DrSimonsohnfoundifthescoreofthepreviouscandidateinadailyseriesofintervieweeswas0.75pointsormorehigherthanthatoftheone17that,thenthescoreforthenextapplicantwould18byanaverageof0.075points.Thismightsouondsmall,butto19theeffectsofsuchadecreaseacandidatewouldneed30moreGMATpointsthanwouldotherwisehavebeen20.

JusticeAnthoryKennedy,joinedbyChiefJusticeJohnRobrtsandtheCourt’sliberals,ruledthatthestateflewtooclosetothefederalsun.ontheoverturnedprovisionsthemajorityheldthecongresshaddeliberately“occupiedthefield”andArizonahadthusintrudedonthefederal’sprivilegedpowers.
