CONVENTION

ONINTERNATIONALCIVILAVIATION

SignedatChicago,

on7December19441

PREAMBLE

      WHEREASthefuturedevelopmentofinternationalcivilaviationcangreatlyhelptocreateandpreservefriendshipandunderstandingamongthenationsandpeoplesoftheworld,yetitsabusecanbecomeathreattothegeneralsecurity;

       WHEREASitisdesirabletoavoidfrictionandtopromotethatcooperationbetweennationsandpeoplesuponwhichthepeaceoftheworlddepends;

      THEREFORE,theundersignedgovernmentshavingagreedoncertainprinciplesandarrangementsinorderthatinternationalcivilaviationmaybedevelopedinasafeandorderlymannerandthatinternationalairtransportservicesmaybeestablishedonthebasisofequalityofopportunityandoperatedsoundlyandeconomically;

       HaveaccordinglyconcludedthisConventiontothatend.

CHAPTERI

GENERALPRINCIPLES

ANDAPPLICATIONOFTHECONVENTION

Article1

Sovereignty

        ThecontractingStatesrecognizethateveryStatehascompleteandexclusivesovereigntyovertheairspaceaboveitsterritory.

Article2

Territory

        ForthepurposesofthisConventiontheterritoryofaStateshallbedeemedtobethelandareasandterritorialwatersadjacenttheretounderthesovereignty,suzerainty,protectionormandateofsuchState.

Article3

Civilandstateaircraft

        (a)ThisConventionshallbeapplicableonlytocivilaircraft,andshallnotbeapplicabletostateaircraft.

        (b)Aircraftusedinmilitary,customsandpoliceservicesshallbedeemedtobestateaircraft.

        (c)NostateaircraftofacontractingStateshallflyovertheterritoryofanotherStateorlandthereonwithoutauthorizationbyspecialagreementorotherwise,andinaccordancewiththetermsthereof.

        (d)ThecontractingStatesundertake,whenissuingregulationsfortheirstateaircraft,thattheywillhavedueregardforthesafetyofnavigationofcivilaircraft.

Article3bis2

        (a)ThecontractingStatesrecognizethateveryStatemustrefrainfromresortingtotheuseofweaponsagainstcivilaircraftinflightandthat,incaseofinterception,thelivesofpersonsonboardandthesafetyofaircraftmustnotbeendangered.ThisprovisionshallnotbeinterpretedasmodifyinginanywaytherightsandobligationsofStatessetforthintheCharteroftheUnitedNations.

           (b)ThecontractingStatesrecognizethateveryState,intheexerciseofitssovereignty,isentitledtorequirethelandingatsomedesignatedairportofacivilaircraftflyingaboveitsterritorywithoutauthorityoriftherearereasonablegroundstoconcludethatitisbeingusedforanypurposeinconsistentwiththeaimsofthisConvention;itmayalsogivesuchaircraftanyotherinstructionstoputanendtosuchviolations.Forthispurpose,thecontractingStatesmayresorttoanyappropriatemeansconsistentwithrelevantrulesofinternationallaw,includingtherelevantprovisionsofthisConvention,specificallyparagraph(a)ofthisarticle.EachcontractingStateagreestopublishitsregulationsinforceregardingtheinterceptionofcivilaircraft.

           (c)Everycivilaircraftshallcomplywithanordergiveninconformitywithparagraph(b)ofthisArticle.TothisendeachcontractingStateshallestablishallnecessaryprovisionsinitsnationallawsorregulationstomakesuchcompliancemandatoryforanycivilaircraftregisteredinthatStateoroperatedbyanoperatorwhohashisprincipalplaceofbusinessorpermanentresidenceinthatState.EachcontractingStateshallmakeanyviolationofsuchapplicablelawsorregulationspunishablebyseverepenaltiesandshallsubmitthecasetoitscompetentauthoritiesinaccordancewithitslawsorregulations.

           (d)EachcontractingStateshalltakeappropriatemeasurestoprohibitthedeliberateuseofanycivilaircraftregisteredinthatStateoroperatedbyanoperatorwhohashisprincipalplaceofbusinessorpermanentresidenceinthatStateforanypurposeinconsistentwiththeaimsofthisConvention.Thisprovisionshallnotaffectparagraph(a)orderogatefromparagraphs(b)and(c)ofthisArticle.

Article4

Misuseofcivilaviation

           EachcontractingStateagreesnottousecivilaviationforanypurposeinconsistentwiththeaimsofthisConvention.

CHAPTERII

FLIGHTOVERTERRITORYOF

CONTRACTINGSTATES

Article5

Rightofnon-scheduledflight

           EachcontractingStateagreesthatallaircraftoftheothercontractingStates,beingaircraftnotengagedinscheduledinternationalairservicesshallhavetheright,subjecttotheobservanceofthetermsofthisConvention,tomakeflightsintoorintransitnon-stopacrossitsterritoryandtomakestopsfornon-trafficpurposeswithoutthenecessityofobtainingpriorpermission,andsubjecttotherightoftheStateflownovertorequirelanding.EachcontractingStateneverthelessreservestheright,forreasonsofsafetyofflight,torequireaircraftdesiringtoproceedoverregionswhichareinaccessibleorwithoutadequateairnavigationfacilitiestofollowprescribedroutes,ortoobtainspecialpermissionforsuchflights.

           Suchaircraft,ifengagedinthecarriageofpassengers,cargo,ormailforremunerationorhireonotherthanscheduledinternationalairservices,shallalso,subjecttotheprovisionsofArticle7,havetheprivilegeoftakingonordischargingpassengers,cargo,ormail,subjecttotherightofanyStatewheresuchembarkationordischargetakesplacetoimposesuchregulations,conditionsorlimitationsasitmayconsiderdesirable.

Article6

Scheduledairservices

           NoscheduledinternationalairservicemaybeoperatedoverorintotheterritoryofacontractingState,exceptwiththespecialpermissionorotherauthorizationofthatState,andinaccordancewiththetermsofsuchpermissionorauthorization.3

Article7

Cabotage

           EachcontractingStateshallhavetherighttorefusepermissiontotheaircraftofothercontractingStatestotakeoninitsterritorypassengers,mailandcargocarriedforremunerationorhireanddestinedforanotherpointwithinitsterritory.EachcontractingStateundertakesnottoenterintoanyarrangementswhichspecificallygrantanysuchprivilegeonanexclusivebasistoanyotherStateoranairlineofanyotherState,andnottoobtainanysuchexclusiveprivilegefromanyotherState.

Article8

Pilotlessaircraft

           NoaircraftcapableofbeingflownwithoutapilotshallbeflownwithoutapilotovertheterritoryofacontractingStatewithoutspecialauthorizationbythatStateandinaccordancewiththetermsofsuchauthorization.EachcontractingStateundertakestoinsurethattheflightofsuchaircraftwithoutapilotinregionsopentocivilaircrarftshallbesocontrolledastoobviatedangertocivilaircraft.

Article9

Prohibitedareas

           (a)EachcontractingStatemay,forreasonsofmilitarynecessityorpublicsafety,restrictorprohibituniformlytheaircraftofotherStatesfromflyingovercertainareasofitsterritory,providedthatnodistinctioninthisrespectismadebetweentheaircraftoftheStatewhoseterritoryisinvolved,engagedininternationalscheduledairlineservices,andtheaircraftoftheothercontractingStateslikewiseengaged.Suchprohibitedareasshallbeofreasonableextentandlocationsoasnottointerfereunnecessarilywithairnavigation.DescriptionsofsuchprohibitedareasintheterritoryofacontractingState,aswellasanysubsequentalterationstherein,shallbecommunicatedassoonaspossibletotheothercontractingStatesandtotheInternationalCivilAviationOrganization.

           (b)EachcontractingStatereservesalsotheright,inexceptionalcircumstancesorduringaperiodofemergency,orintheinterestofpublicsafety,andwithimmediateeffect,temporarilytorestrictorprohibitflyingoverthewholeoranypartofitsterritory,onconditionthatsuchrestrictionorprohibitionshallbeapplicablewithoutdistinctionofnationalitytoaircraftofallotherStates.

           (c)EachcontractingState,undersuchregulationsasitmayprescribe,mayrequireanyaircraftenteringtheareascontemplatedinsubparagraphs(a)or(b)abovetoeffectalandingassoonaspracticablethereafteratsomedesignatedairportwithinitsterritory.

Article10

Landingatcustomsairport

           Exceptinacasewhere,underthetermsofthisConventionoraspecialauthorization,aircraftarepermittedtocrosstheterritoryofacontractingStatewithoutlanding,everyaircraftwhichenterstheterritoryofacontractingStateshall,iftheregulationsofthatStatesorequire,landatanairportdesignatedbythatStateforthepurposeofcustomsandotherexamination.OndeparturefromtheterritoryofacontractingState,suchaircraftshalldepartfromasimilarlydesignatedcustomsairport.ParticularsofalldesignatedcustomsairportsshallbepublishedbytheStateandtransmittedtotheInternationalCivilAviationOrganizationestablishedunderPartIIofthisConventionforcommunicationtoallothercontractingStates.

Article11

Applicabilityofairregulations

           SubjecttotheprovisionsofthisConvention,thelawsandregulationsofacontractingStaterelatingtotheadmissiontoordeparturefromitsterritoryofaircraftengagedininternationalairnavigation,ortotheoperationandnavigationofsuchaircraftwhilewithinitsterritory,shallbeappliedtotheaircraft ofallcontractingStateswithoutdistinctionastonationality,andshallbecompliedwithbysuchaircraftuponentering
