Members,
NotingthatMinisterson20 September 1986agreedthattheUruguayRoundofMultilateralTradeNegotiationsshallaimto“bringaboutfurtherliberalizationandexpansionofworldtrade”,“strengthentheroleofGATT”and“increasetheresponsivenessoftheGATTsystemtotheevolvinginternationaleconomicenvironment”;
DesiringtofurthertheobjectivesofGATT 1994;
Recognizingthatclearandpredictablerulesoforiginandtheirapplicationfacilitatetheflowofinternationaltrade;
Desiringtoensurethatrulesoforiginthemselvesdonotcreateunnecessaryobstaclestotrade;
DesiringtoensurethatrulesoforigindonotnullifyorimpairtherightsofMembersunderGATT 1994;
Recognizingthatitisdesirabletoprovidetransparencyoflaws,regulations,andpracticesregardingrulesoforigin;
Desiringtoensurethatrulesoforiginarepreparedandappliedinanimpartial,transparent,predictable,consistentandneutralmanner;
Recognizingtheavailabilityofaconsultationmechanismandproceduresforthespeedy,effectiveandequitableresolutionofdisputesarisingunderthisAgreement;
Desiringtoharmonizeandclarifyrulesoforigin;
Herebyagreeasfollows:

Article 1:
RulesofOriginback to top
1. ForthepurposesofPartsItoIVofthisAgreement,rulesoforiginshallbedefinedasthoselaws,regulationsandadministrativedeterminationsofgeneralapplicationappliedbyanyMembertodeterminethecountryoforiginofgoodsprovidedsuchrulesoforiginarenotrelatedtocontractualorautonomoustraderegimesleadingtothegrantingoftariffpreferencesgoingbeyondtheapplicationofparagraph1ofArticle IofGATT 1994.
2. Rulesoforiginreferredtoinparagraph 1shallincludeallrulesoforiginusedinnon-preferentialcommercialpolicyinstruments,suchasintheapplicationof:
most-favoured-nationtreatmentunderArticles I,II,III,XIandXIIIofGATT 1994; anti-dumpingandcountervailingdutiesunderArticle VIofGATT 1994; safeguardmeasuresunderArticle XIXofGATT 1994; originmarkingrequirementsunderArticle IXofGATT 1994; andanydiscriminatoryquantitativerestrictionsortariffquotas. Theyshallalsoincluderulesoforiginusedforgovernmentprocurementandtradestatistics.

Part II:
DisciplinestoGoverntheApplicationofRulesofOrigin
Article 2:
DisciplinesDuringtheTransitionPeriodback to top
UntiltheworkprogrammefortheharmonizationofrulesoforiginsetoutinPart IViscompleted,Membersshallensurethat:
(a) whentheyissueadministrativedeterminationsofgeneralapplication,therequirementstobe fulfilledareclearlydefined.Inparticular:
(i) incaseswherethecriterionofchange oftariffclassificationisapplied,sucharuleoforigin,andanyexceptionstotherule,mustclearlyspecifythesubheadingsorheadingswithinthetariffnomenclaturethatareaddressedbytherule;
(ii) incaseswherethead valorempercentagecriterionisapplied,themethodforcalculatingthispercentageshallalsobeindicatedintherulesoforigin;
(iii) incaseswherethecriterionofmanufacturingorprocessingoperationisprescribed,theoperationthatconfersoriginonthegoodconcernedshallbepreciselyspecified;
(b) notwithstandingthemeasureorinstrumentofcommercialpolicytowhichtheyarelinked,theirrulesoforiginarenotusedasinstrumentstopursuetradeobjectivesdirectlyorindirectly;
(c) rulesoforiginshallnotthemselvescreaterestrictive,distorting,ordisruptiveeffectsoninternationaltrade. Theyshallnotposeundulystrictrequirementsorrequirethefulfilmentofacertainconditionnotrelatedtomanufacturingorprocessing,asaprerequisiteforthedeterminationofthecountryoforigin. However,costsnotdirectlyrelatedtomanufacturingorprocessingmaybeincludedforthepurposesoftheapplicationofanad valorempercentagecriterionconsistentwithsubparagraph (a);
(d) therulesoforiginthattheyapplytoimportsandexportsarenotmorestringentthantherulesoforigintheyapplytodeterminewhetherornotagoodisdomesticandshallnotdiscriminatebetweenotherMembers,irrespectiveoftheaffiliationofthemanufacturersofthegoodconcerned

(e) theirrulesoforiginareadministeredinaconsistent,uniform,impartialandreasonablemanner;
(f) theirrulesoforiginarebasedonapositivestandard. Rulesoforiginthatstatewhatdoesnotconferorigin(negativestandard)arepermissibleaspartofaclarificationofapositivestandardorinindividualcaseswhereapositivedeterminationoforiginisnotnecessary;
(g) theirlaws,regulations,judicialdecisionsandadministrativerulingsofgeneralapplicationrelatingtorulesoforiginarepublishedasiftheyweresubjectto,andinaccordancewith,theprovisionsofparagraph1ofArticleXofGATT 1994;
(h) upontherequestofanexporter,importeroranypersonwithajustifiablecause,assessmentsoftheorigintheywouldaccordtoagoodareissuedassoonaspossiblebutnolaterthan150days(3)afterarequestforsuchanassessmentprovidedthatallnecessaryelementshavebeensubmitted. Requestsforsuchassessmentsshallbeacceptedbeforetradeinthegoodconcernedbeginsandmaybeacceptedatanylaterpointintime. Suchassessmentsshallremainvalidforthreeyearsprovidedthatthefactsandconditions,includingtherulesoforigin,underwhichtheyhavebeenmaderemaincomparable. Providedthatthepartiesconcernedareinformedinadvance,suchassessmentswillnolongerbevalidwhenadecisioncontrarytotheassessmentismadeinareviewasreferredtoinsubparagraph (j).Suchassessmentsshallbemadepubliclyavailablesubjecttotheprovisionsofsubparagraph (k);
(i) whenintroducingchangestotheirrulesoforiginornewrulesoforigin,theyshallnotapplysuchchangesretroactivelyasdefinedin,andwithoutprejudiceto,theirlawsorregulations;
(j) anyadministrativeactionwhichtheytakeinrelationtothedeterminationoforiginisreviewablepromptlybyjudicial,arbitraloradministrativetribunalsorprocedures,independentoftheauthorityissuingthedetermination,whichcaneffectthemodificationorreversalofthedetermination;
(k) allinformationthatisbynatureconfidentialorthatisprovidedonaconfidentialbasisforthepurposeoftheapplicationofrulesoforiginistreatedasstrictlyconfidentialbytheauthoritiesconcerned,whichshallnotdiscloseitwithoutthespecificpermissionofthepersonorgovernmentprovidingsuchinformation,excepttotheextentthatitmayberequiredtobedisclosedinthecontextofjudicialproceedings.
Article 3:
DisciplinesaftertheTransitionPeriodback to top
TakingintoaccounttheaimofallMemberstoachieve,asaresultoftheharmonizationworkprogrammesetoutinPart IV,theestablishmentofharmonizedrulesoforigin,Membersshallensure,upontheimplementationoftheresultsoftheharmonizationworkprogramme,that:
(a) theyapplyrulesoforiginequallyforallpurposesassetoutinArticle 1;
(b) undertheirrulesoforigin,thecountrytobedeterminedastheoriginofaparticulargoodiseitherthecountrywherethegoodhasbeenwhollyobtainedor,whenmorethanonecountryisconcernedintheproductionofthegood,thecountrywherethelastsubstantialtransformationhasbeencarriedout;
(c) therulesoforiginthattheyapplytoimportsandexportsarenotmorestringentthantherulesoforigintheyapplytodeterminewhetherornotagoodisdomesticandshallnotdiscriminatebetweenotherMembers,irrespectiveoftheaffiliationofthemanufacturersofthegoodconcerned;
(d) therulesoforiginareadministeredinaconsistent,uniform,impartialandreasonablemanner;
(e) theirlaws,regulations,judicialdecisionsandadministrativerulingsofgeneralapplicationrelatingtorulesoforiginarepublishedasiftheyweresubjectto,andinaccordancewith,theprovisionsofparagraph1ofArticleXofGATT 1994;
(f) upontherequestofanexporter,importeroranypersonwithajustifiablecause,assessmentsoftheorigintheywouldaccordtoagoodareissuedassoonaspossiblebutnolaterthan150daysafterarequestforsuchanassessmentprovidedthatallnecessaryelementshavebeensubmitted. Requestsforsuchassessmentsshallbeacceptedbeforetradeinthegoodconcernedbeginsandmaybeacceptedatanylaterpointintime. Suchassessmentsshallremainvalidforthreeyearsprovidedthatthefactsandconditions,includingtherulesoforigin,underwhichtheyhavebeenmaderemaincomparable. Providedthatthepartiesconcernedareinformedinadvance,suchassessmentswillnolongerbevalidwhenadecisioncontrarytotheassessmentismadeinareviewasreferredtoinsubparagraph (h). Suchassessmentsshallbemadepubliclyavailablesubjecttotheprovisionsofsubparagraph (i);
(g) whenintroducingchangestotheirrulesoforiginornewrulesoforigin,theyshallnotapplysuchchangesretroactivelyasdefinedin,andwithoutprejudiceto,theirlawsorregulations;
(h) anyadministrativeactionwhichtheytakeinrelationtothedeterminationoforiginisreviewablepromptlybyjudicial,arbitraloradministrativetribunalsorprocedures,independentoftheauthorityissuingthedetermination,whichcaneffectthemodificationorreversalofthedeterminati
