AGREEMENTONSAFEGUARDS
Members,
HavinginmindtheoverallobjectiveoftheMemberstoimproveandstrengthentheinternationaltradingsystembasedonGATT1994;
RecognizingtheneedtoclarifyandreinforcethedisciplinesofGATT1994,andspecificallythoseofitsArticle XIX(EmergencyActiononImportsofParticularProducts),toreestablishmultilateralcontroloversafeguardsandeliminatemeasuresthatescapesuchcontrol;
Recognizingtheimportanceofstructuraladjustmentandtheneedtoenhanceratherthanlimitcompetitionininternationalmarkets;and
Recognizingfurtherthat,forthesepurposes,acomprehensiveagreement,applicabletoallMembersandbasedonthebasicprinciplesofGATT1994,iscalledfor;
Herebyagreeasfollows:
Article 1
GeneralProvision
ThisAgreementestablishesrulesfortheapplicationofsafeguardmeasureswhichshallbeunderstoodtomeanthosemeasuresprovidedforinArticle XIXofGATT1994.
Article2
Conditions
1.AMembermayapplyasafeguardmeasuretoaproductonlyifthatMemberhasdetermined,pursuanttotheprovisionssetoutbelow,thatsuchproductisbeingimportedintoitsterritoryinsuchincreasedquantities,absoluteorrelativetodomesticproduction,andundersuchconditionsastocauseorthreatentocauseseriousinjurytothedomesticindustrythatproduceslikeordirectlycompetitiveproducts.
2.Safeguardmeasuresshallbeappliedtoaproductbeingimportedirrespectiveofitssource.
Article 3
Investigation
1.AMembermayapplyasafeguardmeasureonlyfollowinganinvestigationbythecompetentauthoritiesofthatMemberpursuanttoprocedurespreviouslyestablishedandmadepublicinconsonancewithArticle XofGATT1994.Thisinvestigationshallincludereasonablepublicnoticetoallinterestedpartiesandpublichearingsorotherappropriatemeansinwhichimporters,exportersandotherinterestedpartiescouldpresentevidenceandtheirviews,includingtheopportunitytorespondtothepresentationsofotherpartiesandtosubmittheirviews,inter alia,astowhetherornottheapplicationofasafeguardmeasurewouldbeinthepublicinterest.Thecompetentauthoritiesshallpublishareportsettingforththeirfindingsandreasonedconclusionsreachedonallpertinentissuesoffactandlaw.
2.Anyinformationwhichisbynatureconfidentialorwhichisprovidedonaconfidentialbasisshall,uponcausebeingshown,betreatedassuchbythecompetentauthorities.Suchinformationshallnotbedisclosedwithoutpermissionofthepartysubmittingit.Partiesprovidingconfidentialinformationmayberequestedtofurnishnonconfidentialsummariesthereofor,ifsuchpartiesindicatethatsuchinformationcannotbesummarized,thereasonswhyasummarycannotbeprovided.However,ifthecompetentauthoritiesfindthatarequestforconfidentialityisnotwarrantedandifthepartyconcernediseitherunwillingtomaketheinformationpublicortoauthorizeitsdisclosureingeneralizedorsummaryform,theauthoritiesmaydisregardsuchinformationunlessitcanbedemonstratedtotheirsatisfactionfromappropriatesourcesthattheinformationiscorrect.
Article4
DeterminationofSeriousInjuryorThreatThereof
1.ForthepurposesofthisAgreement:
(a)"seriousinjury"shallbeunderstoodtomeanasignificantoverallimpairmentinthepositionofadomesticindustry;
(b)"threatofseriousinjury"shallbeunderstoodtomeanseriousinjurythatisclearlyimminent,inaccordancewiththeprovisionsofparagraph 2.Adeterminationoftheexistenceofathreatofseriousinjuryshallbebasedonfactsandnotmerelyonallegation,conjectureorremotepossibility;and
(c)indetermininginjuryorthreatthereof,a"domesticindustry"shallbeunderstoodtomeantheproducersasawholeofthelikeordirectlycompetitiveproductsoperatingwithintheterritoryofaMember,orthosewhosecollectiveoutputofthelikeordirectlycompetitiveproductsconstitutesamajorproportionofthetotaldomesticproductionofthoseproducts.
2.(a)IntheinvestigationtodeterminewhetherincreasedimportshavecausedorarethreateningtocauseseriousinjurytoadomesticindustryunderthetermsofthisAgreement,thecompetentauthoritiesshallevaluateallrelevantfactorsofanobjectiveandquantifiablenaturehavingabearingonthesituationofthatindustry,inparticular,therateandamountoftheincreaseinimportsoftheproductconcernedinabsoluteandrelativeterms,theshareofthedomesticmarkettakenbyincreasedimports,changesinthelevelofsales,production,productivity,capacityutilization,profitsandlosses,andemployment.
(b)Thedeterminationreferredtoinsubparagraph (a)shallnotbemadeunlessthisinvestigationdemonstrates,onthebasisofobjectiveevidence,theexistenceofthecausallinkbetweenincreasedimportsoftheproductconcernedandseriousinjuryorthreatthereof.Whenfactorsotherthanincreasedimportsarecausinginjurytothedomesticindustryatthesametime,suchinjuryshallnotbeattributedtoincreasedimports.
(c)Thecompetentauthoritiesshallpublishpromptly,inaccordancewiththeprovisionsofArticle 3,adetailedanalysisofthecaseunderinvestigationaswellasademonstrationoftherelevanceofthefactorsexamined.
Article 5
ApplicationofSafeguardMeasures
1.AMembershallapplysafeguardmeasuresonlytotheextentnecessarytopreventorremedyseriousinjuryandtofacilitateadjustment.Ifaquantitativerestrictionisused,suchameasureshallnotreducethequantityofimportsbelowthelevelofarecentperiodwhichshallbetheaverageofimportsinthelastthreerepresentativeyearsforwhichstatisticsareavailable,unlessclearjustificationisgiventhatadifferentlevelisnecessarytopreventorremedyseriousinjury.Membersshouldchoosemeasuresmostsuitablefortheachievementoftheseobjectives.
2.(a)Incasesinwhichaquotaisallocatedamongsupplyingcountries,theMemberapplyingtherestrictionsmayseekagreementwithrespecttotheallocationofsharesinthequotawithallotherMembershavingasubstantialinterestinsupplyingtheproductconcerned.Incasesinwhichthismethodisnotreasonablypracticable,theMemberconcernedshallallottoMembershavingasubstantialinterestinsupplyingtheproductsharesbasedupontheproportions,suppliedbysuchMembersduringapreviousrepresentativeperiod,ofthetotalquantityorvalueofimportsoftheproduct,dueaccountbeingtakenofanyspecialfactorswhichmayhaveaffectedormaybeaffectingthetradeintheproduct.
(b)AMembermaydepartfromtheprovisionsinsubparagraph(a)providedthatconsultationsunderparagraph 3ofArticle 12areconductedundertheauspicesoftheCommitteeonSafeguardsprovidedforinparagraph 1ofArticle 13andthatcleardemonstrationisprovidedtotheCommitteethat(i)importsfromcertainMembershaveincreasedindisproportionatepercentageinrelationtothetotalincreaseofimportsoftheproductconcernedintherepresentativeperiod,(ii)thereasonsforthedeparturefromtheprovisionsinsubparagraph (a)arejustified,and(iii)theconditionsofsuchdepartureareequitabletoallsuppliersoftheproductconcerned.Thedurationofanysuchmeasureshallnotbeextendedbeyondtheinitialperiodunderparagraph 1ofArticle 7.Thedeparturereferredtoaboveshallnotbepermittedinthecaseofthreatofseriousinjury.
Article 6
ProvisionalSafeguardMeasures
Incriticalcircumstanceswheredelaywouldcausedamagewhichitwouldbedifficulttorepair,aMembermaytakeaprovisionalsafeguardmeasurepursuanttoapreliminarydeterminationthatthereisclearevidencethatincreasedimportshavecausedorarethreateningtocauseseriousinjury.Thedurationoftheprovisionalmeasureshallnotexceed200 days,duringwhichperiodthepertinentrequirementsofArticles 2through7and12shallbemet.Suchmeasuresshouldtaketheformoftariffincreasestobepromptlyrefundedifthesubsequentinvestigationreferredtoinparagraph 2ofArticle 4doesnotdeterminethatincreasedimportshavecausedorthreatenedtocauseseriousinjurytoadomesticindustry.Thedurationofanysuchprovisionalmeasureshallbecountedasapartoftheinitialperiodandanyextensionreferredtoinparagraphs 1,2and 3ofArticle 7.
Article 7
DurationandReviewofSafeguardMeasures
1.AMembershallapplysafeguardmeasuresonlyforsuchperiodoftimeasmaybenecessarytopreventorremedyseriousinjuryandtofacilitateadjustment.Theperiodshallnotexceedfouryears,unlessitisextendedunderparagraph 2.
2.Theperiodmentionedinparagraph 1maybeextendedprovidedthatthecompetentauthoritiesoftheimportingMemberhavedetermined,inconformitywiththeproceduressetoutinArticles 2,3,4and 5,thatthesafeguardmeasurecontinuestobenecessarytopreventorremedyseriousinjuryandthatthereisevidencethattheindustryisadjusting,andprovidedthatthepertinentprovisionsofArticles 8and 12areobserved.
3.Thetotalperiodofapplicationofasafeguardmeasureincludingtheperiodofapplicationofanyprovisionalmeasure,theperiodofinitialapplicationandanyextensionthereof,shallnotexceedeightyears.
4.Inordertofacilitateadjustmentinasituationwheretheexpecteddurationofasafeguardmeasureasnotifiedundertheprovisionsofparagraph 1ofArticle 12isoveroneyear,theMemberapplyingthemeasureshallprogressivelyliberalizeitatregularintervalsduringtheperiodofapplication.Ifthedurationofthemeasureexceedsthreeyears,theMemberapplyingsuchameasureshallreviewthesituationnotlaterthanthemidtermof
