Article1TheLawisformulatedinordertofairlyandtimelyresolvelabordisputes,protectthelawfulrightsandinterestsofthepartiesandpromoteharmoniousandstablelaborrelations.
Article2TheLawshallapplytothefollowinglabordisputesbetweenemployingunitsandlaborerswithintheterritoryofthePeople'sRepublicofChina:
1.disputesarisingfromtheconfirmationoflaborrelations;
2.disputesarisingfromtheconclusion,performance,alterationandterminationoflaborcontracts;
3.disputesarisingfromnameremoval,dismissal,resignationorvacationofoffice;
4.disputesarisingfromworkinghours,restdaysandleavedays,socialinsurance,fringebenefits,trainingandlaborprotection;
5.disputesarisingfromlaborremunerations,workinjurymedicalexpenses,economiccompensationordamages;or
6.otherlabordisputesprescribedbylawsandregulations.
Article3Theresolutionoflabordisputesshallbebasedonfactsandfollowtheprinciplesoflawfulness,fairness,timelinessandmediation-orientedtoprotectthelawfulrightsandinterestsoftheparties.
Article4Wherealabordisputearises,alaborermayhaveaconsultationwiththeemployingunitorrequestthelaborunionorathirdpartytohaveaconsultationwiththeemployingunitinordertoreachasettlementagreement.
Article5Wherealabordisputearises,thepartiesarenotwillingtohaveaconsultation,theconsultationfailsorthesettlementagreementisreachedbutnotperformed,anapplicationformediationmaybemadetoanmediationinstitute.Wherethepartiesarenotwillingtomediate,themediationfailsorthemediationagreementisreachedbutnotperformed,anapplicationforarbitrationmaybemadetothelabordisputearbitrationcommission.Wherethereisobjectiontothearbitralaward,litigationmaybeinitiatedtoapeople'scourtunlessotherwisespecifiedherein.
Article6Wherealabordisputearises,thepartieshavetheresponsibilitytogiveevidencefortheirownclaim.Wheretheevidencerelevanttothedisputematterishandledandmanagedbytheemployingunit,theemployingunitshallgivesuchevidence.Wheretheemployingunitdoesnotgiveevidence,itshallassumeanyunfavorableconsequences.
Article7Wherethepartyinalabordisputeconsistsofmorethan10laborers,andtheyhaveajointrequest,theymayrecommendarepresentativetoparticipateinmediation,arbitrationorlitigationactivities.
Article8Thelaboradministrativedepartmentofpeople'sgovernmentsatthecountylevelorabovetogetherwithlaborunionsandenterpriserepresentativesshallestablishalaborrelationtripartitemechanismtojointlystudyandresolvemajorissuesoflabordisputes.
Article9Whereanemployingunitviolatesstateprovisionsandlaborremunerationsareinarrearsornotpaidinfull,orworkinjurymedicalexpenses,economiccompensationordamagesareinarrears,thelaborermaymakeacomplainttothelaboradministrativedepartmentwhichshallhandlethematterinaccordancewiththelaw.
ChapterII:
Mediation
Article10Wherealabordisputearises,thepartiesmayapplyformediationtothefollowingmediationinstitutes:
1.Enterpriselabordisputemediationcommission;
2.Basic-levelpeople'smediationinstitutesestablishedinaccordancewiththelaw;
3.Instituteswithlabordisputemediationfunctionestablishedintownsandvillagesanddistricts.
Theenterpriselabordisputemediationcommissionshallcompriseemployeerepresentativesandenterpriserepresentatives.Employeerepresentativesshallbelaborunionmembersorrecommendedbyallemployees,andenterpriserepresentativesaredesignatedbytheresponsiblepersonofenterprise.Theofficeroftheenterpriselabordisputemediationcommissionshallbealaborunionmemberorapersonrecommendedbybothparties.
Article11Themediatorsoflabordisputemediationinstitutesshallbecitizensthatareimpartial,connectedwiththemassandpassionateaboutmediationwork,andhavecertainlegalknowledge,policylevelandculturallevel.
Article12Thepartiesthatapplyforlabordisputemediationmaysubmitanapplicationinwritingororally.Whereitisanoralapplication,themediationinstituteshallrecordthebasicparticularsoftheapplicant,thematterindisputethatrequiresmediation,thereasonandtimeonthespot.
Article13Tomediatelabordisputes,thefactsandreasonsofbothpartiesshallbelistenedandmediationisconductedwithpatiencetoassistinreachinganagreement.
Article14Whereanagreementisreachedaftermediation,amediationagreementshallbeprepared.
Themediationagreementshallbesignedorsealedbybothparties,andsignedbythemediatoraswellassealedbythemediationinstitutetotakeeffect.Itshallbebindingonbothpartiesandbothpartiesshallperformtheagreement.
Thepartiesmayapplyforarbitrationinaccordancewiththelawifnomediationagreementisreachedwithin15daysofthereceiptofthemediationapplicationbythelabordisputemediationinstitute.
Article15Wherethemediationagreementisreachedandeitherpartythatfailstoperformthemediationagreementwithinthetimelimitprescribedintheagreement,theotherpartymayapplyforarbitrationinaccordancewiththelaw.
Article16Wherethemediationagreementisreachedinrespectofthepaymentoflaborremunerations,workinjurymedicalexpenses,economiccompensationordamagesinarrearsandtheemployingunitfailstoperformtheagreementwithinthetimelimitprescribedintheagreement,thelaborermayapplytothepeople'scourtforapaymentorderinaccordancewiththelawonthestrengthofthemediationagreement.Thepeople'scourtshallissuethepaymentorderinaccordancewiththelaw.
ChapterIII:
Arbitration
Section1GeneralProvisions
Article17Labordisputearbitrationcommissionsshallbesetuppursuanttotheprinciplesofcoordinatedplanning,rationallayoutandmeetingactualneeds.People'sgovernmentsofprovincesandautonomousregionsmaydecidetosetupalabordisputearbitrationcommissionatthemunicipalandcountylevels;people'sgovernmentsofmunicipalitiesdirectlyunderthecentralgovernmentmaydecidetosetupalabordisputearbitrationcommissionatdistrictandcountylevels;andpeople'sgovernmentsofcitiesspecificallydesignatedinthestateplanandcitieswithdistrictsmayalsoestablishoneorseverallabordisputearbitrationcommissions.Labordisputearbitrationcommissionsarenotsetupaccordingtoadministrativeareaslevelbylevel.
Article18ThelaboradministrativedepartmentundertheStateCouncilshallformulatearbitrationrulesinaccordancewiththeprovisionshereof.Thelaboradministrativedepartmentofpeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernmentshallprovideguidancetolabordisputearbitrationworkwithintheadministrativearea.
Article19Labordisputearbitrationcommissionsshallcomprisetherepresentativeofthelaboradministrativedepartment,laborunionrepresentativeandenterpriserepresentative.Thecompositionofthelabordisputearbitrationcommissionsshallbeanoddnumber.
Labordisputearbitrationcommissionsshallperformthefollowingfunctionsanddutiesinaccordancewiththelaw:
1.appointmentanddismissaloffull-timeorpart-timearbitrators;
2.acceptanceoflabordisputecases;
3.discussionofmajororcomplicatedlabordisputecases;and
4.supervisionofarbitrationactivities.
Labordisputearbitrationcommissionsshallsetupofficestohandletheday-to-dayworkofthelabordisputearbitrationcommissions.
Article20Labordisputearbitrationcommissionsshallhaveanarbitratorregister.
Arbitratorsshallbeimpartialandfulfillanyofthefollowingrequirements:
1.havingservedasanadjudicator;
2.engaginginlegalresearchorteachingwithadesignationofmiddlelevelorabove;
3.havinglegalknowledgeandengaginginhumanresourcesmanagement,laborunionworkorotherprofessionalworkforfivefullyears;or
4.havinglegalpracticeforthreefullyears.
Article21Labordisputearbitrationcommissionsshallberesponsibleforthelabordisputesoccurredinthedistrictundertheirjurisdiction.
Labordisputesshallbehandledbythelabordisputearbitrationcommissionattheplacewherethelaborcontractisperformedorattheplacewheretheemployingunitlocates.Wherebothpartiesapplyforarbitrationtothelabordisputearbitrationcommissionattheplacewherethelaborcontractisperformedortheplacewheretheemployingunitlocates,thelabordisputeshallfallwithinthejurisdictionofthelabordisputearbitrationcommissionattheplacewherethelaborcontractisperformed.
Article22Thelaborerinalabordisputeandtheemployingunitarethepartiestolabordisputecases.
Wherethereisalabordisputebetweenalabordeploymentunitandalaborer,thelabordeploymentunitandtheemployingunitarethejointparties.
Article23Thethirdpartythathasaninterestintheresultofthehandlingofalabordisputecasemayapplyforparticipatinginarbitrationactivitiesorbenotifiedtoparticipateinarbitrationactivitiesbythelabord
