2012年中国足球超级联赛俱乐部运动员工作合同（中英文）
2012’sATHLETEEMPLOYECONTRACTOFCHINESESUPERLEAGUE
甲方：
足球俱乐部PartyA:
soccerclub
乙方：
运动员athlete
（国籍nationality出生birthdateofdaymonthyear年月日）
甲、乙双方本着自愿、平等的原则，经过协商一致，签订本合同，以使共同遵守。
Partieshereto，abidingbyprinciplesofequality,voluntarinessandreachingunanimitythroughconsultation,concludeandinterintothiscontractforobservance.
第一条合同期限ClauseITERMLINMITOFCONTRACT
合同期限为壹个赛季，从2012年1月1日至2012年12月31日止。
Termlimitofcontractisoneseasonwhichfromthedateof1January,2012till31December,2012.
（注：
合同期限最短为1个赛季，最长为5个赛季）
Notice:
theminimumtermlimitisoneseasonandmaximumtermlimitisfiveseasons.
第二条工作安排CLAUSEIICONTENTOFWORK
1、甲方安排乙方在俱乐部一队从事训练、比赛和其他活动。
1.PartyAmakeandenablePartyBengageintraining,gameandotheractivity.
2、甲方有权根据俱乐部的需要及乙方能力、表现和状态，在俱乐部一队及预备队之间调整工作岗位。
PartyAhaveauthorityandrightto,baseingonnecessaryofclubandPartyB’sability,achievementandothercondion,adjusthisworkpostbetweenfirstteamandreserveteam.
第三条生活、工作条件和健康保护
CLAUSEIIICONDITIONOFLIVING,WORKINGANDPROTECTIONFORHEALTH
1、甲方为乙方提供清洁、卫生、舒适、便利的住宿安排和营养丰富的饮食安排，其中电话及其他通讯设施的使用费由乙方自理。
PartyAshallprovidePartyBwithaclean,sanitaryandconvenientquarter,andnutritiousdiet.ThefeesoftelephoneandothercommunicationisexpenseofPartyB.
2、如乙方为外籍运动员，甲方应在上述安排基础上予以适当照顾。
（如乙方提出更高的要求，经甲方同意，可在“补充协议”中另作安排，并明确承担费用的责任。
）
WherePartyBwithforeignnationality,towhomPartyAshouldgiveappropriatepreferentialtreatmentbesidespreparationshereabove.IncasePartyBrequiremoresuperioraccommodationwhich,byagreeofPartyA,couldbearrangedotherwiseinSupplementAgreement,inwhichclearlystipulateresponsibilityoftakingrelatedfees.
3、甲方为乙方提供符合中国足球协会执教资格规定的教练员。
PartyAshallprovidePartyBwithcoachwithcompetencyofcoachconformingtotherequirementofChinaFootballAssociation.
4、甲方为乙方提供符合中国足球协会规定标准的草坪训练场和其他训练设施。
PartyAshallprovidePartyBwithlawntrainingfieldconformingtothestandardofChinaFootballAssociationandotherapparatusfortraining.
5、甲方为乙方提供甲方安排的训练、比赛和其他活动的交通、食宿和相关费用。
CostsandexpensesoftrafficandaccommodationrelatedtoPartyB’straining,gameandotheractivitiesbeingarrangedbyPartyAshallbebornebyPartyA.
6、甲方为乙方提供乙方因公伤病的治疗安排及治疗费用和由此产生的相关费用。
PartyAshallarrangePartyB’smedicaltreatmentfortheillnessandinjuryarisingfromworkandbearfeesandotherrelatedfees.
7、甲方为乙方提供乙方非因公伤病的治疗安排及治疗费用（至解约或合同期满），但乙方因违法、违纪、违背社会公德或其他过错行为至使伤病的除外。
PartyA,priorconcellationorexepirationofthiscontract,shallarrangePartyB’smedicaltreatmentfortheillnessandinjuryarisingfromnon-workandbearfeesthereaofandotherrelatedfeesexcepttheillnessandinjuryresultinPartyB’sactionsofbreakinglawandregulation,breachofsocialmoralityorotherfault.
8、甲方为乙方本合同期内，办理养老保险、失业保险、大病保险及人身意外保险、住房公积金，或提供相应的金额由乙方自己办理。
PartyA,withinthetermofthiscontract,effecttheinsuranceofendowment,unemployment,catastrophicillness,personalaccidentandhousingfund,orprovidefundforPartyBtoeffectsamebyhimself.
第四条教育培训CLAUSEIVEDUCATION/TRAINDING
1、甲方如需培养乙方成为教练员或管理人员时，为乙方提供相应的培训条件和费用。
IncasePartyAneedtocultivatePartyBascoachoradministrator,PartyAshouldofferhimcorrespondingtrainconditionandfees.
2、甲方为乙方提供学习文化知识或其他业务知识和技能的条件和便利。
PartyAshallprovidePartyBwiththecondionandconveniencetolearncultureknowledgeorotherprofessionalcompetenceandskill.
第五条工作时间CLAUSEVWORKHOURS
1、甲方安排的工作期包括竞赛准备期和完整赛季。
TheworktermarrangedbyPartyAincludepreparationperiodandwholeseason.
2、甲方依照训练、比赛节奏、在上述工作时间，为乙方安排不少于天的休息日。
PartyAshallarrangePartyBforoff-daynotlessdaysinaccordingtotimingoftrainingandgame.
3、甲方安排的工作，包括训练、比赛、学习、会议、其他活动等，平均每日工作时间不超过8小时。
PartyB’sworkhoursperdayshallnotexceedeighthoursforworksarrangedbyPartyAincludetrainding,game,study,meetingandotheractivity.
第六条肖像权使用CLAUSEVIATHLETE’SPORTRAITURERIGHT
1、乙方享有本人肖像权，未经乙方同意，甲方不得以赢利为目的使用乙方肖像。
PartyBenjoyhimselfportraitrighttowhichPartyA,withoutconsentofPartyB,shallnotusePartyB’sportraitforprofitpurpose.
2、乙方同意甲方和中超委员会在社会公益事业活动、甲方或中超联赛宣传推广活动中，无偿使用乙方肖像，并予以积极合作。
PartyBagreePartyAusehisportraitwithoutcompensationinsocialcommonwealactivity,propagandofChinasuperleaguebyPartyAandcommitteeofsuperleague,andtakecooperationactively.
3、乙方同意在赞助商提供的广告宣传中，无偿使用乙方的肖像。
PartyBagreePartyAuseitsportraitwithoutcompensationinadvertisingpropagandbysponsor.
4、乙方同意中超委员会在为中超联赛赞助商提供的广告宣传中，无偿使用包括乙方在内的不少于5名中超联赛运动员的集体肖像。
PartyBagreePartyAusecollectiveportraitofmorethanfivesuperleagueplayersamongwhichincludePartyBfreecompensationforthepurposeofadvertisingpropagandtosponsor.
5、乙方同意甲方有偿使用乙方肖像进行其他商业广告开发，乙方有权从中获％的收入分成。
PartyBagreePartyAusehisportraintwithpaymentforcommercialadvertismentandisentitletogetincomedivisionof%insumsofadvertisementpayment.
6、乙方使用本人肖像为他人进行广告宣传，必须经过甲方批准，并向甲方上缴％的收入分成。
PartyBusehimselfportraitmakecrommcialadvertisementforothersshouldsubjecttoPartyA’ssanctionandturnin%insumsofadvertisementpaymenttoPartyA.
7、乙方同意甲方和中超委员会有偿使用乙方肖像进行一系列商品开发，并应另行签订协议，获得合理收入。
PartyBagreePartyAandSuperleaguecommitteeusehisportraitwithpaymentfordevelopmentofaseriesofcommodityforwhichanotheragreementsignedandfromwhichgetreasonableincome.
8、乙方获得的上述收入，由甲方代缴个人收入所得税。
PartyB’sindividualincometaxariseouthereaboveincomeshallbeunderwithholdingandcollectiontakenbyPartyA.
第七条工资和奖金CLAUSEVIIWAGEANDBONUS
1、甲、乙双方执行中超委员会制定的《中超俱乐部一线球队工资奖励管理规定》，
PartiesheretoshallexecutetheManagementRuleofWageandRewardForTeamInFirstIineofSuperLeagueconstitutedbysuperleaguecommittee.
2、甲方每月向乙方支付工资元（人民币/美元），其中达到国家规定缴纳个人所得税标准的部分，由甲方代扣代缴个人收入所得税。
PartyAmekepaymentofPartyB’swageof（RMB/USD）,thepartamongwhichreachthestandardofindividualincometaxshould,bystaterull,bewithhledoftaxbyPartyA.
3、如乙方参赛场次、时间或比率未能达到甲方要求时，甲方有权适度核减上述工资，并将核减办法写入补充协议。
Incasethegames,timeorgraderateofPartyBfailtoreqirementofPartyA,PartyAisentitletoreducePartyB’swageappropriatelyforwhichthemeansshallwritteninsupplementagreement.
4、甲方按照比赛性质、比赛结果和乙方上场时间、比赛表现的不同，向乙方支付比赛奖金。
PartyAshallpaybonustoPartyBinconsiderationofqualityandachievementofgame,playingtimeandbehaviour.
5、在中超联赛中，胜场奖金（个人打满全场）最低为元，（人民币/美元），平场奖金（个人打满全场）最低为元（人民币/美元），负场无奖金，俱乐部按照每人报名与否及上场参赛时间的多少等因素发放，具体办法写入“补充协议”；
Insuperleague,ifPartyB,playingfull-courtinwinninggame,shalltakebonusofatleast（RMB/USD）;ifdrawgame,PartyB,playingfull-court,shalltakebonusofatleast（RMB/USD）;iflossgame,noanybonus.Clubshallpaybonusbyconsideratinsofwhethersigninguporplayingtimeforplayertowhichthemeansshallwritteninsupplementagreement.
6、在其他比赛中，奖金依照比赛成绩、商业收入等具体情况另行确定；
Inothergamethebonusshallbeelsedecidedbyspecificsituationsuchasachievementandcommercialincomeetc.
7、除上述工资奖金外，甲方不再以任何名义向乙方支付其他的款项。
Exceptwageandbonushereabove,PartyAshallnotpayanyotherpaymenttoPartyBforanycauseorreason.
8、乙方因公（包括执行国家任务）伤病不能参加训练比赛，甲方应全额支付乙方工资并予以适当补偿（执行国家队任务者，其补贴相当于此间比赛的全队平均奖金）。
WherePartyBfailtotakepartintrainingandgameforinjuryorillnessonbusinessincludeperformingstate’sassignment,PartyAshallpayhimwageinsumandappropriatecompensation,which,asallowanceforperformingstate’sassignment,shallbeequaltowholeteam’saveragebonus.
9、乙方因工伤不能参加训练比赛，而未接触本合同，甲方应向乙方支付不少于全额50％的工资，但乙方因违法、违纪、违背社会公德或其他过错行为致使伤病的除外。
WherePartyBfailtotakepartintrainingandgameforhisinjuryorillnessonbusinesswhichisnotrelatedtothiscontract,PartyAshallpayhimwageasnotlessthan50%sumwage,exceptofsucharisingoutofbreakinglaw,violatingdisciplineandsocialmoralityorotherfaultact.
10、本合同终止或合同解除，甲方不再向乙方支付工资。
UponterminationorexpirationofthiscontractPartyAnolongerpaywagetoPartyB.
11、乙方被调整至预备队期间，不再享受上述上述标准，只享受预备队的工资奖金待遇。
PartyB,duringbeingadjustedtoreserveteam,shallnolongerenjoywagestandardhereabove,onlyenjoytreatmentofwageandbanusofreserveteam.
12、甲方发放工资的日期为每月日，实行先工作后付薪制度。
Paydayisthedayofeachmonth,paymentfollowworking.
13、比赛奖金发放的时期为每场比赛或每一奖励周期结束后天之内。
GamebanusispaidtoPartyBwinthindaysaftereachgameoraperiodofencouragement.
第八条福利待遇CLAUSEVIIIWELFARE
1、甲方每赛季为乙方提供次往返探亲交通费，实报实销或按次估发。
PartyAshallprovidePartyBwiththeroundtripfeesofhome-trafficfortimeseachseasonbyreimbursementonactualexpenses.
2、甲方规定的其他福利待遇。
OtherwelfaresstipulatedbyPartyA.
3、中华人民共和国法定的其他福利待遇。
OtherstatutarywelfaresstipulatedbygovernmentofPeople’sRepublicofChina.
第九条义务和纪律CLAUSEIXLIABILITY&DISIPLINE
1、乙方必须履行下列义务：
PartyBshouldperformliabilityanddutyherebelow:
（1）遵守中华人民共和国各项法律、法规；
AbidebyvariouslawsandrulesofPeople’sRepublicofChina.
（2）遵守国际足联、中国足球协会、中超委员会、中超联赛的章程、规程及个各项规定；
Abidebyvariousconstitution,regulationandprescriptionofFIFA,CFA,CSLCandsuperleague.
（3）遵守甲方的各项规章制度，服从甲方管理；
AbidebyvariousbylawandobeymanagementofPartyA.
（4）遵守职业道德，发扬体育精神，维护公平竞赛原则，维护甲方的形象和声誉；
Complywithprofessional,carryforwardsportspirit,stickupforprincipleoffaircontest,maintainPartyA’sgoodfameandhonour.
（5）保持身体健康和良好的竞技状态，最大限度地发挥体能和技能水平；
Keepastronghealthybodyandwellathleticscondition,farthestexertbodyabilityandskilllevel.
（6）参加甲方安排的所有训练、比赛和相关活动，努力完成规定的调练、比赛任务；
