　　　CONSIDERINGthatthisendmaybestbeachievedbytheconclusionofa

　Convention;

　　　HAVEAGREEDasfollows:

　　Article1GeneralObligationundertheConvention　

　　　TheContractingGovernmentsundertaketogiveeffecttotheprovisions

　ofthepresentConventionandtheAnnexesheretowhichshallconstitutean

　integralpartofthepresentConvention.Everyreferencetothepresent

　ConventionconstitutesatthesametimeareferencetotheAnnexes.　

　　Article2Definitions　

　　　ForthepurposeofthepresentConvention,unlessexpresslyprovided

　otherwise:

（1）"Regulations"meanstheRegulationsannexedtothepresent

　Convention;

（2）"Administration"meanstheGovernmentoftheStatewhoseflagthe

　shipisflying;

　　　（3）"internationalvoyage"meansaseavoyagefromacountrytowhich

　thepresentConventionappliestoaportoutsidesuchcountry,or

　conversely.Forthispurpose,everyterritoryfortheinternational

　relationsofwhichaContractingGovernmentisresponsibleorforwhich

　theUnitedNationsaretheadministeringauthorityisregardedasa

　separatecountry;

　　　（4）"grosstonnage"meansthemeasureoftheoverallsizeofaship

　determinedinaccordancewiththeprovisionsofthepresentConvention;

　　　（5）"nettonnage"meansthemeasureoftheusefulcapacityofaship

　determinedinaccordancewiththeprovisionsofthepresentConvention;

　　　（6）"newship"meansashipthekeelofwhichislaid,orwhichisat

　asimilarstageofconstruction,onorafterthedateofcomingintoforce

　ofthepresentConvention;

　　　（7）"existingship"meansashipwhichisnotanewship;

　　　（8）"length"means96percentofthetotallengthonawaterlineat

　85percentoftheleastmouldeddepthmeasuredfromthetopofthekeel,

　orthelengthfromtheforesideofthestemtotheaxisoftherudder

　stockonthatwaterline,ifthatbegreater.Inshipsdesignedwitharake

　ofkeelthewaterlineonwhichthislengthismeasuredshallbeparallel

　tothedesignedwaterline;

　　　（9）"Organization"meanstheInter-GovernmentalMaritimeConsultative

　Organization.　

　　Article3Application　

（1）ThepresentConventionshallapplytothefollowingshipsengaged

　oninternationalvoyages;

　　　（a）shipsregisteredincountriestheGovernmentsofwhichare

　ContractingGovernments;

　　　（b）shipsregisteredinterritoriestowhichthepresentConventionis

　extendedunderArticle20;and

　　　（c）unregisteredshipsflyingtheflagofaState,theGovernmentof

　whichisaContractingGovernment.

（2）ThepresentConventionshallapplyto:

　　　（a）newships;

　　　（b）existingshipswhichundergoalterationsormodificationswhich

　theAdministrationdeemstobeasubstantialvariationintheirexisting

　grosstonnage;

　　　（c）existingshipsiftheownersorequests;and

　　　（d）allexistingships,twelveyearsafterthedateonwhichthe

　Conventioncomesintoforce,exceptthatsuchships,apartfromthose

　mentionedin（b）and（c）ofthisparagraph,shallretaintheirthen

　existingtonnagesforthepurposeoftheapplicationtothemofrelevant

　requirementsunderotherexistingInternationalConventions.

　　　（3）ExistingshipstowhichthepresentConventionhasbeenappliedin

　accordancewithsub-paragraph

（2）（c）ofthisArticleshallnot

　subsequentlyhavetheirtonnagesdeterminedinaccordancewiththe

　requirementswhichtheAdministrationappliedtoshipsoninternational

　voyagespriortothecomingintoforceofthepresentConvention.　

　　Article4Exceptions　

（1）ThepresentConventionshallnotapplyto:

　　　（a）shipsofwar;and

　　　（b）shipsoflessthan24metres（79feet）inlength.

（2）Nothinghereinshallapplytoshipssolelynavigating:

　　　（a）theGreatLakesofNorthAmericaandtheRiverSt.Lawrenceasfar

　eastasarhumblinedrawnfromCapdesRosierstoWestPoint,Anticosti

　Island,and,onthenorthsideofAnticostiIsland,themeridianof

　longitude63°W;

　　　（b）theCaspianSea;or

　　　（c）thePlate,ParanaandUruguayRiversasfareastasarhumbline

　drawnbetweenPuntaRasa（CaboSanAntonio）,Argentina,andPuntadel

　Este,Uruguay.　

　　Article5ForceMajeure　

（1）Ashipwhichisnotsubjecttotheprovisionsofthepresent

　Conventionatthetimeofitsdepartureonanyvoyageshallnotbecome

　subjecttosuchprovisionsonaccountofanydevi
