2、g to Europe for a PhD under the fund of Party A, two parties, through equal negotiation, have reached and shall abide by the following agreement. 第一条 为招揽人才，甲方自愿资助乙方赴 （国家）留学，帮助其至 大学的 教授处攻读博士学位，资助期限为4年（具体起止时间以乙方录取通知的留学期限为准）。Article 1 In order to attract talents, Party A voluntarily grants financial ai

3、d to Party B to study abroad in (country) for a PhD with Professor of University for a period of four years. 第二条 在乙方留学攻读博士学位期间，甲方自愿按照每月1350欧元（1350/月）的标准，向乙方提供生活费资助，即甲方每年应提供资助费用总计16200欧元。Article 2 During Party Bs pursuit of the PhD, Party A voluntarily provide Party B with living expenses of 1350 per

Both parties agree that the service term shall be no less than 2 years, starting from the date of work. 乙方在服务期内的具体工资标准及福利待遇由甲乙双方届时另行协商确定，但基本工资不得低于人民币 元/月。 The specific wage standard and benefits in the service term will be otherwise agreed by both parties. 7、 less than RMB Yuan per month. 第五条 双方权责Article 5 Rights and obligations（一）甲方 Party A1.本协议签订后，甲方应当按照本协议约定，及时、足额将每年的资助费用支付至乙方指定收款账户，以保障乙方顺利完成学业；Upon the execution of this agreement, Party A shall, in accordance with the provisions of this agreement, pay the annual fund in full and in time to the accou

8、nt designated by Party B, to ensure Party Bs successful completion of his/her studies. 2.乙方留学结束后，甲方有权要求乙方到安排的岗位提供服务。After the end of Party Bs overseas study, Party A is entitled to require Party B to provide service at the position Party A arranges. 3.乙方未能够按照计划顺利毕业时，甲方有权对其延期毕业原因进行调查核实。If Party B can

9、not graduate according to the plan, Party A has right to investigate on the reasons for the delayed graduation. （二）乙方 Party B1.乙方在留学期间，应当专心学业，提高自身的知识水平与专业技能，完成留学计划。During overseas study, Party B shall concentrate on the studies, improve his/her knowledge and professional skills, and complete the ove

10、rseas study plan. 2.乙方留学结束后，应当及时返回国内，按照约定到甲方处参加工作，运用其所学知识与技能为甲方创造实际的经济效益。After the end of overseas study, Party B shall return to China in time, work with Party A as agreed and then create actual economic benefits for Party A by applying the knowledge and skills he/she has obtained abroad. 3.如本协议第一条

11、约定的资助期限届满，乙方未能够顺利毕业的，乙方应提前 天通知甲方，并及时向甲方申请延长资助期限。If Party B cannot successfully graduate at the expiry of the subsidy period under Article 1 of this agreement, he/she shall inform Party A in advance days and apply to Party A timely for the extension of subsidy period. 第六条 资助期限的延长Article 6 Extension o

12、f subsidiary period如乙方无法顺利毕业非因其个人消极懈怠学业所致，经甲方调查核实后，甲方可根据乙方申请，适当延长资助期限，但每次延长期限最长不超过1年，申请延期次数不得超过2次。If Party A investigates and finds that Party Bs failure to graduate is caused by his/her being negative or passive in study, it may appropriately extend the subsidy period according to Party Bs applicat

13、ion, provided that the extension period shall not exceed 1 year each time, and the application for extension shall not exceed 2 times. 第七条 违约责任Breach of agreement1.如约定的资助期限届满，乙方因个人原因，在两次延期后仍然不能毕业的，乙方应向甲方支付违约金，违约金计算方式如下：违约金=甲方资助总费用120%。If Party B cannot graduate after two times of extension due to pe

14、rsonal reasons at the expiry of the agreed subsidiary period, he/she shall pay liquidated damages to Party A, which shall be calculated as follows: liquidated damages = the total funds paid by Party A * 120%.2.如乙方留学结束后未按约定回国为甲方服务的，乙方应向甲方支付违约金，计算方式如下：违约金=甲方资助总费用150%。If Party B does not return to prov

15、ide service for Party A as agreed after the end of overseas study, he/she pay liquidated damages to Party A, which shall be calculated as follows: liquidated damages = the total funds paid by Party A * 150%.3.如乙方在服务期限内停止为甲方提供劳务的，乙方应向甲方支付违约金，计算方式如下：违约金=甲方资助总费用未服务年限总服务年限150%。（注：协议约定服务期限和实际服务期限精确到月，费用金

16、额四舍五入，保留整数。）If Party B stops provide service for Party A during the service period, he/she pay liquidated damages to Party A, which shall be calculated as follows: liquidated damages = the total funds paid by Party A * uncompleted years of service/total years of service *150%.4.本协议履行期间，如甲方未能按照本协议约定及

17、时、足额支付资助费用的，每逾期一次，甲方应向乙方支付违约金人民币 元（大写： 元整）。逾期支付超过 次的，乙方有权解除本协议。During the performance of this agreement, Party A shall pay liquidated damages of RMB Yuan to Party B (Capital: Yuan) every time for its failure to grant the fund in full and in time as agreed. 5.除本协议另有约定外，任一方直接或间接违反本协议任何条款的均视为违约，违约方须向守约

18、方支付违约金人民币 元（大写： 元整）。 Unless otherwise provided by this agreement, any direct or indirect violation of any provisions of this agreement by any party shall be deemed as breach of agreement and the breaching party shall pay liquidated damages of RMB Yuan to the non-breaching party. 6.甲乙双方均同意赔偿由于自身原因或违反

19、本协议给守约方造成的实际损失（包括直接损失和预期可得收益），并支付守约方为避免或减少损失而支付的合理费用，包括但不限于诉讼/仲裁费、鉴定费、公证费、保全费、律师费。Both parties agree to compensate for the actual loss including direct loss and expected gains, caused by its own reasons or breach of this agreement to the non-breaching party, and pay the non-breaching party for reaso

20、nable expenses incurred for avoiding or reducing loss, including but not limited to litigation/arbitration fee, authentication fee, notary fee, preservation fee, and attorney fee. 第八条 特别约定Article 8 Special Provision1.甲方资助乙方留学期间，乙方将同时申请中国国家奖学金。如乙方申请中国国家奖学金成功的，自该笔奖学金发放至乙方账户之次月，甲方可以停止对乙方的资助，并要求乙方返还已支付的

21、资助费用。如乙方申请中国国家奖学金失败的，甲方则应当按照本协议约定继续为乙方提供资助，直至乙方毕业。During the period of studying abroad, Party B may at the same time apply for a Chinese national scholarship. If Party B successfully applies for the Chinese national scholarship, Party A may stop funding Party B the next month since scholarship is pa

22、id to Party Bs account and ask Party B to return the fund which has been already given. If Party B fails to apply for a Chinese national scholarship, Party A shall continue to provide financial assistance to Party B as agreed herein until Party Bs graduation. 2.乙方应当在收到申请结果之日起 日内，及时将其获奖情况告知甲方。如乙方申请奖金

23、学成功的，应当在甲方通知返还资助费用之日起一个月内将甲方已支付资助费用一次性退还至甲方指定账户。本协议自乙方全额退回资助费用之日起失效。Party B shall, within days upon receipt of the application result, inform Party A of the award of scholarship. If Party B successfully applies for a scholarship, he/she shall refund the amount paid by Party A to the account designat

24、ed by Party A in a lump sum within one month after Party As notice of return of the fund. This agreement shall become invalid on the date when Party B refunds the full amount.第九条 争议的解决Article 9 Settlement of Dispute1.本协议受中华人民共和国法律管辖并按其进行解释。This agreement shall be governed by and construed in accorda

25、nce with the laws of the Peoples Republic of China. 2.凡因履行本协议所发生的争议，各方应友好协商解决，如协商不成，任何一方可向有管辖权的人民法院起诉。Any dispute arising out of the performance of this agreement shall be settled by the parties through friendly negotiation. Otherwise, each party may file a lawsuit with the peoples court having juri

26、sdiction. 第十条 其他事项Miscellaneous1.本协议经甲乙双方盖章（签字）后生效。This agreement shall come into force upon being sealed (signed) by both parties. 2.经甲乙双方协商一致，可对本协议进行补充、修改；补充、修改内容与本协议相冲突的，以补充、修改后的内容为准。This agreement may be supplemented or modified upon consensus of both parties through negotiation. In case of any
