Article1TheCivilProcedureLawofthePeople’sRepublicofChinaisformulated

accordingtotheConstitutionandinthelightoftheexperienceandactualconditionsofadjudicatingcivilcasesinourcountry.

Article2ThepurposesoftheCivilProcedureLawofthePeople’sRepublicofChina

aretoprotectthelitigationrightsexercisedbytheparties,toensurethatthepeople’scourtsfindfacts,todistinguishrightfromwrong,toapplythelawcorrectly,totrycivilcasespromptly,toaffirmtherightsandobligationsincivilaffairs,toimposesanctionsforcivilwrongdoings,toprotectthelawfulrightsandinterestsoftheparties,toeducatecitizenstovoluntarilyabidebythelaw,tomaintainthesocialandeconomicorder,andtoguaranteethesmoothprogressofthesocialistconstruction.Article3TheprovisionsofthisLawshallapplytoallthecivillitigationacceptedbypeople’scourtsregardingdisputesoverthestatusofpropertyandpersonalrelationsamongcitizens,legalpersons,orotherorganizationsrespectivelyandmutuallybetweencitizens,legalpersons,orotherorganizations.

Article4AllthosewhoinvolveincivillawsuitswithintheterritoryofthePeople’s

RepublicofChinamustabidebythisLaw.

Article5Foreignnationals,statelesspersons,foreignenterprises,ororganizations,

whichinitiateorrespondtolawsuitsinpeople’scourts,shallhavethesamelitigation

rightsandobligationsasthecitizens,legalpersons,orotherorganizationsofthe

People’sRepublicofChina.

Shouldthecourtsofaforeigncountryimposerestrictionsonthecivillitigationrights

ofthecitizens,legalpersons,orotherorganizationsofthePeople’sRepublicofChina,thepeople’scourtsofthePeople’sRepublicofChinashallfollowtheprincipleof

reciprocityregardingthecivillitigationrightsofthecitizens,

enterprises,ororganizationsofthatforeigncountry.

Article6Theadjudicationauthorityovercivilcasesshallbeexercisedbythepeople’s

courtsonly.

Thepeople’scourtsshalladjudicatecivilcasesindependentlyaccordingtolaw,andshallnotbesubjecttoanyinterferencefromanadministrativeorgan,public

organization,orindividual.

Article7Thepeople’scourtsmusttakethefactsasthebasisandtakethelawasthe

criterionwhenadjudicatingcivilcases.

Article8Allpartiestoacivillitigationshallhaveequallitigationrights.Thepeople’s

courtsshall,whenadjudicatingcivilcases,guaranteeandfacilitateallpartiesto

exercisetheirlitigationrights,andapplythelawequallytoallparties.

Article9Whenadjudicatingcivilcases,thepeople’scourtsmaymediatethedisputes

accordingtotheprinciplesofvoluntarinessandlawfulness;ifamediationagreement

cannotbereached,thecourtsshallrenderjudgmentswithoutdelay.

Article10Whenadjudicatingcivilcases,thepeople’scourtsshallapplythesystems

ofcollegialpanel,recusal,publictrial,and“twotrialsandthesecondoneisfinal”.

Article11Chinesecitizensofallethnicitiesshallhavetherighttousetheirnative

spokenandwrittenlanguagesincivilproceedings.

Intheareaswhereanethnicminorityisconcentratedoranumberofdifferentethnic

nationalitieslivetogether,thepeople’scourtsshallconducthearingsandpublishlegal

documentsinthespokenandwrittenlanguagescommonlyusedbythesepeople.

Thepeople’scourtsshallprovidetranslationsforanylitigationparticipantswhoare

notfamiliarwiththespokenorwrittenlanguagescommonlyusedbythelocalpeople.

Article12Whenadjudicatingcivilcasesbythepeople’scourt,thepartiesshallhave

therighttoengageinargument.

Article13Thepartiestoacivillitigationshallbeentitled,withinthescopestipulated

bylaw,todisposetheirrightsofcivilaffairsandlitigation.

Article14Thepeople’sprocuratoratesshallhavetherighttoexerciselegal

supervisionoverthecivilproceedings.

Article15Ifthecivilrightsandinterestsofthestate,acollective,oranindividual

havebeeninfringed,astateorgan,publicorganization,enterprise,orinstitutionmay

supporttheinjuredunitorindividualtoinitiatelegalactioninapeople’scourt.

Article16ThePeople’sConciliationCommitteesaretheorganizationsformassto

mediatecivildisputesderivedfromprivatecitizensundertheguidanceofbasic

people’sgovernmentsandthebasicpeople’scourts.

ThePeople’sConciliationCommitteesshallconductallmediationsaccordingtolegal

provisionsandtheprincipleofvoluntariness.Allconcernedpartiesshallenforce

mediationagreement.Whereanyconcernedpartiesrefusemediation,failtoreacha

mediationagreement,orretractamediationagreement,theymayinitiatelegal

proceedingsinapeople’scourt.IfaPeople’sConciliationCommitteeviolatesthelawwhenmediatingcivildisputes,thepeople’scourtshallcorrectit.Article17Thepeople’scongressesofthenationalautonomousareasmayformulate

someaccommodatingorsupplementaryprovisionsaccordingtotheprinciplesofthe

ConstitutionandthisLawandbasedonthespecificcircumstancesoftheirlocalities.

SuchprovisionsmadebyanautonomousregionshallbesubmittedtotheStanding

CommitteeoftheNationalPeople’sCongressforapproval.Theprovisionsmadeby

anautonomousprefectureorautonomouscountyshallbesubmittedtothestanding

committeeofthepeople’scongressoftherelevantautonomousregionorprovincefor

approvalandtotheStandingCommitteeoftheNationalPeople’sCongressforthe

record.

Chapter2Jurisdiction

Section1JurisdictionbyLevelsofCourts

Article18Abasicpeople’scourtshallhavejurisdictionasthecourtoffirstinstance

overcivilcases,unlessotherwisestipulatedinthisLaw.

Article19Anintermediatepeople’scourtshallhavejurisdictionascourtsoffirstinstanceoverthefollowingcivilcases:

（1）Majorcasesinvolvingforeignelements;

（2）Casesthathavemajorimpactsintheareaofitsjurisdiction;and

（3）Casesunderthejurisdictionoftheintermediatepeople’scourtsasdeterminedby

theSupremePeople’sCourt.

Article20Ahigherpeople’scourtsshallhavejurisdictionasthecourtoffirstinstance

overcivilcasesthathavemajorimpactsontheareasofitsjurisdiction.

Article21TheSupremePeople’sCourtshallhavejurisdictionasthecourtoffirstinstanceoverthefollowingcivilcases:

（1）Casesthathavemajorimpactsonthewholecountry;and

（2）CasesthattheSupremePeople’sCourtdeemsshouldbeadjudicatedbyitself.

Section2TerritorialJurisdiction

Article22Acivillawsuitbroughtagainstacitizenshallbeunderthejurisdictionof

thepeople’scourtlocatedintheplacewherethedefendanthashisdomicile;ifthe

defendant’sdomicileisdifferentfromhishabitualresidence,thelawsuitshallbe

underthejurisdictionofthepeople’scourtlocatedintheplaceofhishabitual

residence.

Acivillawsuitbroughtagainstalegalpersonoranorganizationshallbeunderthe

jurisdictionofthepeople’scourtlocatedintheplacewherethedefendanthasits

domicile.
