Preamble
Thisdocumentiscomprisedofthefollowing:
a)TermsandConditions;
b)Appendices;
ThiscontracttakesprecedenceoveranyinconsistentprovisioninpreviouslyagreeddocumentsregulatingthetermsandconditionsofemploymentofNon-ConsultantHospitalDoctors.Wherethereisanyconflictbetweenanyprovisionofthecontractdocumentandanypriorinstrument,theprovisioninthiscontractdocumentshouldprevail.
Forthepurposesofthiscontract,thetermNon-ConsultantHospitalDoctor(NCHD)referstopersonsemployedinthepublichealthserviceinIrelandasInterns,SeniorHouseOfficers,Registrars,SeniorRegistrars,SpecialistRegistrarsorotherwiseforthepurposeofprovidingmedicalordentalservicesand/orthepursuanceofmedicalordentaltrainingwhoforthepurposesofsuchemploymentarenotemployedasConsultants.
1.PurposeandCommencementDate
a)Thisisacontractofemploymentbetween____________(nameandaddressofEmployer)and_______________(nameandaddressofemployee)._____________(Nameofemployee)isappointedtothepostofa_________________(stategradeandspecialty)witheffectfromthe_______________(insertdate).TheContractis(deleteasappropriate):
i)forafixedterm/purposeasfollows:

Shouldthecontractbeforafixedterm,theUnfairDismissalsAct,1977–2001shallnotapplytotheNCHD’sdismissalconsistingonlyoftheexpiryofthecontractonthespecifieddate.TheNCHD’semploymentmaybeterminatedbynoticeinaccordancewiththeMinimumNoticeandTermsofEmploymentAct1973–2001:

ii)ofindefiniteduration.
b)Acandidateforandanypersonholdingtheofficemustbeinastateofhealthsuchaswouldindicateareasonableprospectofabilitytorenderregularandefficientservice.
c)Shouldthecontractbeforafixedterm/purposeitwillgenerallycommenceonthesecondMondayofJanuaryorthesecondMondayofJuly.Thisprovisionshallcomeintoeffectfrom1stJuly2010.
2.RegistrationStatusandDesignationofPost
a)OncetheNCHDhascommencedemployment,continuedemploymentinthispostiscontingenton(deleteasappropriate):
i)theNCHDbeingregisteredinaccordancewiththeMedicalPractitionersAct2007withtheRegisterofMedicalPractitionersmaintainedbytheMedicalCouncilofIrelandandmaintaininghis/herprofessionalcompetenceonanon-goingbasispursuanttoanyMedicalCouncilprofessionalcompetenceschemeapplicabletotheNCHDasamedicalpractitionerregisteredbytheMedicalCouncilofIreland;or
ii)inrelationtoapostdesignatedasaNon-TrainingPost,theNCHDbeingregisteredinaccordancewiththeMedicalPractitionersAct2007ontheGeneralDivisionoftheRegisterofMedicalPractitionersmaintainedbytheMedicalCouncilofIrelandmaintaininghis/herprofessionalcompetenceonanon-goingbasispursuanttoanyMedicalCouncilprofessionalcompetenceschemeapplicabletotheNCHDasamedicalpractitionerregisteredbytheMedicalCouncilofIreland;or
iii)inrelationtoapostdesignatedasaTrainingPost(includingInternposts),theNCHDbeingregisteredontheSpecialistTraineeDivisionoftheRegisterofMedicalPractitionersmaintainedbytheMedicalCouncilofIrelandandparticipatingasrequiredinaprogrammeofInterntrainingrecognisedbytheMedicalCouncilofIrelandorinaprogrammeofspecialisttrainingundertheauspicesofapostgraduatemedicaltrainingbodyrecognisedbytheMedicalCouncilofIreland.
3.ReportingRelationship
TheNCHD’sreportingrelationshipistotheEmployerviahis/hersupervisoryConsultantandClinicalDirector(ifsuchisinplace).TheNCHDmayberequiredtoreporttothedesignatedsupervisoryConsultant/ClinicalDirector/HeadofAcademicDepartmentonmattersrelatingtomedicaleducation,trainingandresearch.TheNCHDwillreportdirectlytotheEmployerasrequired.
4.LocationandResidence
a)TheNCHD’sappointmentshallbeto_______________(nameofHSEarea/HSEfundedHospital/Agency).TheNCHD’semploymentlocation(s)is_____________.
b)TheNCHD’semploymentlocationmaybechangedwithinthefunctionalareaandservicerangeapplicabletohis/herEmployer.DueconsiderationwillbegiventotheregistrationstatusoftheNCHDwiththeMedicalCouncilofIrelandshouldachangeinlocationberequired.
c)Incircumstanceswhereachangeoflocationisrequired,(e.g.-hospitalclosuresormajorchangestakingplaceinthecharacteroftheworkbeingcarriedoutthere)theNCHDwillbeofferedanalternativeappointmentinanappropriatediscipline.Inthefirstinstancethiswillbewithinthe(HospitalNetworkArea/HSEfundedHospital/Agency).TheNCHDshallbeconsultedshould(s)heberequiredtochangetoanemploymentlocationoutsidethe(HospitalNetworkArea/HSE-fundedHospital/Agency).SubjecttotheprovisionsoftheremovalexpensesschemefortheHealthServiceExecutive,removalexpensesshallbepayable,ifclaimed.
5.HoursofWork
a)TheNCHDiscontractedtoundertakesuchduties/providesuchservicesasaresetoutinthisContractinthemannerspecifiedfor39hoursperweek.The39hoursareasdeterminedbytherosterandincludeapaidlunchbreak.
b)TheNCHDisrequiredtodeliverthesehoursonany5daysoutofthe7inaweekasdeterminedbytheEmployer.
c)Fortheavoidanceofdoubt,theprovisionsofSection5a)andb)abovearesubjecttoamendmentinaccordancewithClause2.3oftheagreementmadebetweentheHealthServiceExecutiveandtheIrishMedicalOrganisationonthe22nddayofJanuary2010.
d)WhenrosteredtoattendonanydayMondaytoFriday,theNCHDmustworkaminimumshiftof6hours.WhenrosteredtoattendonSaturdayorSunday,theNCHDmustworkaminimumshiftof5hours.
e)TheNCHDshallnotberequiredtoworkformorethan24consecutivehourson-site.
f)TheEmployerwillensurethattheNCHDisrosteredtoworkon-siteforaperiodof24hoursonnomorethana1in5basisotherthaninexceptionalcircumstances.
g)Rostersmustprovideforahandoverperiodbetweeneachshift.Handoverperiodsmustbeofatleast30minutesinduration.
h)TheNCHDmaynotberosteredtoworkasplitshift.
i)TheNCHDmayberequiredto:
i)provideovertimeservices(on-callon-siteservices)on-siteinadditiontothe39hours.
ii)provideon-calloff-siteservicesoutsidecoreand/orovertimehoursasdeterminedbytheClinicalDirector/Employer;
iii)workbeyondhis/herrosteredperiodinlinewiththeexigenciesoftheservice.TheEmployerwillendeavourtoensurethatthiswillbeanexceptionalratherthanastandardrequirement.
j)Aminimumnoticeperiodof2weekswillapplyforprovisionofinitialrosters.
k)TheNCHDshallnotberequiredtoattendon-siteonarostereddayoff(includingleave)outsidethe2weekminimumnoticeperiodwheretherequirementforsuchattendancecanbereasonablyanticipatedbytheemployer.
l)Aminimumnoticeperiodwillapplyforchangestopublishedrosterstakingaccountoftheneedforshorternoticetorespondtoclinicalneedonanunplannedbasis,
m)WheretheNCHDisprovidedwithmorethanonerostereddayoffduringaweek,theEmployershouldendeavourtoensuresuchdaysareconsecutive.
n)TheNCHDshallcomplywithsuchagreedarrangementsasareputintoplacebytheEmployerformeasurableandtransparentsystemsofcontinuouslymonitoringadherencetoworkingtimelegislation.
m)WorkoutsidetheconfinesofthiscontractisnotpermissibleifthecombinedworkingtimeassociatedwiththisemploymenttakentogetherwithanyotheremploymentexceedsthemaximumweeklyworkinghoursassetoutinS.I.No.494of2004EuropeanCommunities(OrganisationofWorkingTime)(ActivitiesofDoctorsinTraining)Regulations2004.
6.StandardDutiesandResponsibilities
a)TheNCHD’sstandarddutiesandresponsibilitiesinclude,asdirectedbytheConsultant/ClinicalDirector/Employerto,interalia:
i)participateasamemberofamulti-disciplinaryteamintheprovisionofmedicalcaretopatients;
ii)diagnoseandtreatpatients;
iii)ensurethatdutiesandfunctionsareundertakeninamannerthatprioritisesthesafetyandwellbeingofpatients;
iv)assesspatientsonadmissionand/ordischargeasrequiredandwritedetailedreportsinthecasenotes;
v)orderandinterpretdiagnostictests;
vi)initiateandmonitortreatment;
vii)communicateeffectivelywithpatientsandclients;
viii)furtherprogressknowledgeofdiagnosisandmanagement;
ix)participateinmultidisciplinaryclinicalauditandproactiveriskmanagementandfacilitateproductionofalldata/informationforsame;
x)co-operatewit
