THECOUNCILOFTHEEUROPEANCOMMUNITIES,

HavingregardtotheTreatyestablishingtheEuropeanEconomicCommunity,andinparticularArticle100athereof,

HavingregardtotheproposalfromtheCommission

（1）,

IncooperationwiththeEuropeanParliament

（2）,

HavingregardtotheopinionoftheEconomicandSocialCommittee（3）,

Whereasitisimportanttoadoptmeasureswiththeaimofprogressivelyestablishingtheinternalmarketoveraperiodexpiringon31December1992;whereastheinternalmarketistocompriseanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensured;

WhereassomeMemberStateshaveadoptedhorizontallegislationonproductsafety,imposing,inparticular,ageneralobligationoneconomicoperatorstomarketonlysafeproducts;whereasthoselegislationsdifferinthelevelofprotectionaffordedtopersons;whereassuchdisparitiesandtheabsenceofhorizontallegislationinotherMemberStatesareliabletocreatebarrierstotradeanddistortionsofcompetitionwithintheinternalmarket;

WhereasitisverydifficulttoadoptCommunitylegislationforeveryproductwhichexistsormaybedeveloped;whereasthereisaneedforabroadly-based,legislativeframeworkofahorizontalnaturetodealwiththoseproducts,andalsotocoverlacunaeinexistingorforthcomingspecificlegislation,inparticularwithaviewtoensuringahighlevelofprotectionofsafetyandhealthofpersons,asrequiredbyArticle100a（3）oftheTreaty;

WhereasitisthereforenecessarytoestablishonaCommunitylevelageneralsafetyrequirementforanyproductplacedonthemarketthatisintendedforconsumersorlikelytobeusedbyconsumers;whereascertainsecond-handgoodsshouldneverthelessbeexcludedbytheirnature;

Whereasproductionequipment,capitalgoodsandotherproductsusedexclusivelyinthecontextofatradeorbusinessarenotcoveredbythisDirective;

Whereas,intheabsenceofmorespecificsafetyprovisions,withintheframeworkofCommunityregulations,coveringtheproductsconcerned,theprovisionsofthisDirectivearetoapply;

WhereaswhentherearespecificrulesofCummunitylaw,ofthetotalharmonizationtype,andinparticularrulesadoptedonthebasisofthenewapproach,whichlaydownobligationsregardingproductsafety,furtherobligationsshouldnotbeimposedoneconomicoperatorsasregardstheplacingonthemarketofproductscoveredbysuchrules;

Whereas,whentheprovisionsofspecificCommunityregulationscoveronlycertainaspectsofsafetyorcategoriesofrisksinrespectoftheproductconcerned,theobligationsofeconomicoperatorsinrespectofsuchaspectsaredeterminedsolelybythoseprovisions;

Whereasitisappropriatetosupplementthedutytoobservethegeneralsafetyrequirementbyanobligationoneconomicoperatorstosupplyconsumerswithrelevantinformationandadoptmeasurescommensuratewiththecharacteristicsoftheproducts,enablingthemtobeinformedoftherisksthattheseproductsmightpresent;

Whereasintheabsenceofspecificregulations,criteriashouldbedefinedwherebyproductsafetycanbeassessed;

WhereasMemberStatesmustestablishauthoritiesresponsibleformonitoringproductsafetyandwithpowerstotaketheappropriatemeasures;

WhereasitisnecessaryinparticularfortheappropriatemeasurestoincludethepowerforMemberStatestoorganize,immediatelyandefficiently,thewithdrawalofdangerousproductsalreadyplacedonthemarket;

WhereasitisnecessaryforthepreservationoftheunityofthemarkettoinformtheCommissionofanymeasurerestrictingtheplacingonthemarketofaproductorrequiringitswithdrawalfromthemarketexceptforthoserelatingtoaneventwhichislocalineffectandinanycaselimitedtotheterritoryoftheMemberStateconcerned;whereassuchmeasurescanbetakenonlyincompliancewiththeprovisionsoftheTreaty,andinparticularArticles30to36;

WhereasthisDirectiveapplieswithoutprejudicetothenotificationproceduresinCouncilDirective83/189/EECof28March1983layingdownaprocedurefortheprovisionofinformationinthefieldoftechnicalstandardsandregulations（4）andinCommissionDecision88/383/EECof24February1988providingfortheimprovementofinformationonsafety,hygieneandhealthatwork（5）;

Whereaseffectivesupervisionofproductsafetyrequiresthesetting-upatnationalandCommunitylevelsofasystemofrapidexchangeofinformationinemergencysituationsinrespectofthesafetyofaproductandwhereastheprocedurelaiddownbyCouncilDecision89/45/EECof21December1988onaCommunitysystemfortherapidexchangeofinformationondangersarisingfromtheuseofconsumerproducts（6）shouldthereforebeincorporatedintothisDirectiveandtheaboveDecisionshouldberepealed;whereasitisalsoadvisableforthisDirectivetotakeoverthedetailedproceduresadoptedundertheaboveDecisionandtogivetheCommission,assistedbyacommittee,powertoadaptthem;

Whereas,moreover,equivalentnotificationproceduresalreadyexistforpharmaceuticals,whichcomeunderDirectives75/319/EEC（7）and81/851/EEC（8）,concerninganimaldiseasesreferredtoinDirective82/894/EEC（9）,forproductsofanimalorigincoveredbyDirective89/662/EEC（10）,andintheformofthesystemfortherapidexchangeofinformationinradiologicalemergenciesunderDecision87/600/Euratom（11）;

WhereasitisprimarilyforMemberStates,incompliancewiththeTreatyandinparticularwithArticles30to36thereof,totakeappropriatemeasureswithregardtodangerousproductslocatedwithintheirterritory;

WhereasinsuchasituationthedecisiontakenonaparticularproductcoulddifferfromoneMemberStatetoanother;whereassuchadifferencemayentailunacceptabledisparitiesinconsumerprotectionandconstituteabarriertointra-Communitytrade;

Whereasitmaybenecessarytocopewithseriousproduct-safetyproblemswhichaffectorcouldaffect,intheimmediatefuture,alloralargepartoftheCommunityandwhich,inviewofthenatureofthesafetyproblemposedbytheproductcannotbedealtwitheffectivelyinamannercommensuratewiththeurgencyoftheproblemundertheprocedureslaiddowninthespecificrulesofCommunitylawapplicabletotheproductsorcategoryofproductsinquestion;

Whereasitisthereforenecessarytoprovideforanadequatemechanismallowing,inthelastresort,fortheadoptionofmeasuresapplicablethroughouttheCommunity,intheformofadecisionaddressedtotheMemberStates,inordertocopewithemergencysituationsasmentionedabove;whereassuchadecisionisnotofdirectapplicationtoeconomicoperatorsandmustbeincorporatedintoanationalinstrument;whereasmeasuresadoptedundersuchaprocedurecanbenomorethaninterimmeasuresthathavetobetakenbytheCommissionassistedbyacommitteeofrepresentativesoftheMemberStates;whereas,forreasonsofcooperationwiththeMemberStates,itisappropriatetoprovideforaregulatorycommitteeaccordingtoprocedureIII（b）ofDecision87/373/EEC（12）;

WhereasthisDirectivedoesnotaffectvictims'rightswithinthemeaningofCouncilDirective85/374/EECof25July1985ontheapproximationofthelaws,regulationsandadministrativeprovisionsoftheMemberStatesconcerningliabilityfordefectiveproducts（13）;

WhereasitisnecessarythatMemberStatesprovideforappropriatemeansofredressbeforethecompetentcourtsinrespectofmeasurestakenbythecompetentauthoritieswhichrestricttheplacingonthemarketofaproductorrequireitswithdrawal;

Whereasitisappropriatetoconsider,inthelightofexperience,possibleadaptationofthisDirective,particularlyasregardsextensionofitsscopeandprovisionsonemergencysituationsandinterventionatCommunitylevel;

Whereas,inaddition,theadoptionofmeasuresconcerningimportedproductswithaviewtopreventingriskstothesafetyandhealthofpersonsmustcomplywiththeCommunity'sinternationalobligations,

HASADOPTEDTHISDIRECTIVE:

TITLEIObjective-Scope-Definitions

Article1

1.ThepurposeoftheprovisionsofthisDirectiveistoensurethatproductsplacedonthemarketaresafe.

2.TheprovisionsofthisDirectiveshallapplyinsofarastherearenospecificprovisionsinrulesofCommunitylawgoverningthesafetyoftheproductsconcerned.

Inparticular,wherespecificrulesofCommunitylawcontainprovisionsimposingsafetyrequirementsontheproductswhichtheygovern,theprovisionsofArticles2to4ofthisDirectiveshallnot,inanyevent,applytothoseproducts.

WherespecificrulesofCommunitylawcontainprovisionsgoverningonlycertainaspectsofproductsafetyorcategoriesofrisksfortheproductsconcerned,thosearetheprovisionswhichshallapplytotheproductsconcernedwithregardtotherelevantsafetyaspectsorrisks.

Article2

ForthepurposesofthisDirective:

（a）productshallmeananyproductintendedforconsumersorlikelytobeusedbyconsumers,suppliedwhetherforconsiderationornotinthecourseofacommercialactivityandwhethernew,usedorreconditioned.

However,thisDirectiveshallnotapplytosecond-handproductssuppliedasantiquesorasproductstoberepairedorreconditionedpriortobeingused,providedthatthesupplierclearlyinformsthepersontowhomhesuppliestheproducttothateffect;

（b）safeproductshallmeananyproductwhich,undernormalorreasonablyforeseeableconditionsofuse,includingduration,doesnotpresentanyriskoronlytheminimumriskscompatiblewiththeproduct'suse,conside
