Article1

Toreinforceworksafety,preventandreduceworksafetyaccidents,protectthelifeandpropertysafetyofthepeople,andpromotethesustainableandsoundeconomicandsocialdevelopment,thisLawisdeveloped.　

Article2

ThisLawisapplicabletotheworksafetyofentitiesengagedinproductionandotherbusinessactivities（hereinafterreferredtoasthe“businessentities”）withintheterritoryofthePeople'sRepublicofChina.Wherearelevantlaworadministrativeregulationprovidesotherwiseforfiresafety,roadtrafficsafety,railwaytrafficsafety,waterwaytrafficsafety,civilaviationsafety,nuclearandradiationsafety,orsafetyofspecialequipment,theprovisionsofsuchalaworadministrativeregulationshallapply.　

Article3

Inworksafety,thenotionof“people-orientedandsafedevelopment”andtheprincipleof“safetyfirst,focusingonprevention,andintegratedcontrol”shallbeadheredto,theprimaryresponsibilitiesofbusinessentitiesshallbereinforcedandenforced,andamechanismincludingtheresponsibilitiesofbusinessentities,participationofemployees,governmentalregulation,industryself-regulation,andsupervisionfromthegeneralpublicshallbeestablished.　

Article4

BusinessentitiesmustcomplywiththisLawandotherlawsandregulationsrelatedtoworksafety,strengthenworksafetymanagement,establishandimprovetheirworksafetyresponsibilitysystemsandworksafetypolicesandrules,enhanceworksafetyconditions,promoteworksafetystandardization,improvetheirworksafetylevels,andensureworksafety.　

Article5

Theprimarypersoninchargeofabusinessentityshallbefullyresponsibleforthebusinessentity'sworksafety.　

Article6

Employeesofabusinessentityshallbeentitledtosafeguardsforworksafetyaccordingtothelaw,andperformworksafetyobligationsaccordingtothelaw.　

Article7

Tradeunionsshalloverseeworksafety.　

Thetradeunionofabusinessentityshallorganizeemployeestoparticipateinthedemocraticmanagementandoversightofworksafetyofthebusinessentity,andprotectthelawfulrightsandinterestsofemployeesintermsofworksafety.Todeveloporamendpolicesandrulesrelatedtoworksafety,abusinessentityshallheartheopinionsofitstradeunion.

Article8

TheStateCouncilandthelocalpeople'sgovernmentsatandabovethecountylevelshalldevelopandorganizetheimplementationofgeneralplansonworksafetyinaccordancewiththenationaleconomicandsocialdevelopmentplans.Generalplansonworksafetyshallbeconnectedwithgeneralplansonurbanandruraldevelopment.　

TheStateCouncilandthelocalpeople'sgovernmentsatandabovethecountylevelshallstrengthentheirleadershipinworksafety,supportandsupervisetherelevantdepartmentsinperformingtheirregulatorydutiesinworksafetyaccordingtothelaw,establishandimproveworksafetycoordinationmechanisms,andprovidetimelycoordinationandsolutionstothemajorissuesexistinginworksafetysupervisionandadministration.

Thepeople'sgovernmentsoftownshipsandtownsandthebranchofficesofthelocalpeople'sgovernmentssuchassub-districtofficesanddevelopmentzonemanagementinstitutionsshall,accordingtotheirduties,strengthenthesupervisoryinspectiononworksafetyofbusinessentitieswithintheirrespectiveadministrativeregions,andassisttherelevantdepartmentsofthepeople'sgovernmentsatahigherlevelinperformingtheirregulatorydutiesinworksafetyaccordingtothelaw.

Article9

TheworksafetyadministrativedepartmentoftheStateCouncilshallconductcomprehensivesupervisionandadministrationofworksafetynationwideinaccordancewiththisLaw;andtheworksafetyadministrativedepartmentsofthelocalpeople'sgovernmentsatandabovethecountylevelshallconductcomprehensivesupervisionandadministrationofworksafetywithintheirrespectiveadministrativeregionsinaccordancewiththisLaw.　

TherelevantdepartmentsoftheStateCouncilshall,inaccordancewiththisLawandotherrelevantlawsandadministrativeregulations,conductsupervisionandadministrationofworksafetyintherelevantsectorsorfieldswithintheirrespectivescopesofduties;andtherelevantdepartmentsofthelocalpeople'sgovernmentsatandabovethecountylevelshall,inaccordancewiththisLawandotherrelevantlawsandregulations,conductsupervisionandadministrationofworksafetyintherelevantsectorsorfieldswithintheirrespectivescopesofduties.

Theworksafetyadministrativedepartmentsandthedepartmentsconductingsupervisionandadministrationofworksafetyintherelevantsectorsorfieldsarecollectivelyreferredtoasthedepartmentswithworksafetyregulatoryfunctions.

Article10

TherelevantdepartmentsoftheStateCouncilshall,accordingtotherequirementsforsafeguardingworksafety,developrelevantnationalorindustrystandardsinatimelymanneraccordingtothelaw,andamendsuchstandardsappropriatelyonthebasisoftechnologicaladvancementandeconomicdevelopment.

Businessentitiesmustimplementthenationalorindustrystandardsforsafeguardingworksafetydevelopedaccordingtothelaw.　

Article11

Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsthereofshallstrengthenthepublicityoflawsandregulationsonworksafetyandworksafetyknowledgeinvariousformstoraisetheworksafetyawarenessofthewholesociety.　

Article12

Therelevantassociationsshall,inaccordancewithlaws,administrativeregulations,andtheirarticlesofassociation,providebusinessentitieswithinformation,training,andotherservicesrelatedtoworksafety,playtheirself-regulatoryroles,andpromotetheenhancedworksafetymanagementofbusinessentities.　

Article13

Institutionslegallyformedtoprovideworksafetytechnicalandmanagementservicesshall,inaccordancewithlaws,administrativeregulations,andstandardsofpractice,provideworksafetytechnicalandmanagementservicesforbusinessentitiesasagreedupontherewith.　

Whereabusinessentityemploysanaforesaidinstitutiontoprovideworksafetytechnicalormanagementservices,thebusinessentityshallremainresponsibleforensuringitsworksafety.

Article14

Thestateshallapplyanaccountabilityenforcementsystemtoworksafetyaccidents,andthepersonsliableforsuchaccidentsshallbesubjecttolegalliabilityinaccordancewiththisLawandotherrelevantlawsandregulations.　

Article15

Thestateshallencourageandsupportthescientificandtechnologicalresearchonworksafetyandthepromotionandapplicationofadvancedworksafetytechnologytoimprovethelevelofworksafety.　

Article16

Thestateshallconferawardsonentitiesandindividualswhichhavemadeoutstandingachievementsinimprovingworksafetyconditions,preventingworksafetyaccidents,andparticipatinginrescueoperations,amongothers.　

ChapterIISafeguardsforWorkSafetyofBusinessEntities 

Article17

BusinessentitiesshallmeettheworksafetyconditionsprescribedbythisLawandotherrelevantlaws,administrativeregulations,andnationalorindustrystandards.Businessentitiesnotmeetingsuchconditionsshallnotbeengagedinproductionandotherbusinessactivities.　

Article18

Theprimarypersoninchargeofabusinessentityshallhavethefollowingdutiesintheworksafetyofthebusinessentity：

（1）Establishingandimprovingtheworksafetyresponsibilitysystemofthebusinessentity.

（2）Organizingthedevelopmentofpolicies,rules,andoperatingproceduresforworksafetyofthebusinessentity.

（3）Organizingthedevelopmentandimplementationoftheworksafetyeducationandtrainingplansofthebusinessentity.

（4）Ensuringtheeffectiveutilizationoftheworksafetyinputofthebusinessentity.

（5）Supervisingandinspectingtheworksafetyofthebusinessentitytoeliminatehiddenrisksofworksafetyaccidentsinatimelymanner.

（6）Organizingthepreparationandimplementationofthebusinessentity'semergencyrescueplansforworksafetyaccidents.

（7）Reportingworksafetyaccidentsinatimelyandhonestmanner.

Article19

Theworksafetyresponsibilitysystemofabusinessentityshallspecifytheresponsiblepersonforeachposition,thescopeofduties,andtheevaluationcriteria,amongothers.　

Abusinessentityshallestablishcorrespondingmechanismstostrengthenthesupervisionandevaluationoftheimplementationofitsworksafetyresponsibilitysystemandensuretheimplementationofthesystem.

Article20

Inputoffundsnecessaryforabusinessentitytomeettheprescribedworksafetyconditionsshallbeguaranteedbythedecision-makingbodyortheprimary
