CollectiveBargainingAgreement劳资条约doc
CollectiveBargainingAgreement劳资协议-
1.TheCompanyandtheUnionagreethattheywillnotdiscriminateagainstanemployeebyreasonofrace,color,creed,age,sex,sexualpreference,physicalormentaldisability,nationalorigin,membershipornon-membershipintheUnion.
2.NothinginthisAgreementshallbeconstruedasconstitutinganagreementthatanyworkisormaybecometheexclusiverightofanyemployeeorclassificationofemployees.TheCompanyretainsthesoleandunrestricteddiscretiontodirectemployees,onatemporarybasis,toperformworknotwithinthejobdescriptionofthepositionthattheynormallyoccupywhenevertheCompanydeterminesthattheinterestsofensuringregulatorycomplianceandproductqualityandintegrity,andmaximizingproductivity,efficiencyorsafetywillbestbeservedbydoingso.Thisclauseshallnotcontravenetheseniorityandovertimeprovisions.
3.AllprovisionsofthisAgreementareassumedtobeinconformitywiththeapplicablelawsoftheStatesofNewJerseyandNewYorkandtheUnitedStates.Ifanyprovisionsarelaterproventobecontrarytoanyapplicablelawexistingatthistimeorsubsequentlyenacted,suchprovisionshallthenbeconsideredvoid,andtheinvalidityorunenforceabilityofsuchprovisionshallhavenoeffectontheremainingprovisionsoftheAgreement.
4.TheCompanyhastherighttousesupervisorsandothernon-bargainingunitpersonneltoperformbargainingunitworktowhateverextentandforwhateverdurationmanagementdeemsbestservestheCompany’soverallinterestsinensuringregulatorycomplianceandproductqualityandintegrity,andmaximizingsafety.Supervisorsalsomay,intheinterestsofefficiencyandorderlyproduction,fillinorworkonaparticularjobasdictatedbythenecessitiesoftheoperation.However,ifanemployeewithinthebargainingunitleavestheemployoftheCompany,hewillnotbereplacedwithasupervisoryemployeeprovidedthepositionisstillavailable.Likewise,ifthereareovertimeopportunities,supervisoryemployeesshallnotreplacebargainingunitemployees;butthisproscriptionshallnotprecludequalifiedsupervisorsfromdoinguptotwo
(2)hoursofunitworkiftherearenoqualifiedbargainingunitemployeesintheplantandavailabletodotheworkatthetime.Someexamplesofsupervisorsworkingare:
(a)Emergenciesoccurringduringscheduledworkingdayswhenanoperationisnotfullymanned.
(b)Instructingortrainingofemployees,includingself-training.
(c)Performingexperimentalworkinvolvingnewproducts,newequipment,newmethodsornewmaterials.
(d)Makingminoradjustmentsandsetup.
(e)Providingforthecontinuanceoftheworkflow.
(f)Productvalidationorothernonproductionscientificwork.
ItisagreedthattheCompanyshallnotexerciseitsrightsunderthisSectioninsuchawayastoreducesystematicallythenumberofbargainingunitpositions.
5.TheCompanyshallberesponsibleforinstitutingformaltrainingproceduresinalljobclassifications.TrainingshallbeperformedbysuchpersonnelastheCompanydeems,initssoleandunrestricteddiscretion,bestsuitedtoeffectiveandefficientperformanceofthetrainingfunction.Employeesassignedtoperformsuchtrainingfunctionsshallbecompensatedatarateonedollarandfiftycents($1.50)abovetheirnormalrateduringtheperiodofsuchassignment.Atrainingguideshallbedevelopedcoveringtheskillsandresponsibilitieswhichemployeesineachtypeofworkshallbetaught.Employeesmaybedirectedtoparticipateincross-trainingexercisestoensuretheavailabilityofadequatepersonnelwiththeappropriateskillmixtodealwithemergencyorpeakloadsituations,ortobestservetheCompany’soverallinterestsinensuringregulatorycomplianceandproductqualityandintegrity,andmaximizingproductivity,efficiencyandsafety.Thedeterminationofthedepartmentsinwhichcross-trainingwillbedoneandthenumberofemployeesinsuchdepartmentstobegivencross-trainingisamattercommittedtothesoleandunrestricteddiscretionoftheCompany.Iflessthanallemployeesinajobclassificationwithinadepartmentaretobeassignedtoparticipateincross-trainingexercises,employeesshallbeselectedforsuchexercisesonthebasisofseniority.Employeestemporarilyassignedtopositions,otherthantheonestheynormallyoccupy,forcross-trainingpurposesshallnotbedeemedtohavetransferredintosuchpositions.TheCompanywillinformtheUnionatleasttwo
(2)weekspriortoimplementationofitsplans,andanymodificationsthereof,forcross-traininginanydepartmentwithbargainingunitemployeeswhowillbeinvolvedinthecross-trainingprogram.Allemployeeswhoparticipateintraining,whetherastrainersortrainees,shallberequiredtocertifyondocumentationprovidedbytheCompanythatsuchtraininghasbeencompleted.However,itisunderstoodthatanemployee’ssignatureasrequiredbytheprecedingsentencedoesnotnecessarilysignifythattheemployeecertifiesorbelievesthatthecontentofthetrainingwassufficienttoqualifytheemployeereceivingthetrainingtoperformworkofthesortthatwasthesubjectofthetraining.
6.MANAGEMENTTRAINEES:
WhereasitistheexpressedintentoftheCompanytotrain,educateandfamiliarizesupervisorsandmanagerswiththeCompany’stotaloperation,includingeachphaseoftheoperation,departmentbydepartment,theCompanyshallhavetherighttohavemanagementtraineesworkonanyoralljobs,includingproductionjobsincludedinthebargainingunit,withthefollowinglimitations:
(a)ManagementtraineesshallnotbeincludedinthebargainingunitandshallnotberequiredtojointheUnion.
(b)Managementtraineesshallnotexceedfifteenpercent(15%)orten(10)employees,whicheveristhelesser,ofthetotalnumberofbargainingunitemployeesatanygiventime(i.e.,ifthereareforty(40)bargainingunitemployees,thereshallnotbemorethansix(6)managementtrainees).TheCompanywillnotifytheUnionofitsdecisiontoemploymanagementtraineespursuanttothisSectiononorbeforethecommencementdateoftheemploymentofanysuchemployees.
(c)Amanagementtraineeshallnotperformbargainingunitworkforaperiodinexcessoffifteen(15)monthsonanover-allbasis,andnotmorethanfour(4)consecutivemonthsinanyonedepartment.
(d)Althoughthecompanyidentifieswithandsubscribestothepolicyofpromotionfromwithin,andmayselectemployeesfromthebargainingunittobecomemanagementtrainees,itisunderstoodthatitiswithintheCompany’ssoleandunrestricteddiscretiontodetermineandselectemployeestobecomemanagementtraineesandmaymakesuchselectionfromanyoutsidesource.
(e)ItisnottheintentoftheCompanytosubstitutemanagementtraineesforbargainingunitemployeesintheperformanceofbargainingunitwork.
(f)TheUnionshallbeentitledtomeetwiththeCompanyeverysix(6)monthstoreviewtheManagementTraineeProgram.
7.SUMMERHELP:
Employeeshiredduringthesummervacationperiod(90daysorless)orduringthetwo-weekChristmasperiodshallbeexcludedfromcoverageundertheAgreement.
8.CoffeewillbeprovidedatCompanyexpenseinallbreakroomsutilizedbybargainingunitemployees.
9.BargainingunitemployeesshallbesuppliedbytheCompanywithuniformstobeworninperformingtheirwork,andtheCompanyshallmakearrangementsforperiodiccleaningofsuchuniformsatCompanyexpense.
10.Whenbargainingunitemployeesarerequiredforjob-relatedreasonstotravelusingtheirownvehiclesbetweentheCompany’sfacilitiesattheNorthvale,NewJerseylocationandthePomona,NewYorklocation,theyshallbereimbursedbytheCompanyforsuchtravelattherateof_________cents($_________)permile.
11.Paychecksforbargainingunitemployeesshallbeissuedweekly,andpaydayshallbeonWednesday.
12.Bagelsand/ordonutsshallbeprovidedforbargainingunitemployeesrequiredtoworkovertimeonSaturday,unlessoneormoreemployeesarescheduledtoworkstraighttimeonthatday.
13.BargainingunitemployeesworkingthesecondshiftshallnotberequiredtobeginmandatoryovertimeworkonSaturdaysanysoonerthaneight(8)hoursaftercompletionoftheirfinal,straight-timeshift(whichwouldhavebegunontheprecedingFriday);notwithstandingtheforegoing,secondshiftemployeesmaybeginovertimeworkonSaturdaysinlessthaneight(8)hoursaftercompletionoftheirlastprecedingstraight-timeshiftifsucharrangementismutuallyagreeabletotheemployeeandthesupervisorresponsibleforschedulingtheovertimework.
14.TheCompanywillgenerallyseektomaintainaone-to-oneratioofQAAssociatestoQAInspectorsintheQualityAssuranceDepartment.Notwithstandingtheforegoing,itshallnotbeconsideredaviolationofthetermsofthisAgreementfortheCompanytohaveasmanyastwo
(2)moreQAAssociatesthanQAInspectorsintheDepartmentforaperiodofuptofour(4)monthsiftheCompanydeemsthatsuchanimbalanceadvancestheCompany’sinterestsinensuringregulatorycomplianceandproductqualityandintegrityandmaximizingproductivity,efficiencyandsafety.
15.WORKANDFAMILYCOMMITTEE:
TheCompanyandtheUnionrecognizethatcounselingandotherformsofassistancemaybeofvaluetoanemployeeandhisorherfamilyinsituationsinwhichpersonalproblemshavethepotentialtointerferewiththeemployee’sperformanceofjobresponsibilities.TheCompanyandUnionalsorecognizethatCompanypoliciesmayhaveanimpactonthelivesofemployees.TheCompanyandtheUnionagreethatemployees
