根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《山东省劳动合同条例》，甲乙双方经平等协商同意，自愿签订本合同，共同遵守本合同所列条款。

一、劳动合同期限ContractPeriod

第一条本合同期限类型为无固定期限合同，开始时间为。

二、工作内容WorkContents

第二条乙方同意根据甲方工作需要，担任指定的岗位（工种）工作，以及其他由甲方指定的兼职工作和临时工作。

乙方工作地点为：

第三条乙方必须按照甲方的合法要求，按时完成规定的工作数量，达到规定的质量标准。

PartyBshouldfulfillalltheworkintimeandbyqualitystandardaccordingtoPartyA’slegalrequirements.

三、劳动保护、劳动条件、工作时间和休假WorkProtection,Condition,Timeand

Leaves

第四条甲方安排乙方执行8小时/日工作制，

甲方依法保证乙方的休息权利。

乙方在劳动合同履行期间依法享受法定节假日以及探亲假、婚丧假、产假、带薪年假等休假权利。

甲方安排乙方每日工作时间不超过8小时，每周工作5天，平均每周不超过40小时。

甲方保证乙方每周休息二天。

因特殊原因需要延长工作时间的，在保障乙方身体健康的条件下，甲乙双方友好协商执行，原则上每月不超过24小时。

PartyAarrangesPartyBtoworkmaximum8hoursperdayand5dayseveryweek,andtheaverageworkhoursperweekshouldbenotmorethan40hours.PartyAgivesPartyB2daysvacationeveryweek.BecauseofspecialreasonsPartyBneedstoworkover-hoursonthebasisofnormalhealthcondition,afteragreementoftwoparties.Basicallyitshouldnotbemorethan24hourseverymonth.

第五条甲方安排乙方加班的，应安排乙方同等时间补休或依法支付加班工资；加点的，甲方应付加点工资。

IfpartyArequirespartyBtodoovertimework,PartyAshouldgivetheequaltimeleaveinsomeothertimeorgiveovertimepaymentaccordingtolaw;ifpartyBneedstoworkinextensionhours,PartyAshouldpayfortheextensionhours.

第六条甲方为乙方提供必要的劳动条件和劳动工具，建立健全的生产工艺流程，制定操作规程、工作规范和劳动安全卫生制度及其标准。

PartyAshouldprovidethenecessaryworkconditionsandtools,buildupcompleteproductionprocessandmakeoperationregulations,rulesandsafetysystemandstandards.

第七条甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的教育和培训。

PartyAshouldarrangetogivethenecessarytrainingforPartyBaboutpoliticalthoughts,professionalmorality,operationskillsandoperationsafetyandregulations.

四、劳动报酬Workpayment

第八条乙方应按照甲方的要求完成相应的工作，甲方应根据按劳分配、效率优先、兼顾公平的原则，按照国家规定和甲方依法制定的工资分配办法等规章制度按月以货币形式支付乙方的工资，公司每月7日前为员工支付上月工资（遇节假日则顺延）。

甲方支付乙方的工资标准为:

元/月。

工资额度必须对第三者保密，甲乙双方都应严格遵守。

PartyBfulfillstheworkaccordingtotherequirementsofPartyA.PartyAshouldgivethepaymentincasheverymonthaccordingtonationallawandpartyA’s

salarypaymentregulationonthebasisofworking,efficiencyprioritywithdueconsiderationtofairness.Everymonthbefore7th,PartyAshouldpayPartyB’ssalaryforlastmonth.PartyB’ssalaryisYuan/Month.Both

partiesmustkeepthesalaryasaconfidentialmattertothirdparty.

第九条由于甲方生产任务不足，使乙方待岗的，甲方保证乙方的月生活费不低于日照市最低生活保障。

IfPartyAdoesn’thaveenoughworktaskandPartyBhavenoworktodo,PartyAshouldgivesPartyBthelivingallowancewhichshouldnotbelessthanRizhaoMinimumlivingguarantee.

五、保险福利待遇Insuranceandwelfare

第十条甲乙双方应按国家和山东省社会保险的有关规定交纳职工养老、失业和大病医疗统筹及其他社会保险费用。

乙方应缴纳的部分按照法律法规应有甲方代扣代缴的，由甲方从乙方工资中代为扣缴。

甲方应为乙方填写《职工养老保险手册》。

双方解除、终止劳动合同后，《职工养老保险手册》按有关规定转移。

PartyAandPartyBshouldpayendowmentinsurance,unemploymentinsuranceandseriousillnessinsuranceandothersocialinsuranceasnationalandprovinceregulationsaboutinsurance.ThePartwhichshouldbepaidbyPartyBshouldbewithheldfromsalarybyPartyA.

PartyAshouldfillinEmployeeEndowmentInsuranceHandbookforPartyB.Aftertheterminationofthecontract,EmployeeEndowmentInsuranceHandbookshouldbehandedoveraccordingtorelevantregulations.

第十一条乙方患病或非因工负伤，其工资按照国家已经制定相关规定执行。

IfPartyBgetsillorgetshurtnotbecauseofwork,thenhis/hersalaryshouldbecalculatedaccordingtorelevantnationalregulations.

第十二条乙方患职业病或因工负伤的工资和医疗保险待遇按照国家和山东省有关规定执行。

IfPartyBgetsoccupationaldiseaseorgetshurtbecauseofwork,thenhissalaryandmedicalinsuranceshouldbecalculatedasrelevantnationalandprovinceregulations.

六、劳动纪律WorkDisciplines

第十三条乙方应遵守甲方依法制定的规章制度，严格遵守劳动安全卫生、生产工艺、操作规程和工作规范，以及《劳动合同附件及职工保密协议书》，爱护甲方的财产，遵守职业道德；积极参加甲方组织的培训，提高思想觉悟和职业技能。

PartyBshouldfollowPartyA’sdisciplinesandrules,followingclosetothelineofoperationsafetyrequirements,process,operationrulesandregulations,AppendixtoLaborContractandEmployeeSecret-KeepingAgreement.PartyBshouldprotectcompany’sproperty,followprofessionalmorality;PartyBshouldbeactivetoattendthetrainingorganizedbyPartyAtoincreaseprofessionalskills.

第十四条乙方违反劳动纪律，甲方可依据本单位规章制度，给予纪律处分，直至解除本合同。

IfPartyBviolatesdisciplinesorregulations,PartyAcouldgivethepenaltyaccordingtothecompany’sregulationorrules,oreventoendthecontract.

七、劳动合同的变更、解除、终止、续订Change,terminate,endorrenewthecontract

第十五条订立本合同所依据的法律、行政法规、规章发生变化，本合同应变更相关内容。

Iftherelevantlaws,regulationsorruleshavechanged,thiscontractwillbechangedaccordinglyaswell.

第十六条订立本合同所依据的客观情况发生重大变化，致使本合同无法履行的，经甲乙双方协商同意，可以变更本合同相关内容。

Iftheobjectivecircumstancehaschangedalot,whichmakesitnotpossibletocontinuethiscontract;afteragreementofthetwoparties,thecontractcouldbemodifiedaccordingly.

第十七条乙方有下列情形之一的，甲方可以解除本合同：

PartyAcouldendthecontractwithPartyB,IfPartyB:

1．在试用期间，被证明不符合录用条件的；

ItisprovedduringtheprobationperiodthatPartyBisnotqualifiedfortheworkandemployment;

2.严重违反劳动纪律或甲方规章制度的；

MateriallyviolatePartyA’srulesandregulations;

下列行为属于严重违反甲方劳动纪律或规章制度的行为：

ThosefollowingactionsbelongtomateriallyViolation:

（1）在工作期间饮酒的；

Drinkingduringtheworktime;

（2）连续旷工超过15天或一年内累计旷工超过30天的；

Absentfromworkcontinuefor15daysormorethan30daystotalayear.

（3）乙方是驾驶员的，因其自身原因，其营运服务的证、照被吊扣或失效15天（含）以上的或发生行车事故次要责任（含）以上的；

IfPartyBisdriver,becauseofhismistake,thecarorcarlicenseiscaughtbypoliceorgooutofvalidperiodformorethan15days（including）,orinaccidentPartyBtakemorethansubordinateresponsibility（including）.

（4）在工作场所打架斗殴、妨碍干扰正常工作秩序及违犯社会治安管理条例的；

Fightonworkingplace,disturbnormalworkingsystem,andviolatesocietysafetymanagementregulation.

（5）乙方以欺诈、胁迫的手段，使甲方在违背真实意思情况下订立或者变更合同的；

PartyBsignorchangethecontractwithpartyAwithoutthewillingthePartyAbycheatingorthreating.

（6）在劳动关系存续期间，与其他用人单位（或个人）建立劳动关系或发生劳务关系的；

DuringthecontractPeriod,PartyBdoesworkforanyotherthirdemploymentParty.

（7）在工作期间搞其他产业或第二职业的。

Duringworktime,PartyBdoesotherworkorsecondaryjob.

（8）乙方在招聘录用时所填个人履历和档案等有关内容不真实，提供虚假信息的。

包括但不限于：

离职证明、身份证明、户籍证明、学历证明、体检证明等是虚假或伪造的；应聘前患有精神病、传染性疾病及其他严重影响工作的疾病而在应聘时未声明

PartyBgivesthefalseinformationwhenfillingintheCompanyEntranceForm,includingbutnotlimitedto,DimissionProve,IDprove,ResidenceProve,EducationProve,PhysicalCheckingProve;haveseriousmental

disorder,infectedillnessorotherillnesswhichaffectshiswork.

3.严重失职、营私舞弊，对甲方利益造成重大损害的（（包括但不限于因个人故意或过失，一次给甲方造成3000元以上损失或连续12个月内累计造

成5000元损失的）；

Commitsseriousderelictionofdutyorpracticesgraft,causingsubstantialdamagetothePartyA（includingbutnotlimitedtothelossof3000Yuanbyonetimeortotal5000Yuanwithincontinue12monthscausedbyPartyB’sdeliberatelyorfault）;

4,被依法追究刑事责任的。

Hashiscriminalliabilitypursuedinaccordancewiththelaw.

第十八条下列情形之一，甲方可以解除本合同，但应提前三十日以书面形式通知乙方：

Ifoneofthefollowingsituationsapplies,PartyAcouldterminatethecontract,buthastoinformPartyB30daysinadvancebywritten:

1、乙方患病或非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方另行安排的工作的；

Aftertherecoveringperiodofmedicalcareforanillnessornon-work-relatedinjury,PartyBcanengageneitherinhisoriginalworknorinotherworkarrangedforhimbyPartyA.

2、乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的；

PartyBisincompetentandremainsincompetentaftertrainingoradjustmentofhisposition.

3、双方不能依据法律律规定和本合同约定就变更合同达成协议的。

Twopartiescannotreachtheagreementtomodifythecontractaslaworthiscontract.

第十九条甲方濒临破产进行法定整顿期间或者生产经营发生严重困难，经向工会或者全体职工说明情况，听取工作或者职工的意见，并向劳动行政部门报告后，可以解除本合同。

DuringrestructuringperiodpursuanttotheEnterpriseBankruptcyLaworSeriousdifficultiesinproductionand/orbusinessoperations,afterPartyAhasexplainedthesituationstoitsLaborUnionortoallofhisemployees,andhasconsideredtheopinionsoftheLaborUnionortheemployeesandhassubsequentlyreportedtothelaboradministrationdepartment,PartyAmayterminatethecontract.

第二十条乙方有下列情形之一的，甲方不得依据本合同第十八条、第十九条终止、解除合同：

PartyAmaynotterminateanemploymentcontractpursuanttoArticle

18orArticle19hereofifPartyB:

1、患病或非因工负伤、在规定的医疗期内的；

Hascontractedanillnessorsustainedanon-work-relatedinjury,andtherecoveringperiodofmedicalcarethereforehasnotexpired;

2、女职工在孕期、产期、哺乳期内的；

Isafemaleemployeeinherpregnancy,maternityorbreastfeedingperiod

3、在本单位连续工作满十五年，且距法定退休年龄不足五年的；

HasbeenworkingfortheEmployercontinuouslyfornotlessthan15years

andislessthan5yearstohislegalretirementage

4、法律法规规定的其他情形。
