给予纪律处分,直至解除本合同。 If Party B violates disciplines or regulations, Party A could give the penalty according to the companys regulation or

19、 rules, or even to end the contract.七、劳动合同的变更、解除、终止、续订 Change, terminate, end or renew the contract第十五条 订立本合同所依据的法律、行政法规、规章发生变化,本合同应变更相关内容。 If the relevant laws, regulations or rules have changed, this contract will be changed accordingly as well.第十六条 订立本合同所依据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,可以变更本合同

20、相关内容。 If the objective circumstance has changed a lot, which makes it not possible to continue this contract; after agreement of the two parties, the contract could be modified accordingly.第十七条 乙方有下列情形之一的,甲方可以解除本合同: Party A could end the contract with Party B, If Party B:1在试用期间,被证明不符合录用条件的; It is pr

21、oved during the probation period that Party B is not qualified for the work and employment;2. 严重违反劳动纪律或甲方规章制度的;Materially violate Party As rules and regulations;下列行为属于严重违反甲方劳动纪律或规章制度的行为:Those following actions belong to materially Violation:(1)在工作期间饮酒的; Drinking during the work time;(2)连续旷工超过15天或一年内

22、累计旷工超过30天的; Absent from work continue for 15 days or more than 30 days total a year.(3)乙方是驾驶员的,因其自身原因,其营运服务的证、照被吊扣或失效15天(含)以上的或发生行车事故次要责任(含)以上的; If Party B is driver, because of his mistake, the car or car license is caught by police or go out of valid period for more than 15 days (including), or in

23、 accident Party B take more than subordinate responsibility (including).(4) 在工作场所打架斗殴、妨碍干扰正常工作秩序及违犯社会治安管理条例的;Fight on working place, disturb normal working system, and violate society safety management regulation. (5) 乙方以欺诈、胁迫的手段,使甲方在违背真实意思情况下订立或者变更合同的; Party B sign or change the contract with party

24、 A without the willing the Party A by cheating or threating.(6) 在劳动关系存续期间,与其他用人单位(或个人)建立劳动关系或发生劳务关系的;During the contract Period, Party B does work for any other third employment Party.(7) 在工作期间搞其他产业或第二职业的。During work time, Party B does other work or secondary job.(8) 乙方在招聘录用时所填个人履历和档案等有关内容不真实,提供虚假信息

25、的。包括但不限于:离职证明、身份证明、户籍证明、学历证明、体检证明等是虚假或伪造的;应聘前患有精神病、传染性疾病及其他严重影响工作的疾病而在应聘时未声明 Party B gives the false information when filling in the Company Entrance Form, including but not limited to, Dimission Prove, ID prove, Residence Prove, Education Prove, Physical Checking Prove; have serious mental disorder

26、, infected illness or other illness which affects his work.3. 严重失职、营私舞弊,对甲方利益造成重大损害的((包括但不限于因个人故意或过失,一次给甲方造成3000元以上损失或连续12个月内累计造成5000元损失的);Commits serious dereliction of duty or practices graft, causing substantial damage to the Party A (including but not limited to the loss of 3000Yuan by one time

27、or total 5000Yuan within continue 12 months caused by Party Bs deliberately or fault) ;4, 被依法追究刑事责任的。Has his criminal liability pursued in accordance with the law.第十八条 下列情形之一,甲方可以解除本合同,但应提前三十日以书面形式通知乙方: If one of the following situations applies, Party A could terminate the contract, but has to info

28、rm Party B 30 days in advance by written:1、 乙方患病或非因工负伤,医疗期满后,不能从事原工作也不能从事由甲方另行安排的工作的;After the recovering period of medical care for an illness or non-work-related injury, Party B can engage neither in his original work nor in other work arranged for him by Party A.2、 乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;

29、Party B is incompetent and remains incompetent after training or adjustment of his position.3、 双方不能依据法律律规定和本合同约定就变更合同达成协议的。 Two parties can not reach the agreement to modify the contract as law or this contract.第十九条 甲方濒临破产进行法定整顿期间或者生产经营发生严重困难,经向工会或者全体职工说明情况,听取工作或者职工的意见,并向劳动行政部门报告后,可以解除本合同。 During re

30、structuring period pursuant to the Enterprise Bankruptcy Law or Serious difficulties in production and/or business operations, after Party A has explained the situations to its Labor Union or to all of his employees, and has considered the opinions of the Labor Union or the employees and has subsequ

31、ently reported to the labor administration department, Party A may terminate the contract.第二十条 乙方有下列情形之一的,甲方不得依据本合同第十八条、第十九条终止、解除合同: Party A may not terminate an employment contract pursuant to Article 18 or Article 19 hereof if Party B:1、患病或非因工负伤、在规定的医疗期内的;Has contracted an illness or sustained a n

32、on-work-related injury, and the recovering period of medical care therefore has not expired;2、女职工在孕期、产期、哺乳期内的;Is a female employee in her pregnancy, maternity or breast feeding period3、在本单位连续工作满十五年,且距法定退休年龄不足五年的;Has been working for the Employer continuously for not less than 15 years and is less than 5 years to his legal retirement age4、法律法规规定的其他情形。Other situations pursuant to Laws or regulations第二十一条 乙方患职业病或因
