INTRODUCTION

1.ThisShipboardOilPollutionEmergencyPlan(hereafterreferredtoasthe"Plan")iswritteninaccordancewiththerequirementsofregulation37ofAnnexIoftheInternationalConventionforthePreventionofPollutionfromShips,1973asmodifiedbytheProtocolof1978relatingthereto.

 

2.ThepurposeofthePlanistoprovideguidancetotheMasterandofficersonboardtheshipwithrespecttothestepstobetakenwhenanoilpollutionincidenthasoccurredorislikelytooccur.TheappendicescontaincommunicationdataofallcontactsreferencedinthePlan,aswellasotherreferencematerial.

 

3.ThePlancontainsallinformationandoperationalinstructionsasrequiredbythe"GuidelinesforthedevelopmentoftheShipboardOilPollutionEmergencyPlan"asdevelopedbytheOrganization(IMO),publishedunderMEPC.54(32)andamendedbyMEPC.86(44).

4.ThePlanhasbeenapprovedbytheAdministrationorontheirbehalfand,exceptasprovidedbelow,noalterationorrevisionshallbemadetoanypartofitwithoutthepriorapprovalbyoronbehalfoftheAdministration.

 

5.ChangestoSection5andtheappendicesarenotrequiredtobeapproved.Theappendicesshouldbemaintaineduptodatebytheowners,operatorsandmanagers.

SECTION1:

PREAMBLE

1.1ThisPlanisavailabletoassisttheship’spersonnelindealingwithanunexpecteddischargeofoil.Itsprimarypurposeistosetinmotionthenecessaryactionstostoporminimizethedischargeofoilandtomitigateitseffects.

1.2Effectiveplanningensuresthatthenecessaryactionsaretakeninastructured,logicalandtimelymanner.

1.3TheprimaryobjectivesofthisPlanareto

∙preventoilpollution

∙stoporminimizeoiloutflowwhenadamagetotheshiporitsrequirementsoccurs

∙stoporminimizeoiloutflowwhenaoperationalspilloccursinexcessofthequantityor

instantaneousratepermittedunderthepresentConvention

1.4Further,thepurposeofthePlanistoprovidetheMaster,officersandcertaincrewmemberswithapracticalguidetothepreventionofoilspillsandincarryingouttheresponsibilitiesassociatedwithregulation37ofAnnexItoMARPOL73/78

∙procedurestoreportanoilpollutionincident

∙CoastalStatecontacts(FocalPoints)andPortContactListstobecontactedinthe

eventofanoilpollutionincident

∙responseactionstoreduceorcontrolthedischargeofoilfollowinganincident

∙co-ordinationwithnationalandlocalAuthoritiesincombatingoilpollution

1.5Insummary,thePlanwillservetopromoteapractisedresponsewhentheship’spersonnelisfacedwithanoilspill.

1.6AlthoughthePlanisdesignedasaship-specifictoolitmustalsobeconsideredasanadditionalinstrumentandasalinktoshore-basedplans.WiththisthePlansallowanefficientco-ordinationbetweentheshipandshore-basedAuthorities/Organizationsinmitigatingtheeffectsofanoilpollutionincident.

1.7ThePlanincludesasummaryflowcharttoguidetheMasterthroughreportingandactingproceduresrequiredduringanoilpollutionincidentresponse.

1.8ThePlanislikelytobeadocumentusedonboardbytheMasterandofficersoftheshipandmustthereforebeavailableintheworkinglanguageusedbythem.

SECTION2:

REPORTINGREQUIREMENTS

2.1General

Thereportingrequirementofthissectioncomplieswiththoseofregulation37ofMARPOL73/78,AnnexI.

Whentheshipisinvolvedinanincidentwhichresultsinthedischargeorprobabledischargeofoil,theMasterisobligedunderthetermsofMARPOL73/78toreportdetailsoftheincident,withoutdelay,tothenearestCoastalStatebymeansofthefastesttelecommunicationchannelsavailable.

TheintentoftheserequirementsaretoensurethatCoastalStatesareinformed,withoutdelay,ofanyincidentgivingrisetooilpollution,orthreatofoilpollution,ofthemarineenvironment,aswellasofassistanceandsalvagemeasures,sothatappropriateactionmaybetaken.

Withoutinterferingwithshipowners'liability,somecoastalstatesconsiderthatitistheirresponsibilitytodefinetechniquesandmeanstobetakenagainstanoilpollutionincidentandapprovesuchoperationswhichmightcausefurtherpollution,i.e.lightening.StatesareingeneralentitledtodosoundertheInternationalConventionrelatingtoInterventionontheHighSeasinCasesofOilPollutionCasualties,1969.

 

2.2ReportingProcedures

ForeasyreferencethereportingrequirementsinthecontextofthisPlanaredividedinthefollowinginformationblocks:

2.2.1Whentoreport

Takingthesummaryflowchartasabasicguideintoconsiderationreportsarenecessaryinthefollowingcases:

2.2.1.1ActualDischarge

TheMasterisobligedtoreporttothenearestCoastalStatewheneverthereisadischargeofoilresulting

∙fromdamagetotheship

∙fromdamagetotheship’sequipment

∙forthepurposeofsecuringthesafetyofashiporsavinglifeatsea

∙duringtheoperationoftheShipinexcessofthequantityorinstantaneousratepermittedunderthepresentConvention

2.2.1.2ProbableDischarge

TheMasterisobligedtoreportevenwhennoactualdischargeofoilhasoccurredbutthereisaprobabilitythatonecould.

However,asitisnotpracticabletolaydownprecisedefinitionsofalltypesofsituationsinvolvingprobabledischargeofoilwhichwouldwarrantanobligationtoreporttheMasterisobligedtojudgebyhimselfwhetherthereissuchaprobabilityandwhetherareportshouldbemade.

Therefore,itisrecommendedthat,atleast,thefollowingevents

∙damage,failureorbreakdownwhichaffectsthesafetyoftheship(e.g.collision,grounding,fire,explosion,structuralfailure,flooding,cargo,cargoshiftingetc.)

or

∙failureorbreakdownofmachineryorequipmentwhichresultsinimpairmentofthesafetyofnavigation(e.g.failureorbreakdownofsteeringgear,propulsion,electricalgeneratingsystem,essentialshipbornenavigationaidsetc.)

arecarefullyconsideredbytheMaster–takingintoaccountthenatureofthedamagefailureorbreak-downoftheship,machineryorequipmentaswellastheship’slocation,proximitytoland,weather,stateoftheseaandtrafficdensity–ascasesinwhichaprobabledischargeofoilismostlikely.

Ifindoubt,theMastershouldalwaysmakeareportincasesaforementioned.

InallcasestheAuthoritiesshouldbekeptinformedbytheMasterashowthesituationprogressandbeadvisedwhenallthreatofpollutionhaspassed.

2.2.2InformationRequired

Asrequiredinarticle8andProtocolIofMARPOL73/78ConventiontheMasterorotherpersonshavingchargeoftheshipshouldreporttheparticularsofanypollutionincident.InthiscontexttheInternationalMaritimeOrganization(IMO),in1997,adoptedResolutionA.851(20)"GeneralPrinciplesforShipReportingSystemsandShipReportingRequirements,includingGuidelinesforReportingIncidentsinvolvingDangerousGoods,HarmfulSubstancesand/orMarinePollutants".

TheintentoftheResolutionaforementionedistoenableCoastalStatesandotherinterestedpartiestobeinformed,withoutdelay,ofanyincidentgivingrisetooilpollution,orthreatofoilpollution,ofthemarineenvironment,aswellasofassistanceandsalvagemeasures,sothatappropriateactionmaybetaken.

NothinginthischapterrelievestheMasterinusingsoundjudgementtomakesurethatanyincidentorprobabledischargeofoilisreportedasquicklyaspossibleintheprevailingsituation.

WhentransmittinginitialreportstotheauthoritiesofthenearestCoastalStatetheMasterorotherpersonsdealingwithsuchatransmissionshouldtakenoteofResolutionA.851(20).
