Interpretation

2.  InthisAct,unlessthecontextotherwiserequires —

“AppealBoard”meanstheAppealBoardestablishedbytheMinisterundersection 25H;

“authorisedofficer”,inrelationtoanyprovisioninthisAct,meansanypublicofficerauthorisedinthatbehalfbytheMinisterforthepurposesofthatprovision;

“bodycorporate”includesalimitedliabilitypartnershipregisteredundertheLimitedLiabilityPartnershipsAct（Cap. 163A）;

“constructionworks”meanstheconstruction,extension,installation,carryingout,repair,maintenance,renewal,removal,alteration,dismantlingordemolitionof —

（a）

anybuilding,erection,edifice,structure,wall,fenceorchimney,whetherconstructedwhollyorpartlyaboveorbelowgroundlevel;

（b）

anyroad,motorway,harbourworks,railway,cableway,canaloraerodrome;

（c）

anydrainage,irrigationorrivercontrolwork;

（d）

anyelectrical,water,gasortelecommunicationworks;or

（e）

anybridge,viaduct,dam,reservoir,earthworks,pipeline,sewer,aqueduct,culvert,drive,shaft,tunnelorreclamation,

andincludesanyworkswhichformanintegralpartof,orarepreparatorytotheworksdescribedinparagraphs （a）to（e）,includingsiteclearance,earth-moving,excavation,layingoffoundation,siterestorationandlandscaping,andsuchotherworksoractivitiesastheMinistermay,bynotificationintheGazette,specifytobeconstructionworks;

“Controller”meanstheControllerofWorkPassesappointedundersection 3;

“debarred”,inrelationtoaperson,meansapersonwhoisdebarredundersection 7（4）（d）fromapplyingfor,orbeingissuedwith,aworkpass;

“employ”meanstoengageorusetheserviceofanypersonforthepurpose —

（a）

ofanywork;or

（b）

ofprovidinganytrainingforthatperson,

whetherunderacontractofserviceorotherwise,andwithorwithoutsalary;

“employer”meansanypersonemployingaforeignemployee,andincludes —

（a）

forthepurposesofanapplicationforaworkpass,anypersonwhohastheintentionorpurportstohavetheintentiontoemployaforeignemployee;or

（b）

inacasewhereaforeignemployeehasorhadavalidworkpass,anypersonspecifiedintheworkpassastheemployeroftheforeignemployee;

“employmentinspector”meanstheControllerandanypersonappointedasanemploymentinspectorundersection 3;

“foreignemployee”means —

（a）

anyforeigner,otherthanaself-employedforeigner,whoseeksorisofferedemploymentinSingapore;or

（b）

suchotherpersonorclassofpersonsastheMinistermay,bynotificationintheGazette,specify;

“foreigner”meansanypersonwhoisnotacitizenorpermanentresidentofSingapore;

“in-principleapproval”meansthein-principleapprovalofanapplicationforaworkpassissuedbytheControllerundersection 7（2A）;

“levy”meansthelevyimposedundersection 11;

“occupier”,inrelationtoanypremises,includes —

（a）

thepersonhavingthecharge,managementorcontrolofeitherthewholeorpartofthepremiseseitheronhisownaccountorasanagent;and

（b）

anypersonwhoiscarryingoutconstructionorotherworksatthepremisesonbehalfofsomeotherperson;

“premises”includes —

（a）

anybuildingorstructure,whetherpermanentortemporary;

（b）

anyland,whetherornotbuilton;

（c）

anyplace,whetherornotenclosed,includinganyplacesituatedundergroundorunderwater;

（d）

anyvehicle,vesseloraircraft;and

（e）

anypartofanypremises;

“prescribedinfringement”means —

（a）

anycontraventionofsection 9

（1）,25

（1）,

（2）,（3）or（4）or25A

（2）;

（b）

anycontraventionofanyprovisionintheregulationsmadeunderthisActthatisprescribedasaprescribedinfringement;or

（c）

theabetment,withinthemeaningofsection 25F,ofanycontraventionreferredtoinparagraph （a）or（b）;

“regulatorycondition”meansaconditionofanin-principleapprovaloraworkpassthat —

（a）

isprescribedbytheMinisterasaregulatorycondition;or

（b）

isimposedbytheControllerundersection7asaregulatorycondition;

“self-employedforeigner”meansanyforeignerwho,notbeingemployedunderacontractofservice,seekstoengageinorengagesin —

（a）

anytrade,vocationorprofession,whetherforthepurposeofgainorotherwise;or

（b）

anyotheractivityinSingaporeforthepurposeofgain;

“train”,inrelationtoaforeignemployee,meanstoteach,instructoreducatetheforeignemployeeinrelationtotheworkinwhichtheforeignemployeeisemployedortobeemployed;

“validworkpass”meansaworkpassthatisvalidinaccordancewithsection 12;

“workpass”meansaworkpassbelongingtoanyprescribedcategoryofworkpasseswhichisissuedbytheControllerundersection 7.

Meaningof“personalidentifier”

2A.

—

（1）  InthisAct,“personalidentifier”meansanyoftheidentifiersspecifiedinthe Schedule（includinganyindigitalform）.

（2）  TheMinistermay,byorderpublishedintheGazette,amendthe Schedule,exceptthatanyotherpersonalidentifiersoprescribedintheordermust —

（a）

beanimageof,orameasurementorrecordingof,anexternalpartofthehumanbody;and

（b）

notbeanidentifiertheobtainingofwhichwouldinvolvethetakingofanintimatesamplewithinthemeaningofsection 13AoftheRegistrationofCriminalsAct（Cap.268）.

AppointmentofControllerofWorkPassesandemploymentinspectors,etc.

（1）  TheMinistermayappointaControllerofWorkPasseswhoshallhavesuchfunctionsandpowersasareconferredonhimbythisActandsuchnumberofDeputyControllersofWorkPassesandAssistantControllersofWorkPassesastheMinistermaythinknecessarytoassisttheControllerintheproperdischargeofhisfunctions.

（1A）  TheDeputyControllersofWorkPassesandtheAssistantControllersofWorkPassesshallhaveandmayexerciseandperformallthepowers,dutiesandfunctionsoftheControllerconferredbythisAct（exceptthepowerofdelegationconferredbysubsection （3））,subjecttosuchlimitationsastheControllermaythinkfittoimpose.

（2）  TheMinistermayappointsuchnumberofemploymentinspectorsashemaythinkfitforcarryingoutthepurposesofthisAct.

（3）  TheControllermaydelegatetheexerciseofalloranyofthefunctionsorpowersconferredonhimbythisAct（exceptthepowerofdelegationconferredbythissubsection）tooneormoreauthorisedofficers,subjecttosuchconditionsorlimitationsassetoutinthisActorastheControllermayspecifyinwriting;andanyreferenceinthisActtotheControllershallincludeareferencetosuchanauthorisedofficer.

（4）  ForthepurposesofthisAct,anauthorisedofficermaybegivensuchtitleastheMinistermay,bynotificationintheGazette,specify.

Controllerandemploymentinspectorstobepublicservants

3A.  TheControllerandeveryDeputyControllerofWorkPasses,AssistantControllerofWorkPassesandemploymentinspectorappointedundersection 3shallbedeemedtobepublicservantswithinthemeaningofthePenalCode（Cap.224）.

Exemption

4.  TheMinistermay,bynotificationintheGazette,exemptanypersonorclassofpersonsfromalloranyoftheprovisionsofthisAct.

Prohibitionofemploymentofforeignemployeewithoutworkpass

5.

—

（1）  Nopersonshallemployaforeignemployeeunlesstheforeignemployeehasavalidworkpass.

（2）  Noforeignemployeeshallbeintheemploymentofanemployerwithoutavalidworkpass.

（3）  Nopersonshallemployaforeignemployeeotherwisethaninaccordancewiththeconditionsoftheforeignemployee’sworkpass.

（4）  Inanyproceedingsforanoffenceundersubsection 

（1）,itshallnotbeadefenceforadefendanttoprovethathedidnotknowthattheemployeewasaforeignerunlessthedefendantfurtherprovesthathehadexercisedduediligencetoascertainthenationalityoftheemployee.

（5）  Forthepurposeofsubsection （4）,adefendantshallnotbedeemedtohaveexercisedduediligenceunlesshehadcheckedthepassport,documentofidentityorothertraveldocumentoftheemployee.

（6）  Anypersonwhocontravenessubsection 

（1）shallbeguiltyofanoffenceandshall —

（a）

beliableonconvictiontoafineofnotlessthan$5,000andnotmorethan$30,000ortoimprisonmentforatermnotexceeding12monthsortoboth;and

（b）

onasecondorsubsequentconviction —

（i）

inthecaseofanindividual,bepunishedwithafineofnotlessthan$10,000andnotmorethan$30,000andwithimprisonmentforatermofnotlessthanonemonthandnotmorethan12 months;or

（ii）

inanyothercase,bepunishedwithafineofnotlessthan$20,000andnotmorethan$60,000.
