租 赁合同

LEASEAGREEMENT

本租赁合同由下述双方于   年   月  日于中华人民共和国北京市签订:

Thisleaseagreement,datedthe[   ]dayof          ,2007,SignedinBeijing,People’sRepublicofChinabythefollowingparties.

一、   出租人:

甲方为光华路SOHO【  】单元（以下简称“房屋”）合法拥有者，建筑面积为【  】平方米，甲方同意将房屋及内部设施在良好状态下租给乙方,只可作为办公用途。

四、   租赁期:

4.2             租期届满,甲方有权收回全部房屋，乙方应在租期届满日或之前，以甲方交付时状态或双方共同认可的状态将房屋完好交还甲方。

Uponexpiryofthislease,PartyAhastherighttotakebacktheentirePremises,andPartyBshallreturnthePremisesonorpriortothedateofexpiryinthesameconditionasitisdeliveredortheotherconditionthepartiesagreetoPartyBbyPartyA. 

4.3             租期届满,乙方如要求续租,应在本合同期限届满前两个月提出书面申请，取得甲方同意后，甲、乙双方须另行签署租赁协议。

    IfPartyBwishestorenewthelease,partyBshallsubmitawrittenapplicationtoPartyAtwomonthspriortotheexpiryofthislease,andaleaseagreementshallbeconcludedbetweenthepartiesseparatelysubjecttoPartyA’sconsent.

五、  免租期（含装修期）:

乙方在免租期内免付租金。

六、   租金和其它费用:

6.1租金：

电话号码由乙方自行申请，电话费按电信局的收费标准,每月按实际通话次数/时间结算，乙方按单缴付。

ThetelephonenumbershallbeappliedbyPartyBandthecallchargeshallbepaidinaccordancewiththerateofthetelecommunicationauthority. PartyBshallpaythecallchargeactuallyincurredeachmonth.

6.3其它费用:

  Othercharges:

在租赁期内,乙方承租单元所用的电由大厦的物业管理机构每月按实际耗用量结算,乙方按单缴付。

免租期内承租单元所用的电费由乙方支付。

Duringtheleaseterm,theelectricityconsumedinthePremisesshallbepaidbyPartyBtotheManagementDepartmentinaccordancewiththeactualconsumptionappearedonthebilloftheManagementDepartment.PartyBshallpayfortheelectricityconsumedinthePremisesduringtheGracePeriod

七、支付方式:

Payment:

7.1     租金应按      预付,免租期届满后,乙方于应付款月的第【  】号前向甲方支付下期租金。

八、币种和帐户:

CurrencyandAccount:

乙方应按甲方指定的帐户支付本合同项下所有的到期款项，所有付款以人民币计算,以人民币支付。

PartyBshallpaytherentandallotheramountsdueandpayableinRMBto theaccountdesignatedbyPartyA.

九、保证金:

Deposit:

9.1自本合同签订之日起    日内，乙方应向甲方缴付相当于【 】个月的租金计人民币【  】元作为保证金及首期租金人民币【   】元，共计人民币【     】元。

9.2本合同期满，如本合同不续租，甲方应在期满后三十（30）天内返还保证金（不计利息）。

如乙方因违约而导致违约金、赔偿金、费用和/或乙方尚未支付任何应付款项，甲方可从保证金中扣除此类违约金、赔偿金、费用和/或未付款项。

UponexpirationoftheLeaseAgreement,iftheLeaseAgreementisnottoberenewed,PartyAshallrefundthedepositwithoutinteresttoPartyBwithinthirty（30）daysaftertheexpirationofthisLeaseAgreement. IfthereisanydefaultpenaltyorcompensationorexpensesincurredduetothebreachofPartyBand/oranydueamountthatPartyBfailstopay,PartyAmaydeductsuchdefaultpenaltyorcompensationorexpensesordueamountfromthedeposit.

9.3在本合同期限内，如有任何应由乙方支付的违约金、赔偿金、费用和/或其他应付款项，甲方可直接从保证金中予以扣除，乙方应在接到甲方书面通知后五（5）天内补足该部分保证金。

Duringtheleaseterm,ifthereisanydefaultpenalty,compensationorexpenseand/oranyotherdueamountthatshallbepaidbyPartyB,PartyAmaydeductsuchamountfromthedepositandPartyBshall,withinfive（5）daysafterPartyAsonotifies.
