请求依法确认将位于陆集西街王启才宅基以北、以东的一宗宅基地确权给申请人使用。

事实和理由:

申请人和被申请人同住陆集村陆集西街～申请人共兄弟五人。

申请人的父亲王子钦在世时给兄弟五人分家～老大王启发～父母分给的地点在陆集南北街路东两间房子。

老二王启才～父母分给他的地点在陆集西边住房三间～厨房一间的一个院子。

老三王启友～父母分给他的地点在陆集北头住房三间。

老四王启富,既申请人,～父母分给他的地点在陆集西街路北住房三间后有院子。

老五王启漂～父母分给他的地点在陆集西街路北两间楼房后有院子。

1992年11月9日申请人的父亲王子钦在世和被申请人王启才签有一份协议～协议规定:

调解将父亲的三间门面的西边一间交给二子王启才居住～由王启才使用管理～王启才的门面范围:

南靠大路、北靠申请人王启富宅子、东靠申请人王启富门面、西靠土路、界线以灰桩为准。

如果今后街道加宽或重建房屋门面需要向后移动～王启才居住的一间门面的位置必须同时往后移动和东边的门面保持一致～王子钦与四子王启富,被申请人,～五子王启漂分家后不论门面交给谁都必须照此执行。

父母去世后把老宅基地分给了申请人王启富使用。

2009年3月28日为落实申请人父亲王子钦的协议～经王启发、牛国利、王启友、王子军调解申请人和王排涛,被申请人王启才的儿子,重新签订了协议:

规定被申请人王启才的宅基向北移动～南北总长度14米。

但被申请人不顾父母已把老宅基地分给了申请人的事实～任意歪曲理解协议认为已分给申请人的宅基地仍然是父母的继续向北侵占～多次辱骂申请人～毁坏申请人的财产～对申请人的生活造成了严重影响。

经村干部、镇司法所多次无效。

申请人根据《中华人民共和国土地法》第十六条、《安徽省土地权属争议管理条例》第三十条、第三十四条规定申请王集镇人民政府依法支持申请人的请求。

申请人宅基纠纷的调解工作。

申请人的父亲王子钦有五个儿子～大儿子王启发结婚后分家到东边老宅基两间空地～二儿子叫王启才,即被申请人,结婚后分家在陆集西边的一片宅基、三间堂屋一间厨房～老三王启友分家在北地、三间堂屋。

老二、老三住的宅基都是王子钦家的荒地～老四,即申请人,、老五年龄小给父母住一起。

申请人父亲的老宅基是瓦房～路北边靠路～前面三间、后面三间一个整院～这片宅基东边的两间楼房上下四间～分给老五王启漂了～申请人的父亲王子钦住的这片宅基前面三间、后面三间对着都分给老四王启富,即申请人,啦～这片宅基全部是申请人的。

在申请人的父亲王子钦活着的时候～申请人从西边临时给其父一间卖杂货～这一间房子地皮都是申请人的～后来被申请人王启才给申请人的父亲闹～搬到申请人借给父亲那一间杂货铺中住着不走～再后来经大家协商～考虑到被申请人王启才残疾～生活较困难～就把这间杂货铺交给被申请人使用～当时四个角都订了灰桩～并且订了协议～给被申请人王启才的那一间房子就是门面～原房子多宽就是多宽～不是通到宅基北边～北边仍然属于申请人王启富所有使用～另外房子西边还有一条小路三尺～向后院来回走的～1992年的协议书规定靠路的三间翻建时向北移多宽都移多宽～三间门面保持一致。

边是他的宅基～后来经我、牛国利,老表关系,、王启友、王启法、申请人王启富、被申请人王启才一家三口,被申请人的妻子范素勤、儿子排涛,～被申请人王启才要求向北与他那一间房屋一直到宅基北边都要完～申请人王启富不同意～因那老房子以北都是申请人王启富的宅基～后来我硬做工作～叫被申请人王启才从他老堂屋后墙向北移8米～从前墙皮向北共14米属于被申请人王启才使用～被申请人及其全家都同意啦。

后来又做申请人王启富的工作～因为我是申请人的小叔～硬压才于2009年3月28日签了合同～合同规定被申请人王启才的使用范围只有14米～14米以北属申请人王启富所有和使用～被申请人王启才再往北侵占是没有道理的。

他参与了申请人和被申请人宅基纠纷的处理。
