Introduction

In2011ACONpublishedaGAPanalysisofNSWdomesticviolencesupportservicesinrelationtogay,lesbian,bisexual,transgenderandintersex(GLBTI)communitiesinNSW.OneofthekeyfindingsofthereportwasthatthereisasignificantvariationintheservicesprovidedregardingtheircompetenceandconfidenceinworkingwithGLBTIcommunitymembersandunderstandingtheirspecificneeds,whilesomeserviceproviderslackedbasicawareness.

OneofthemainthemesemergingfromtheACONsurveywasthatthatsomeserviceprovidersadoptedanon-discriminatoryapproachthatfrequentlyresultedinajustificationfornotseekingtoidentifygender,sexorsexualityofthosepeopleseekingsupport.Alsomanyservicesappearedtolackanunderstandingofthedifferencebetweensexandsexualityparticularlyinrelationtointersexandtransgenderpeople.

Whenfacedwithinadequateorinappropriateserviceprovisions,itisimportantthatmembersoftheGLBTIQcommunityknowwhatcanbedoneaboutitincludinghowtousetheAnti-DiscriminationAct1977(NSW)andseekredresswhenthereisdiscriminationinthedeliveryofservicesinthedomesticviolencecontext.

Orwhenyouareavictimofdomesticviolencethiscanhaveadramaticimpactonyouremployment.Ifyouthinkaboutityoumayneedtotakesometimeoffbecauseattheveryleastyouwillbeunderagreatdealofstress,youmayhaveaninjuryasaresultofdomesticviolenceorhaveanappointmentwiththepoliceacounselloracourtdate;HowisyouremployergoingtotreatyouifyouareamemberoftheLGBTIQcommunity.Willyoubetreatedlessfavourablythanastraightemployeeinthesameorsimilarcircumstances?

AtthisFirstNationalLGBTIQdomesticViolenceConferenceIwantedtotalktoyouabouthowtheAntiDiscriminationAct1977worksinthecontextofLGBTIQcommunityanddomesticviolence;includingdiscussingthegroundsofdiscriminationandtheareasoflifeinwhichthelawappliesandthemostappropriatewayinwhichtheAnti-DiscriminationAct1977andtheAnti-DiscriminationBoardcanhelpyou.Iwillthentalkaboutthenumbersofcomplaintswereceivedinourlastfinancialyear2009-2010andhowIbelievethatthesestatisticsdonotnecessarilyreflectwhatisreallyhappening.FinallyIwilltalkabouttheotherwaysinwhichtheAnti-DiscriminationBoardworkswiththeLGBTIQcommunitytoaddressdiscriminationinallareasoflife.

TheAnti-DiscriminationAct–GroundsandAreasAppropriateforDomesticViolence

IfapersonintheGLBTIQcommunitysuffersfromdomesticviolenceandneedstoaccessvitalservicessuchasmedicalsupportthroughhospitalsormedicalcentres,orprotectionfromthepolice,oraccesstotheadministrationservicesofcourtsorseekslegaladvice,theyareentitledtoexpectandreceivethesameappropriatetreatmentasanyoneelseinthecommunity.

Ifthereisdomesticviolenceathomeandtheonlyoptionistoleaveimmediatelywiththeclothesonyourback,no-wheretoliveandverylimitedresources,membersoftheLGBTIQcommunityneedtobeabletoaccessarefuge,asafehavenawayfromtheviolence,orthethreatofviolence,orifthepolicearecalledforhelpandassistance,youneedtoknowthatyouwillbetreatedwithrespect,takenseriously,thatthestandarddiscriminatorystereo-typingisnotappliedinyourcircumstances.

YouwanttoknowthatmembersoftheLGBTIQcommunitywillbetreatedwithcredibilityandgiventhesamedomesticviolencereferralstosupportservicesinthesamewayanyoneinthecommunitywouldbe.ThatthedutysolicitorwillattendtoyourapplicationforaninterimApprehendedViolenceOrderandyouwillbetreatedasseriouslyassomeonewhoisnotmemberoftheLGBTIQcommunity.

HowcanNSWAnti-discriminationLawHelp

Iffrontlineorsupportservicesarediscriminatoryintheprovisionofthegoodsorservice,thereareprovisionsinNSWlawforyoutomakeacomplaintonthebasisofdiscrimination.AnditiscriticalforpeopleintheLGBTIQcommunitythatsufferfromthistypeofdiscriminationtaketheappropriateaction,asitmakestheorganisation,institute,oremployeraddressdiscriminationmoreeffectively,asthereisnothingmorethreateningtosomeemployersasthethreatoflegalactionandnegativepublicitycancauseverynegativeimpactsonthebusiness.Thinkaboutthecasesyouhaveheardaboutinthemedia.
