(AdoptedatheEighthMeetingoftheStandingCommitteeoftheEighthNationalPeoplesCongressonJuly5,1994,promulgatedbyOrderNo.28ofthePresidentofthePeoplesRepublicofChinaonJuly5,1994,andeffectiveasofJanuary1,1995)

Chapter1-GeneralProvisions

Article1

ThisLawisherebyformulatedinaccordancewiththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflaborers,readjustlaborrelationship,establishandsafeguardthelaborsystemsuitingthesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.

Article2

ThisLawappliestoenterprises,individually-ownedeconomicorganizations(hereinafterreferredtoastheemployer)andlaborerswhoformalaborrelationshipwiththemwithintheboundaryofthePeoplesRepublicofChina.

Statedepartments,institutionalorganizationsandsocialgroupsandlaborerswhoformalaborrelationshipwiththemshallfollowthisLaw.

Article3

Laborershavetherighttobeemployedonanequalbasis,chooseoccupations,obtainremunerationsforlabor,takerests,haveholidaysandleaves,receivelaborsafetyandsanitationprotection,gettraininginprofessionalskills,enjoysocialinsuranceandwelfaretreatment,andsubmitapplicationsforsettlementoflabordisputes,andotherlaborrightsstipulatedbylaw.

Laborersshallfulfilltheirtasksoflabor,improvetheirprofessionalskills,followrulesonlaborsafetyandsanitation,observelabordisciplineandprofessionalethics.

Article4

Theemployershallestablishandperfectrulesandregulationsinaccordancewithlawandguaranteethatlaborersenjoylaborrightandfulfilllaborobligations.

Article5

TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,formulatelaborstandards,regulatesocialincomes,perfectsocialinsurance,coordinatelaborrelationships,andgraduallyraisethelivingleveloflaborers.

Article6

TheStateshalladvocatelaborersparticipationinsocialvoluntarylabor,laborcompetition,andactivitiesofforwardingrationalproposals;encourageandprotectlaborersinscientificresearch,technicalrenovation,andinvention;andcommendandawardlabormodelsandadvancedworkers.

Article7

Laborersshallhavetherighttoparticipateinandorganizetradeunionsinaccordancewithlaw.

Tradeunionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflaborers,andstageactivitiesindependentlyinaccordancewithlaw.

Article8

Laborersshalltakepartindemocraticmanagementthroughworkerscongress,workersrepresentativeassembly,oranyotherformsinaccordancewithlaw,orconsultwiththeemployeronanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflaborers.

Article9

ThelabormanagementdepartmentundertheStateCouncilshalltakechargeofthemanagementoflaborofthewholecountry.

Localpeoplesgovernmentsabovethecountylevelshalltakechargeofthemanagementoflaborinareasundertheirjurisdiction.

Chapter2-PromotionofEmployment

Article10

TheStateshallcreateemploymentconditionsandexpandemploymentopportunitiesthroughpromotionofeconomicandsocialdevelopment.

TheStateshallencourageenterprises,institutionalorganizations,andsocialgroupstostartindustriesorexpandbusinesseswithinthescopeallowedbystipulationsoflawsandadministrativedecreesforthepurposeofincreasingemployment.

TheStateshallsupportlaborerstoorganizeandemploythemselvesonavoluntarybasisandtogetemployedinindividualbusinesses.

Article11

Localpeoplesgovernmentsatvariouslevelsshalltakemeasurestodevelopvariouskindsofjobagenciesandprovideemploymentservices.

Article12

Laborersshallnotbediscriminatedagainstinemploymentduetotheirnationality,race,sex,orreligiousbelief.

Article13

Womenshallenjoyequalrightsasmeninemployment.SexshallnotbeusedasapretextforexcludingwomenfromemploymentduringrecruitmentofworkersunlessthetypesofworkorpostsforwhichworkersarebeingrecruitedarenotsuitableforwomenaccordingtoStateregulations.Norshallthestandardsofrecruitmentberaisedwhenitcomestowomen.

Article14

Anyspecialstipulationsinlawsandregulationsabouttheemploymentofthedisabled,minoritypeople,anddemobilizedsoldiersshallbeobserved.

Article15

Theemployershallbebannedfromrecruitingjuvenilesundertheageof16.

Art,sportsandspecial-skillunitsthatplantorecruitjuvenilesundertheageof16shallgothroughexaminationandapprovalproceduresaccordingtorelevantStateregulationsandguaranteetherightoftheemployedtoreceivecompulsoryeducation.

Chapter3-LaborContractsandCollectiveContracts

Article16

Laborcontractsareagreementsreachedbetweenlaborersandtheemployertoestablishlaborrelationshipsandspecifytherights,interestsandobligationsofeachparty.

Laborcontractsshallbeconcludediflaborrelationshipsaretobeestablished.

Article17

Conclusionandalterationoflaborcontractsshallfollowtheprincipleofequality,voluntariness,*andagreementthroughconsultation.Theyshallnotruncountertostipulationsinlawsoradministrativedecrees.

Laborcontractsshallbecomelegallybindingoncetheyareconcludedinaccordancewithlaw.Thepartiesinvolvedshallfulfillobligationsstipulatedinlaborcontracts.

Article18

Thefollowinglaborcontractsshallbeinvalid;

(1)Laborcontractsconcludedagainstlawsoradministrativedecrees;

(2)Laborcontractsconcludedthroughcheating,threat,oranyothermeans.

Invalidlaborcontractsshallnotbelegallybindingfromtheverybeginningoftheirconclusion.Ifalaborcontractisconfirmedasbeingpartiallyinvalid,theotherpartsshallbevalidifthepartsthatareinvaliddonotaffectthevalidityoftheseotherparts.

Theinvalidityofalaborcontractshallbeconfirmedbyalabordisputearbitrationcommitteeorapeoplescourt.

Article19

Laborcontractsshallbeconcludedinwrittenformandcontainthefollowingclauses:

(1)Timelimitofthelaborcontract;

(2)Contentofwork;

(3)Laborprotectionandlaborconditions;

(4)Laborremunerations;

(5)Labordisciplines;

(6)Conditionsfortheterminationofthelaborcontract;

(7)Liabilitiesforviolationsofthelaborcontract.

Apartfromthenecessaryclausesspecifiedintheprecedingclause,thepartiesinvolvedcanincludeintheirlaborcontractsothercontentsagreeduponbythemthroughconsultation.

Article20

Thetimelimitsoflaborcontractsshallbedividedintofixedandflexibletimelimitsandtimelimitsforthecompletionofcertainamountofwork.

Laborcontractswithflexibletimelimitsshallbeconcludedbetweenthelaborersandtheemployeriftheformerrequestfortheconclusionoflaborcontractswithflexibletimelimitsafterworkingcontinuouslywiththeemployerformorethen10yearsandwithagreementbetweenbothofthepartiesinvolvedtoprolongtheircontracts.

Article21

Probationperiodscanbeagreeduponinlaborcontracts.Theseprobationperiodsshallnot,however,exceedsixmonthsatthelongest.

Article22

Thepartiesinvolvedinalaborcontractcanreachagreementsintheirlaborcontractsonmattersconcerningthekeepingofthecommercialsecretsoftheemployer.

Article23

Laborcontractsshallterminateupontheexpirationoftheirtimelimitsortheoccurrenceoftheconditionsagreeduponinlaborcontractsbythepartiesinvolvedforterminatingthesecontracts.

Article24

Laborcontractscanberevokedwithagreementreachedbetweenthepartiesinvolvedthroughconsultation.

Article25

Theemployercanrevokelaborcontractsshouldanyoneofthefollowingcasesoccurwithitslaborers:

(1)Whentheyareprovedduringprobationperiodstobeunqualifiedforemployment;

(2)Whentheyseriouslyviolatelabordisciplinesortherulesorregulationsoftheemployer;

(3)Whentheycausegreatlossestotheemployerduetoseriousderelictionofdutiesorengagementinmalpracticeforselfishends;

(4)Whentheyarebroughttoholdcriminalresponsibilitiesinaccordancewithlaw.

Article26

Theemployercanrevokelaborcontractsshouldanyoneofthefollowingcasesoccur,withitslaborerstobenotified,inwrittenform,ofsuchrevocationin30daysadvance:

(1)Thelaborerscanneithertakeuptheiroriginaljobsnoranyotherkindsofnewjobsassignedbytheemployeraftercompletionofmedicaltreatmentfortheirillnessesorinjuriesnotsufferedduringwork;

(2)Thelaborersareincompetentattheirjobsandremainassoevenaftertrainingorafterreadjustingtheworkposts;

(3)Noagreementsonaalterationoflaborcontractscanbereachedthroughconsultationbetweenandbythepartiesinvolvedwhenmajorchangestakingplaceintheobjectiveconditionsservingasthebasisoftheconclusionofthesecontractspreventthembeingimplemented.

Article27

Incaseitbecomesamustfortheemployertocutdownthenumberofworkforceduringtheperiodoflegalconsolidationwhenitcomestothebrinkofbankruptcyorwhenitrunsdeepintodifficultiesinbusiness,theemployershallexplainthesituationtoitstradeunionorallofitsemployees30daysinadvance,solicitopinionsfromitstradeunionortheemployees,andreporttothelaboradministrativedepartmentbeforeitmakessuchcuts.

IftheemployercutsitsstaffaccordingtostipulationsinthisArticleandthenseeksrecruitswithinsixmonths,itshallfirstrecruitthosethathavebeencut.

Theemployershallmakeeconomi
