AdditionalClausesforBusinessInterruptionInsurance

ThefollowingclausesaretheAdditionalClausesforBusinessInterruptionInsurancePolicy（2009Version）,whichishereinaftercalledPolicy.Theterms,conditionsandexclusionsofthePolicyshallapplyexcepttotheextentthattheyareexpresslyvariedbytheAdditionalClauses.AnyoneoftheAdditionalClause（s）couldbechosenbytheApplicanttobeattachedtoandformingpartofthePolicy.

1.ExtensionClauses

K01.ScopeofCover（A）

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,theInsurershallindemnifytheInsuredinrespectoflossofGrossProfitresultingfrominterruptionoforinterferencewiththebusinessatthepremisesinconsequenceofphysicaldamagetothepropertyusedinbusinessoperationcausedbyperilsorhazardscoveredunderthePhysicalDamageInsuranceduringtheperiodofinsurance.

ProvidedthattheInsurershallnotbeliableforanylossduetocausesasfollowing:

1.willfulactand/orgrossnegligenceoftheApplicantand/ortheInsured;and/or

2.earthquakeortsunamiand/orsecondarydisasterssocaused;and/or

3.strike,riot,civilcommotion,maliciousdamagean/oractofterrorism;and/or

4.confiscation,temporaryorpermanentrequisitionbyorderofthegovernmentdejureordefactoorbyanypublicauthority;and/or

5.nuclearradiation,nuclearfission,nuclearfusion,nuclearpollutionorcontaminationandotherradioactivepollutionorcontamination;and/or

6.pollutionofatmosphere,soil,waterandothernon-radioactivepollution;and/or

7.otherexclusionswhichagreedbytheInsurerandtheInsured.

ThisClauseissubjectotherwisetotheterms,ConditionsandExclusionsofthisPolicy.

K06.DenialofAccess（A）

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,lossasinsuredbythisPolicyresultingfrominterruptionoforinterferencewiththebusinessinconsequenceofthedamage（aswithindefine）topropertyinthevicinityofthePremiseswhichshallpreventorhindertheusethereofofaccessthereto,whetherthePremisesorpropertyoftheInsuredthereinshallbedamagedornot,shallbedeemedtobelossresultingfromdamagetopropertyusedbytheInsuredatthePremises.

ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.

K07.DenialofAccess（B）

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,lossasinsuredbythisPolicyresultingfrominterruptionoforinterferencewiththebusinessinconsequenceofthedamage（aswithindefine）topropertyinthevicinityofthePremiseswhichshallpreventorhindertheusethereofofaccessthereto,whetherthePremisesorpropertyoftheInsuredthereinshallbedamagedornot,shallbedeemedtobelossresultingfromdamagetopropertyusedbytheInsuredatthePremises.

Provided,however,thattheInsurershallnotbeliableforanylossiftheaforesaidpreventionoftheuseofthepremiseorthehinderoftheaccesstheretoiscontributedtothefailureofgasand/orwatersupplyinthevicinityofInsuredpremisesresultingfromthepropertydamagethereof.

TheindemnitylimitunderthisclauseshallnotexceedtherelevantsublimitsstatedinthePolicy.

ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.

K08.Murder,InfectiousDisease,andFoodContaminationExtensionClause（A）

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,thisPolicyisextendedtocoverlossasinsuredhereunderresultingfrominterruptionoforinterferencewiththeBusinesscarriedonbytheInsuredatthePremisesinconsequencesof:

1.MurderorsuicideoccurringatthePremisesstatedinthePolicy;

2.Closure&/orquarantineofthePremisesstatedinthePolicybyorderofacompetentpublicauthorityduetoNotifiableInfectiousDiseasemanifestedbyanypersonatthePremises;

3.ClosingofthewholeorpartofthepremisesbyorderofacompetentpulblicauthorityconsequentupondefectsinthedrainsandothersanitaryfacilitiesatthePremisesstatedinthePolicy.

4.InjuryorillnesssustainedbyanyguestarisingfromspoilageoforinfectiousmatterinfoodordrinksprovidedatthePremisesstatedinthePolicy.

InrespectofeachandeveryoccurrenceofthedamagegivingrisetoaclaimunderthisClause,theInsurershallnotbeliableforthefirstseventy-two（72）hoursofsuchloss.

ItisaconditionprecedenttoanyliabilityoftheInsurerthattheInsuredshallobserveandfulfillrelevantlaws,regulationsandrequirementsonsecurity,sanitationandhealth,andshallexerciseduediligencetoavoidtheoccurrenceofthecontingenciesaforementioned.

TheindemnitylimitunderthisclauseshallnotexceedtherelevantsublimitsstatedinthePolicy.

ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.

K09.Murder,InfectiousDisease,andFoodContaminationExtension（B）

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,thisPolicyisextendedtocoverlossasinsuredhereunderresultingfrominterruptionoforinterferencewiththeBusinesscarriedonbytheInsuredatthePremisesinconsequencesof:

1.ThecancellationoforinabilitytoacceptbookingsforaccommodationatthepremisesasaresultofanoutbreakofaninfectiousorcontagiousdiseaseoccurringatthePremises;

2.MurderorsuicideoccurringatthePremises;

3.InjuryorillnesssustainedbyanyguestarisingfromspoilageoforinfectiousmatterinfoodordrinksprovidedatthePremises;

4.ClosingofthewholeorpartofthePremisesbyorderofacompetentpublicauthorityconsequentupondefectsinthedrainsandothersanitaryfacilitiesatthePremises.

ItisaconditionprecedenttoliabilityonthepartoftheInsurerthattheInsuredshallmakesureeveryarticleisappropriatelyusedandshallexerciseduediligencetoavoidtheoccurrenceofthecontingenciesaforementioned.

Theindemnitylimitunderthisclauseshallnotexceed__.

ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.

K10.Murder,InfectiousDisease,andFoodContaminationExtension（C）

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,thisPolicyisextendedtocoverlossasinsuredhereunderresultingfrominterruptionoforinterferencewiththeBusinesscarriedonbytheInsuredatthePremisesinconsequencesof:

1.ThecancellationoforinabilitytoacceptbookingsforaccommodationatthepremisesasaresultofanoutbreakofaninfectiousorcontagiousdiseaseoccurringatthePremises;

2.MurderorsuicideoccurringatthePremises;

3.InjuryorillnesssustainedbyanyguestarisingfromspoilageoforinfectiousmatterinfoodordrinksprovidedatthePremises;

4.ClosingofthewholeorpartofthepremisesbyorderofacompetentpublicauthorityconsequentupondefectsinthedrainsandothersanitaryfacilitiesatthePremises.

InrespectofeachandeveryoccurrenceofthedamagegivingrisetoaclaimunderthisClause,theInsurershallnotbeliableforthefirstthree（3）daysofsuchloss.

ItisaconditionprecedenttoliabilityonthepartoftheInsurerthattheInsuredshallmakesureeveryarticleisappropriatelyusedandshallexerciseduediligencetoavoidtheoccurrenceofthecontingenciesaforementioned.

ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.

K11.InfectiousDiseaseExtension

Itisagreedandunderstoodthat,subjecttotheApplicanthavingpaidtheagreedadditionalpremium,thispolicyisextendedtocoverlossresultingfrominterruptionoforinterferencewiththebusinessasthedirectandsoleresultofNotifiableInfectiousDiseasemanifestedbyanypersonattheInsuredPremiseswhichresultsinthetotalclosure&/orquarantineoftheInsuredPremisesbyorderofacompetentgovernmen
