ontheprotectionofanimalsduringtransportandrelatedoperationsandamendingDirectives64/432/EECand93/119/ECandRegulation（EC）No1255/97

THECOUNCILOFTHEEUROPEANUNION,

HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle37thereof,

HavingregardtotheproposalfromtheCommission,

HavingregardtotheOpinionoftheEuropeanParliament[1],

HavingregardtotheOpinionoftheEuropeanEconomicandSocialCommittee[2],

FollowingconsultationoftheCommitteeoftheRegions,

Whereas:

（1）TheProtocolonprotectionandwelfareofanimalsannexedtotheTreatyrequiresthatinformulatingandimplementingagricultureandtransportpolicies,theCommunityandtheMemberStatesaretopayfullregardtothewelfarerequirementsofanimals.

（2）UnderCouncilDirective91/628/EECof19November1991ontheprotectionofanimalsduringtransport[3],theCouncilhasadoptedrulesinthefieldofthetransportofanimalsinordertoeliminatetechnicalbarrierstotradeinliveanimalsandtoallowmarketorganisationstooperatesmoothly,whileensuringasatisfactorylevelofprotectionfortheanimalsconcerned.

（3）TheReportfromtheCommissiontotheEuropeanParliamentandtheCouncilontheexperienceacquiredbyMemberStatessincetheimplementationofCouncilDirective95/29/ECof29June1995amendingDirective91/628/EECconcerningtheprotectionofanimalsduringtransport[4],asrequiredunderDirective91/628/EEC,recommendedamendingcurrentCommunitylegislationinthisfield.

（4）MostMemberStateshaveratifiedtheEuropeanConventionfortheprotectionofanimalsduringinternationaltransportandtheCouncilhasgivenamandatetotheCommissiontonegotiateonbehalfoftheCommunitytherevisedEuropeanConventionfortheprotectionofanimalsduringinternationaltransport.

（5）Forreasonsofanimalwelfarethetransportofanimalsoverlongjourneys,includinganimalsforslaughter,shouldbelimitedasfaraspossible.

（6）TheCouncilinvitedtheCommissionon19June2001[5]tosubmitproposalsforensuringeffectiveimplementationandstrictenforcementofexistingCommunitylegislation,improvingtheprotectionandwelfareofanimalsaswellaspreventingtheoccurrenceandspreadofinfectiousanimaldiseases,andputtinginplacemorestringentrequirementssoastopreventpainandsufferinginordertosafeguardthewelfareandhealthofanimalsduringandaftertransport.

（7）On13November2001,theEuropeanParliamentcalledontheCommissiontopresentproposalsforamendingexistingCommunityrulesonthetransportoflivestock,inparticularwithaviewto:

-consultingthecompetentscientificcommitteeonthedurationofanimaltransport,

-presentingaharmonisedEuropeanmodelcertificatefortransporters;harmonisingrouteplansforlongtransport,

-ensuringthatanymemberofstaffhandlinglivestockduringtransporthascompletedatrainingcourserecognisedbythecompetentauthorities,and

-ensuringthatveterinarychecksatCommunityborderinspectionpostsincludecomprehensiveinspectionofthewelfareconditionsinwhichanimalsaretransported.

（8）TheScientificCommitteeonAnimalHealthandAnimalWelfareadoptedanopiniononthewelfareofanimalsduringtransporton11March2002.Communitylegislationshouldthereforebeamendedtotakeintoaccountnewscientificevidencewhilegivingprioritytotheneedforitsenforceabilitytobeproperlyensuredintheimmediatefuture.

（9）Specificprovisionsforpoultry,catsanddogswillbesetoutinappropriateproposalswhentherelevantopinionsoftheEuropeanFoodSafetyAuthority（EFSA）areavailable.

（10）InthelightofexperiencegainedunderDirective91/628/EECinharmonisingCommunitylegislationonthetransportofanimals,andthedifficultiesencounteredduetothedifferencesintranspositionofthatDirectiveatnationallevel,itismoreappropriatetosetoutCommunityrulesinthisfieldinaregulation.PendingtheadoptionofdetailedprovisionsforcertainspecieshavingparticularneedsandrepresentingaverylimitedpartoftheCommunitylivestock,itisappropriatetoallowMemberStatestoestablishormaintainadditionalnationalrulesapplyingtotransportofanimalsofsuchspecies.

（11）InordertoensureaconsistentandeffectiveapplicationofthisRegulationacrosstheCommunityinthelightofitsbasicprincipleaccordingtowhichanimalsmustnotbetransportedinawaylikelytocauseinjuryorunduesufferingtothem,itisappropriatetosetoutdetailedprovisionsaddressingthespecificneedsarisinginrelationtothevarioustypesoftransport.Suchdetailedprovisionsshouldbeinterpretedandappliedinaccordancewiththeaforesaidprincipleandshouldbetimelyupdatedwhenever,inparticularinthelightofnewscientificadvice,theyappearnolongertoensurecompliancewiththeaboveprincipleforparticularspeciesortypesoftransport.

（12）Transportforcommercialpurposesisnotlimitedtotransportwhereanimmediateexchangeofmoney,goodsorservicestakesplace.Transportforcommercialpurposesincludes,inparticular,transportwhichdirectlyorindirectlyinvolvesoraimsatafinancialgain.

（13）Theunloadingandsubsequentreloadingofanimalscouldalsobeasourceofstressforthemandcontactatcontrolposts,formerlyreferredtoasstagingpoints,couldincertainconditionsleadtothespreadofinfectiousdiseases.Itisthereforeappropriatetoprovideforspecificmeasuressafeguardingthehealthandwelfareofanimalswhenrestingatcontrolposts.Asaresult,itisnecessarytoamendtheprovisionsofCouncilRegulation（EC）No1255/97of25June1997concerningCommunitycriteriaforstagingpointsandamendingtherouteplanreferredtointheAnnextoDirective91/628/EEC[6].

（14）Poorwelfareisoftenduetolackofeducation.Therefore,trainingshouldbeaprerequisiteforanypersonhandinganimalsduringtransportandtrainingshouldbeprovidedonlybyorganisationsapprovedbythecompetentauthorities.

（15）Welfareconditionsofanimalsduringtransportresultmainlyfromtheday-to-dayconductofthetransporters.ChecksbycompetentauthoritiesmaybehinderedastransporterscanfreelyoperateindifferentMemberStates.Therefore,transportersshouldbemoreaccountableandtransparentconcerningtheirstatusandoperations.Inparticulartheyshouldprovideproofoftheirauthorisation,systematicallyreportanydifficultyandkeeppreciserecordsoftheiractionsandtheresults.

（16）Animaltransportinvolvesnotonlytransportersbutalsoothercategoriesofoperatorssuchasfarmers,traders,assemblycentresandslaughterhouses.Asaconsequence,someobligationsregardingthewelfareofanimalsshouldbeextendedtoanyoperatorinvolvedinthetransportofanimals.

（17）Assemblycentresplayacriticalroleinthetransportofsomelivestockspecies.Therefore,assemblycentresshouldensurethatCommunitylegislationontheprotectionofanimalsduringtransportisknownandrespectedbytheiremployeesandvisitors.

（18）Longjourneysarelikelytohavemoredetrimentaleffectsonthewelfareofanimalsthanshortones.Hencespecificproceduresshouldbedesignedtoensurebetterenforcementofthestandards,inparticularbyincreasingthetraceabilityofsuchtransportoperations.

（19）CouncilRegulation（EEC）No3820/85of20December1985ontheharmonisationofcertainsociallegislationrelatingtoroadtransport[7]providesformaximumdrivingperiodsandminimumrestperiodsforroaddrivers.Itisappropriatethatjourneysforanimalsaresimilarlyregulated.CouncilRegulation（EEC）No3821/85of20December1985onrecordingequipmentinroadtransport[8]providesforrecordingequipmenttobeinstalledandusedtoensureeffectivecheckingoncompliancewithsociallegislationconcerningroadtransport.Itisnecessarythatsuchrecorddatabemadeavailableandcheckedsoastoenforcetravellingtimelimitsunderanimalwelfarelegislation.

（20）InsufficientexchangeofinformationbetweencompetentauthoritiesleadstoinadequateenforcementofCommunitylegislationfortheprotectionofanimalsduringtransport.Accordingly,itisnecessarytosetupflexibleprocedurestoimprovethelevelofcollaborationbetweenthecompetentauthoritiesinthedifferentMemberStates.

（21）RegisteredEquidae,asdefinedinArticle2（c）ofDirective90/426/EEC[9],arefrequentlytransportedfornon-commercialpurposesandsuchtransportsmustbecarriedoutinlinewiththeoverallobjectivesofthisRegulation.Havingregardtothenatureofsuchmovements,itappearsappropriatetoderogatefromcertainprovisionswhereregisteredEquidaearetransportedforcompetition,races,culturaleventsorbreeding.However,itisnotappropriatetoapplysuchderogationtoEquidaetransported,directlyoraftertransitthroughamarketormarshallingcentre,toaslaughterhouseforslaughter,whichinaccordancewithArticle2（d）and8

（1）,secondindentofDirective90/426/EEC,aretobeconsideredas"Equidaeforslaughter".

（22）Inadequatefollow-upofinfringementsoflegislationonanimalwelfareencouragesnon-compliancewithsuchlegislationandleadstodistortionofcompetition.Therefore,uniformproceduresshouldbeestablishedthroughouttheCommunitytoincreasechecksandtheimpositionofpenaltiesforinfringementsofanimalwelfarelegislation.TheMemberStatesshouldlaydownrulesonpenaltiesapplicabletoinfringementsoftheprovisionsofthisRegulationandensurethattheyareimplemented.Thosepenaltiesmustbeeffective,proportionateanddissuasive.

（23）Asignificantnumberofanimalsaretransportedbylivestockvessel
