ERECTIONALLRISKS

&THIRDPARTYLIABILITYINSURANCEPOLICY

ThisPolicycomprisesmainlytheSchedule,ScopeofCover,Exclusions,TreatmentofClaim,Insured’sObligations,GeneralConditions,andSpecialProvisions,includingalsotheProposalofinsurancetogetherwithitsattachmentsaswellasanyadditionstobemade,fromtimetotime,bytheCompanyintheformofEndorsement.

WHEREASTHEINSUREDnamedintheScheduleheretohasmadetoPingAnProperty&CasualtyInsuranceCompanyofChina（hereinaftercalled“thecompany”）awrittenProposalwhichtogetherwithanyotherstatementsmadebytheinsuredforthepurposeofthisPolicyisdeemedtobeincorporatedhereinandhaspaidtotheCompanythepremiumstatedintheSchedule.

NOWTHISPOLICYOFINSURANCEWITNESSESthatsubjecttothetermsandconditionscontainedhereinorendorsedhereontheCompanyshallindemnifytheInsuredforthelossordamagesustainedorlegalliabilityincurredtoanythirdpartiesbytheInsuredduringtheperiodofinsurancestatedintheScheduleinthemannerandtotheextenthereinafterprovided.

I.SECTIONⅠ--MATERIALDAMAGE

1.ScopeofCover

1.1TheCompanyshallindemnifytheInsuredinrespectofthephysicallossofordamagetothepropertyinsuredduringtheperiodofinsurancewithinthespecifiedwork-sitearisingfromanyNATURALHAZARDSorACCIDENTotherthanthosespecificallyexcluded,inthemannerandtotheextenthereinafterprovided;

1.2TheCompanyshallalsoindemnifytheInsuredforthenecessarycostspecifiedintheScheduleandincurredfollowinguponanyeventgivingrisetoaclaimunderthisPolicy;

1.3TheliabilityoftheCompanyinrespectofeachiteminsuredshallnotexceedthesumsetoppositetheretospecifiedintheSchedule,northelimitofindemnityspecifiedintheSpecialProvisionsorEndorsementswhereapplicable.ButinnocaseshallthemaximumliabilityoftheCompanyinrespectofmaterialdamageunderthissectionexceedthetotalsuminsuredspecifiedintheSchedule.

DEFINTIONS

Thewords“NATURALHAZARDS”shallforthepurposeofthisPolicy,meanearthquake,tsunami,thunder-and-lightning,hurricane,typhoon,tornado,storm,tempest,flood,inundation,frost,hailstorm,landslide,rockslide,avalanche,volcanicexplosion,subsidenceofgroundandanyotherphenomenaofnaturewithstrongdestructivepowerandbeyondhumancontrol.

TheWord“ACCIDENT”shallforthepurposeofthisPolicy,meananyunforeseen,uncontrollableandsuddeneventwhichleadstomaterialdamageorbodilyinjury,includingfireandexplosion.

2.Exclusions

TheCompanyshallnotbeliablefor:

2.1lossofordamagetotheinsureditemsthemselvesduetofaultydesign,defectivecastingormaterialorbadworkmanshipandexpensesincurredforreplacing,repairingorrectifyingsuchdefectsormistakes;

2.2lossofordamagetotheinsuredelectricequipmentorapparatusduetooverloading,overvoltage,electriclinecontact,arcing,leakageofelectricity,short-circuiting,electricitydischargedfromatmosphereandotherelectricphenomena;

2.3lossofordamagetotheconstructionplantandequipmentnotcausedbyexteriorinfluence;

2.4lossofordamagetotheinsureditemsthemselvesorexpensesarisingtherefromduetowearandtear,inherentorlatentdefect,changeinsubstance,spontaneouscombustion,naturalheating,oxidation,rustandcorrosion,leakage,mice,insectsorvermin,changeinatmosphere（climaticortemperature）conditions,changeinnormalwaterleveloranyotherprogressivelyoperatingcause;

2.5expensesofmaintenanceorupkeepornormaloverhaul;

2.6lossofordamagetofiles,documents,accountbooks,bills,cash,securities,charts,dataandpackingmaterials;

2.7shortagediscoveredatthetimeoftakinganinventory;

2.8lossofordamagetovehicles,shipsoraircraftlicensedforgeneraltransportuseorhavingbeencoveredbyanyotherinsurance;

2.9unlessotherwiseagreedbytheCompanyinwritinglossofordamagetothepropertybelongingtotheInsuredwhichisexistingorformedwithinorinthevicinityofthesitebeforethecommencementoftheerectionwork;

2.10unlessotherwiseagreedbytheCompanyinwritinglossofordamagetoanypartorpartsofthepropertyinsuredforwhichacertificateofcompletionhasbeenissuedorwhichhavebeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipalbeforetheexpirydateofthisPolicy.

II.SECTIONⅡ--THIRDPARTYLIABILITY

1.ScopeofCover

1.1TheCompanyshallinthemannerhereinafterprovidedindemnifytheInsuredagainstsuchsumswhichtheInsuredshallbecomelegallyliabletopayasdamagesinrespectofdeathoforbodilyinjurytoorillnessofthirdparties,orlossofordamagetopropertybelongingtothirdpartiesinconsequenceofanaccidentoccurringindirectconnectionwiththeperformanceoftheerectionworkinsuredandhappeningonorinthevicinityofthesiteduringtheperiodofinsurance.

1.2InrespectofanyclaimcoveredunderthisSection,theCompanyshallinadditionindemnifytheInsuredagainsttherelevantlegalcostspayablebytheInsuredandotherexpensesincurredwiththepriorwrittenconsentoftheCompany.

1.3TheindemnificationmadebytheCompanyforanyoneaccidentshallbesubjecttotheamountstobepayablebytheInsuredwhicharedecidedinaccordancewiththelawbythecourtorthegovernmentaldepartmentconcerned.

ProvidedalwaysthattheliabilityoftheCompanyunderthissectionshallinnocaseexceedthelimitsofindemnityforanyoneaccidentstatedintheSchedule,andduringthewholeperiodofinsurance,themaximumliabilityoftheCompanyunderthissectionshallinnocaseexceedthelimitofindemnityinaggregateasstatedintheSchedule.

2.Exclusions

TheCompanyshallnotbeliablefor:

2.1lossordamageandexpensescoveredorcoverableunderSectionIofthisPolicy;

2.2liabilityarisingfrom:

2.2.1deathoforbodilyinjurytoorillnessofthePrincipal（s）ortheContractor（s）oranyotherparty（ies）ortheiremployeesorworkmenengagedinconnectionwiththecontractworkonthesite,ormembersoftheirfamilies;

2.2.2lossofordamagetopropertybelongingtoorheldincare,custodyorcontrolofthePrincipal（s）ortheContractor（s）oranyotherparty（ies）concernedortheiremployeesorworkmen;

2.2.3anyaccidentcausedbyvehicles,shipsoraircraftslicensedforgeneraltransportuse

2.2.4indemnificationorpaymentmadebytheInsuredinaccordancewithanyagreementbetweentheInsuredandotherparties,unlesssuchliabilitywouldhavebeenattachedtotheinsurednotwithstandingsuchagreement.

III.GENERALEXCLUSIONS

TheCompanyshallnotindemnifytheInsuredunderthisPolicyinrespectofloss,damage,expenses,orliabilitydirectlyorindirectlycausedbyorarisingoutoforaggravatedby:

1.1war,warlikeoperation,hostilities,armedconflicts,terrorism,conspiracyinsurrection,coupd'etat;

1.2confiscation,requisition,destructionordamagebyanyactionororderofanygovernmentdejureordefactoorbyanypublicauthorities;

1.3strike,riot,civilcommotion;

2.IntentionalactorgrossnegligenceoftheInsuredorhisrepresentative;

3.Nuclearfission,nuclearfusion,nuclearweapon,nuclearmaterial,nuclearradiationandradioactivecontamination;

4.pollutionofanykindordescriptionwhatsoeversuchasatmosphere,landandwaterpollutions;

5.cessationofworkwhethertotalorpartial;

6.consequentiallossofanykindordescriptionwhatsoeverincludingpenalties,lossesduetodelayorlossofcontract;

7.thedeductiblesstatedintheScheduletobebornebytheInsured.

IV.SUMINSURED

1.Itisabasicrequirementofthisinsurancethatthesumsinsuredstatedinthe

Scheduleshallnotbelessthan:

1.1Forerectionwork--thefullvalueoftheinsuredprojectatthecompletionoftheerectionincludingcostofequipments,materials,erectionandconstruction,freightandpremium,customsduty,anyotherduesandexpenses,andthecostofmaterialsorequipmentssuppliedbythePrincipal;

1.2Forconstructionplantandequipment－thereplacementcostoftheinsureditemsbynewonesofthesamesizeandsamecapacity;

1.3ForotherItemsInsured--thesumsagreeduponbetweentheInsuredandtheCompany.

2.Ifthesuminsuredinrespectoferectionworkisbasedontheestimatedcontractvaluestatedintheerectioncontract,theInsuredshall:

2.1immediatelynotifytheCompanyinwritingifthecontractvalueincludingallexpensesunderthisinsuranceexceedstheoriginalinsuredcontractvalueduetoriseinpriceorincrement,andtheCompanyshallthenadjustthesuminsuredaccordingly;

2.2keepapreciserecordinwritingontheparticularsoftheworkconcernedduringtheperiodofinsuranceandallowtherepresentativeoftheCompanytoinspectandexaminesuchrecordatanyreasonabletime;

2.3iftheerectionperiodoftheinsuredprojectislongerthanthirty-six（36）months,declaretotheCompanyatanintervalofeverytwelve（12）monthsfromtheinceptiondateofthePolicy,theactualamountoffundputintotheprojectbythetimeofdeclarationaswellasthenewestimatecontractvalue,ifitisrevisedtheCompanyshalladjustthepremiumaccordingly;

2.4providetheCompanywiththeactualfinalcontractvaluewithinthree（3）monthsaftertheexpirydateofthisinsurance,andanydifferencebetweenthepremiumpaidinadvanceandthatpayableshallbep
