1目的和主题内容
为了指导律师授权发表声明，制订本标准。
本标准规定了律师授权声明的特点、发表程序、授权声明书的制作、应注意的问题及工作草稿等。
1objectivesandthemestoguidethecontentofauthorizedlawyersissuedastatement,theformulationoftheCode.regulatetheprovisionsofthecharacteristicsoflawyersauthorizedstatement,publishedprocedures,authorizedthedeclarationofproduction,shouldpayattentiontotheproblemsandworkingpapers,andsoon.
2适用范围
本标准适用于本所全部律师。
以下人员应知晓本标准：

3术语
律师授权发表声明：
是指在民事活动中，律师依照当事人的授权，就有关当事人利益的法律事实，公布声明其立场或主张其权利的单方式律行为。
律师授权声明的对象是针对社会公共，不是针对特定的哪个单位或个人。
声明不管采取何种方式，都是为了声明当事人对某一行为或事件的主张，明确某项权利或义务，使当事人的合权益不受或少受侵害。
因此，授权声明必需公布，只有为社会公共所知，才能起到宣传和警告作用。

referstothecivilactivities,lawyersunderthemandateoftheparties,thepartiesconcernedintheinterestsofthelegalfacts,thepublicstatementoftheirpositionorthatitslegalrighttounilateralacts.Lawyersauthorizedstatementwastargetedagainstthecommunity,isnottargetedatanyspecificunitorindividual.Nomatterwhatformthestatement,thepartiesaretothestatementofanactoreventcallsforaclearrightorobligation,sothattheinterestsofthepartiesorlessarenotsubjecttoabuse.Therefore,theauthorizationstatementmustbeopen,onlyforthecommunityknow,canplayaroleinpublicityandcaution.
4职责
本标准的编制和修订由本所标准化委员会提出，经合股人会议批准后，由主任公布。

6律师授权声明的特点
（1）授权人必需具有主体资格。
具体要求：
1）授权人具有承担民事责任的能力；
2）发表声明的内容必需与授权人的职务、身份和经营范围等权利能力和行为能力相适应。
（2）声明的内容必需真实靠得住。
（3）声明的内容必需合乎法律标准、公共利益和社会公德。
（4）声明必需公布。

（1）authorizedpersonmustbethemainqualification.Specificrequirements:
1）toempowerpeoplewiththeabilitytobearcivilliability,2）issuedastatementtothecontentofthedutiesandauthority,identityandbusinessscopeoftherightabilitiesandcapacitiesofadaptation.
（2）thecontentofthestatementmustbetrueandreliable.（3）the
contentofthestatementmustbeinlinewithlegalnorms,thepublicinterestandpublicmorality.（4）Thedeclarationmustbeopen.
7律师授权声明的程序
（1）同意委托。
律师在同意委托前，应初步审查声明的各类证据材料，确认其内容真实靠得住、合法以后，才能依照TY/《收案方法》的规定，办理委托手续。
当事人应按规定交纳费用。
（2）制作声明书。
律师同意委托后，应付当事人提供的证据材料进一步审查核实，在事实清楚、证据充分的基础上，审查内容是不是合法，是不是规避法律。
如承办律师经调查发觉，当事人提供的证据材料虚假，提出的内容违法，应依照TY/《收案方法》的规定撤销委托，并向当事人说明理由。
（3）声明书制成后，应经至少两名以上合股人审阅并签署“同意”意见，方可交由报社、杂志社、电台、电视台公布发表。
7lawyersauthorizedastatementofprocedures
（1）acceptthecommission.Lawyersinthecommission,shouldpreliminaryreviewofthestatementofevidence,confirmeditscontentsreliable,legitimate,accordingtoTY/"atthemethods",commissionedbythehandlingprocedures.Thepartiesshouldbeprovidedtopaycosts.
（2）Productionstatement.Lawyersacceptthecommission,thepartiesshouldprovideevidenceofafurtherreviewtoverifythefactsareclear,onthebasisofsufficientevidence,reviewthelegalityofthecontent,whetherornottocircumventthelaw.IfthecontractorbytheLawSocietysurveyfoundthatthepartiestoprovidefalseevidenceofmaterial,thecontentisillegal,shouldbein
accordancewithTY/"atthemethods"toeliminatethecommissionandthepartieswiththereasons.（3）afterthestatementmade,itshallbeatleasttwomorepartnersreviewedandsignedthe"consent",onlybythenewspaper,magazine,radioandtelevisionstationsopenlypublished.
8律师授权声明书的制作
首部：
包括题目和当事人的身份事项。
（1）题目。
有两种写法：
直接由授权人发表声明的，应当写明“律师授权声明书”；担任法律顾问的律师发表声明的，题目应当由顾问单位名称、律师事务所名称、文书名称三部份组成。
（2）当事人的身份情形。
应当写明授权人、被授权人的大体情形。
正文：
当事人发表声明要紧有两种情形：
（1）为了保护当事人的某项产品、某个商标、某种效劳项目等在公众中的信誉，指出社会上的伪造、冒充和其他有损当事人声誉的不良现象，以警戒违法行为，提高公众对真与假的识别能力。
该种情形下，律师授权声明书应当写明以下三个方面的内容：
1）写明某项产品的品种、质量、功能等，或某商标在国内外的信誉；
2）写明社会上伪造产品、冒充商标的情形；
3）要求公众提高识别能力并揭发、揭发伪造、冒充的单位和个人，以便提请有关单位追究其法律责任。
（2）基于当事人单位及其下属单位的分离、归并、撤销、破产等情形，当事人需要停业整顿、清理债务。
该种情形下，授权委托书应当写明：
1）当事人当前的处境情形；
2）宣布当事人单位或下属单位暂停（或停止）一切经济活动。
尾部：
写明授权、被授权发表声明人所在地址、等，以便社会有关单位、个人联系。
8lawyerauthorizetheproductionoftheStatementoftheMinistryofinclude:
thetitleandtheidentityofthepartymatters.
（1）title.Therearetwoway:
directlybytheauthorizedpersoninastatement,itshouldbestated,"lawyerauthorizedstatement"astheLegalAdviseroftheLawSocietyissuedastatement,thetitleshouldbethenamebytheconsultants,lawfirmname,titleinstrumentconsistsofthreeparts.
（2）theidentityofthepartysituation.Itshouldbewrittenauthorization,authorizedthebasicsituation.
Text:
Statementbythemajorpartieshavetwosituations:
（1）Inordertosafeguardthepartiesforcertainproducts,atrademark,aserviceprojectinpublicinthecredibility,pointingoutthatthecommunityofforgery,counterfeitingandotherprejudicialtothepartiesThebadreputation,inordertoalerttheoffenceisenhancingpublicawarenessofthetrueandfalserecognition.Thekindsofcases,lawyersshouldbeauthorizeddeclarationstatedthefollowingthreeaspects:
1）specifyaproductofthevariety,quality,function,oratrademark'sreputationathomeandabroad,2）statedthecommunitycounterfeitproducts,counterfeittrademarks;3）requirepublicreportingandimprovetheabilitytoidentify,exposeforgery,Afakeunitsandindividualstotheattentionoftheunitsheldtheirlegalobligations.
（2）thepartiesbasedontheunitanditssubordinateunitsfromthemerger,revocation,suchasbankruptcycases,thepartiesneedtostraightenouttheclosure,cleanupdebt.Thekindsofcases,themandateshouldbewrittenpowerofattorney:
1）thepartiesinthecurrentsituation,2）thatthepartiessuspendedtheirsubordinateunitsorunits（orsuspended）alleconomicactivities.tail:
stateauthority,isauthorizedtomakeastatementislocatedaddress,telephonenumber,inordertotherelevantunitsofsocial,personalcontact.
9律师授权声明应注意的问题
律师授权发表声明属于非诉讼的民事代理行为。
当事人之因此不亲自发表声明，而是授权律师代理自己发表声明，一是为了让律师对声明的合法性和可行性进行审查把关；二是利用律师的身份给社会造成阻碍。
因此，律师在同意委托时应当注意：
（1）必需有当事人的授权。
律师只能在授权范围内以当事人的名义发表声明，当事人应付发表声明所产生的后果承担责任，并交纳因发表声明而支出的各类费用。
（2）律师授权发表声明必需具有法律意义，能够引发民事权利义务关系的转变。
（3）律师在授权发表声明时，还应考虑声明的内容是不是与当事人的人身有关，若是属于《民法通那么》第63条第3款的内容，就应当由当事人自己发表声明，律师不得代理其声明。
（4）律师在发表声明时，应严格审查声明内容，审查当事人提供的各类证据材料，以便有效地达到目的。
9authorizedlawyersshouldpayattentiontotheissueofthestatementauthorizedlawyersissuedastatementofnon-agentsofthecivillitigation.Thereasonwhythepartiesdonotpersonallyissuedastatement,buthisagentauthorizedlawyersissuedastatement,First,toallowlawyerstothestatement'slegitimacyandfeasibilityofscreeningandtheotherisusingthelawyerastothesocialimplications.Therefore,lawyersinthecommissionshouldpayattentionto:
（1）thepartiesmusthavethemandate.Lawyersonlytotheextentauthorizedbythepartiesissuedastatementonbehalfofthepartiestoastatementbytheconsequencesofresponsibilityandpayforastatementofallcostsandexpenses.
（2）empowerstheLawSocietyissuedastatementmusthavelegalsignificancetocivilrightsandobligationsarisingfromthechanges.（3）authorizedlawyersinastatement,thestatementshouldalsoconsiderwhetherthecontentsofthephysicalandthepartiesconcerned,ifthe"GeneralPrinciplesofCivilLaw"Article63,paragraph3,ofthecontent,theyshouldmakeastatementbythepartiesthemselves,theirlawyersnottoActingStatement.
（4）lawyersissuedastatement,thestatementshouldbestrictlyreview,reviewofthevariouspartiestoprovideevidence,inordertoeffectivelyachieveitsobjective
10工作草稿
律师在同意委托、制作声明书时，应制作工作草稿。
律师应及时、准确、真实地制作工作草稿，工作草稿的质量是判定律师是不是勤勉尽责的重要依据。
工作草稿由承办律师依照TY/《律师业务档案立卷归档方法》的规定立卷归档。

（范例）
X制药是国家XX治理局惟一批准生产XX药品的生产厂家。
XX药品研制生产以来，X制药从未授权、委托其他厂家生产该种药品。
近来，药品市场上显现了其他厂家生产的XX药品，其中有些还标有“X制药授权”字样，纯属冒充；其作法不仅侵犯了X制药的合法权益，而且侵害了广大患者的利益，也扰乱了药品市场的秩序。
为此，本律师授权发表声明：
凡有上述非法行为的厂家，必需当即停止生产、销售XX药品，当即停止对X制药的侵权行为并对此前生产、销售XX药品所发生的一切不良后果承担全数责任。
对此前，尤其是尔后将随时依据国家的有关法律、法规，代表X制药追究其经济责任和法律责任。
