(2)TheOntarioMunicipalBoardmaydirectthatnoticeofanapplicationforapprovaloftheclosingofaroadunderthissectionshallbegivenatsuchtime,insuchmannerandtosuchpersons,includingmunicipalitiesandlocalboardsofmunicipalities,astheOntarioMunicipalBoarddetermines,andmayfurtherdirectthatparticularsofobjectionstotheclosingshallbefiledwithitwithinsuchtimeasitdirects.1992,c.1,s.4

(b)isunabletosellthelandatfairmarketvalueandneedstosellitquicklyforhealthorfinancialreasonsortosettleanestate.1992,c.1,s.5.

Inspections
(3)Incarryingoutaninspection,aninspectormay,
(a)beaccompaniedbyanypersontoassistincarryingouttheinspection;
(b)conductsurveys,examinations,investigationsandtestsoftheland,includingtheexcavationoftestpits,andforthosepurposes,placeequipmentonthelandforsuchperiodastheinspectorconsidersnecessary;
(c)takeandremovesamplesorextracts;
(d)makeinquiriesofanyperson;and
(e)recordorcopyinformationbyanymethod.1992,c.1,s.8(3).
Identification
(4)Aninspectorwhoiscarryingoutaninspectionshallproducehisorhercertificateofdesignationuponrequest.1992,c.1,s.8(4).
Restoration
(5)Afteraninspectioniscompleted,theCorporationshall,insofarasispracticable,restorethelandtotheconditionitwasinbeforetheinspection.1992,c.1,s.8(5).
Compensation

Inspectionwithoutwarrant
9.
(1)Thefollowingapplytoaninspectioncarriedoutwithoutawarrant:
1.Atleastsevendaysbeforeenteringtocarryoutaninspection,theCorporationshall,bypersonalserviceorbyprepaidmail,serveawrittennoticeoftheinspectionupontheownersandoccupantsofthelandasshownbytherecordsofthelandregistryofficeandbythelastreturnedassessmentrollofthemunicipalityinwhichthelandislocated.
2.Thenoticeshallspecifythedateuponwhichtheinspectorintendstoenteronthelandtocommencetheinspection.
3.Iftheinspectorintendstoenteronthelandmorethanonceduringaperiodoftime,thenoticeshallspecifythatperiod.
4.Iftheinspectorintendstoleaveequipmentonthelandforaperiodoftime,thenoticeshallsetoutadescriptionoftheequipmentandtheperiodoftimeduringwhichtheinspectorintendstoleaveitontheland.
5.Anoticeservedunderthissectionbyprepaidmailshallbedeemedtohavebeenreceivedonthefifthdayafterthedateofmailingofthenotice.
6.Aninspectorshallnotuseforceagainstanyindividualincarryingouttheinspection.
7.Aninspectorshallonlyenteronlandtocarryoutaninspectionbetweenthehoursof6a.m.and9p.m.unless,afterorconcurrentwithservingthenoticeunderparagraph1,theCorporationhasgivenatleasttwenty-fourhourswrittennoticeoftheintenttoinspectthelandatotherhourstotheoccupantsbypersonalservice,prepaidmailorbypostingthenoticeonthelandinaconspicuousplace.1992,c.1,s.9
