TheRegulationsofShanghaiMunicipalityonPopulationandFamilyPlanning,adoptedatthe9thSessionoftheStandingCommitteeoftheTwelfthShanghaiMunicipalPeople’sCongressonDecember31,2003,isherebypromulgatedandshallgointoeffectiveasofApril15,2004.

Article1TheseRegulationsareenacted,inaccordancewithPopulationandFamilyPlanningLawofthePeople’sRepublicofChinaandinlightoftheactualcircumstancesoftheMunicipality,withtheaimsofbringingaboutanoverall,coordinatedandsustainabledevelopmentbetweenpopulation,economy,society,resourcesandenvironment,promotingfamilyplanning,protectinglegalrightsandinterestsofcitizens,andenhancingwelfareoffamilies,prosperityofthenationanddevelopmentofsociety.

Article2TheseRegulationsapplytothepopulationandfamilyplanningprogramswithintheMunicipality’sadministrativearea.

AdministrationoffamilyplanningprogramsforfloatingpopulationshallobserverelevantstipulationsoftheStateandtheMunicipality.

Article3Thepeople’sgovernmentsatalllevelsshallstrengthenmanagementofpopulationandfamilyplanningprograms,andtakecomprehensivemeasurestocontrolthesize,raisethequality,improvethestructureandpromoterationaldistributionofpopulation.

Thepeople’sgovernmentsatalllevelsshallenhancepublicityandeducation,takeadvantageofscientificandtechnologicalprogress,improveall-roundservices,andsetupandperfectrewardandsocialsecuritysystem,toinsuresatisfactorypopulationandfamilyplanningadministration.

Article4Populationandfamilyplanningadministrativedepartmentatthemunicipallevel,byitsstatutoryduty,isinchargeofpopulationandfamilyplanningprogramswithintheMunicipality’sadministrativearea.Populationandfamilyplanningadministrativedepartmentsatdistrictandcountylevel,bytheirrespectivestatutoryduty,areinchargeofthepopulationandfamilyplanningprogramswithintheirrespectiveadministrativeareas.

Publicadministrativedepartmentsofdevelopmentandreform,publicsecurity,laborandsocialsecurity,publichealth,civilaffairs,statistics,andeducation,areinchargeofrelevantpopulationandfamilyplanningadministrationwithinthelimitsoftheirrespectivefunctionsandduties.

People’sgovernmentsoftownshipsandtownsandsub-districtofficesareinchargeoftheadministrationofpopulationandfamilyplanningprogramswithintheirrespectiveadministrativeareas.

Article5PublicorganizationsincludingTradeUnions,CommunistYouthLeagues,Women’sFederations,FamilyPlanningAssociations,PopulationAssociationsandsuch,andenterprises,institutions,privately-runnon-enterpriseunits,andcitizensshallassistthepeople’sgovernmentsincarryingoutpopulationandfamilyplanningprograms.

Neighborhoodcommitteesandvillagers’committeesshallassistthepeople’sgovernmentsincarryingoutpopulationandfamilyplanningprogramsandshallbestaffedwithappropriatefull-timeorpart-timepersonnel.

Article6People’sgovernmentsatalllevelsshalllistthefundingforpopulationandfamilyplanningprogramsintofiscalbudgets,ensureadequatefundforpopulationandfamilyplanningprograms.Fundingforpopulationandfamilyplanningprogramsshouldbeincreasedgraduallyalongwithnationaleconomicandsocialdevelopment.

Article7PopulationandfamilyplanningprogramsshallbeintegratedintotheMunicipality’ssocialisticspiritualcultureconstructionasanimportantpart.

Article8People’sgovernmentsatalllevelsshallcommendandrewardorganizationsorindividualsthathavemadeoutstandingachievementsinandcontributionstopopulationandfamilyplanningprograms.

Governmentdepartments,publicorganizations,enterprises,institutions,privately-runnon-enterpriseunitsshallcommendandrewardindividualsintheirorganizationswhohavemadeoutstandingachievementsinandcontributionstopopulationandfamilyplanningprograms.

ChapterIIComprehensiveManagementofPopulation

Article9People’sgovernmentsatmunicipal,districtandcountylevelsshall,inaccordancewiththepopulationdevelopmentplansmadebythepeople’sgovernmentsatthenexthigherlevelandinlightoftheactualcircumstancesintheirownadministrativeareas,drawupmediumandlong-termplansandannualplansforpopulationdevelopment,andincorporatethemintothenationaleconomicandsocialdevelopmentplans.

Article10Administrativedepartmentsofpopulationandfamilyplanning,statisticsandsuchareinchargeofconductingmediumandlong-termprojectionsofpopulationtrends,includingpopulationsize,birth,death,structureandmigration,asabasisfordevelopingpopulationplansandmakingdecisionsoncomprehensivepopulationmanagement.

Article11People’sgovernmentsatmunicipal,districtandcountylevelsshall,inaccordancewiththemediumandlong-termplansforpopulationdevelopment,developimplementationplansforpopulationandfamilyplanningprogramswithintheirrespectiveadministrativeareasandmakearrangementsfortheimplementation.

Administrativedepartmentsofpopulationandfamilyplanningatmunicipal,districtandcountylevelsareresponsibleforimplementationofdailytasksinpopulationandfamilyplanningplans.

People’sgovernmentsattownshipandtownlevelandsub-districtofficesareresponsibleforfulfillmentofthepopulationandfamilyplanningimplementationplans.

Article12TheMunicipalpeople’sgovernmentassignstheannualtargetsanddutiesforpopulationandfamilyplanningprogramstothedistrictandcountypeople’sgovernments,assessesandevaluatestheirimplementation,andgivesrewardsorsanctionsaccordingly.Thedistrictandcountypeople’sgovernmentsassigntheannualtargetsanddutiesforthepopulationandfamilyplanningprogramstopeople’sgovernmentsattownshipandtownlevelandsub-districtoffices,assessandevaluatetheirimplementationandgiverewardsorsanctionsaccordingly.

Thepeople’sgovernmentsatalllevelsandsub-districtofficesshallfulfillrelevantdutiesandachievetheannualtargetsforthepopulationandfamilyplanningprograms.

Article13Forthosewhosehouseholdregistrationplacesareinconsistentwiththeirpresentresidences,people’sgovernmentsofbothplacesareresponsibleforfamilyplanningadministrationofthem,withthepeople’sgovernmentsatthepresentresidencestakingmajorresponsibility.

Article14TheMunicipalpeople’sgovernmentshallmakeplansforthesizeofpopulationdevelopment,regulateandcontrolthetotalamountoftheresidentpopulationbasedonthelevelofeconomicandsocialdevelopmentandthebearingcapacityoftheresourcesandenvironment.

People’sgovernmentsatmunicipal,districtandcountylevelsshallperfectthereproductiveregulationpolicies,maintainalowfertilitylevel,establishtheregulationandcontrolmechanismofflowing-in-and-outofresidentpopulation,andrationallycontrolthemechanicalgrowthofpopulation.

Article15People’sgovernmentsatmunicipal,districtandcountylevelsshallcontrolpopulationsizeinthecentralareasoftheMunicipalityandpromoterationaldistributionofurbanandruralpopulationwhilemakingandimplementingurbanplanning.

Specializedplanningonindustry,housing,transportation,scienceandtechnology,education,culture,publichealth,andlaborandsocialsecurity,developedandimplementedbyrelevantadministrativedepartments,shallbeinaccordancewithregionalpopulationdevelopmentprograms.

Article16RegulationsandmeasuresformulatedandimplementedbytheMunicipalityonreproduction,migrationandflowing-in-and-outofpopulationshallbeconducivetotheoptimizationofagestructureandalleviationofpopulationageing.

Article17Administrativedepartmentsofpublichealthatalllevelsshallimprovematernalandchildhealthcareservices,decreaseinfantmortalityrate,reduceincidenceofbirthdefects,andenhancehealthofthenewborns.

TheMunicipalityadvocatesthatcitizensundergopremaritalandmaternalmedicalexaminations.TheMunicipalpeople’sgovernmentshallformulaterulesconducivetovoluntarypremaritalandmaternalmedicalexaminationsamongcitizens.

Medicalandhealthcareinstitutionsshallprovidestandardandqualityservicesforclientsinpremaritalandmaternalmedicalexaminationsandkeepconfidentialityforthem.Medicaldoctorsandmidwivesshallstrictlyobserverelevantoperationalproceduresandpreventandreducebirthinjury.

Article18Administrativedepartmentsofpopulationandfamilyplanning,publichealth,education,cultureradiofilmandTV,pressandpublication,civilaffairs,andpublicorganizationsshallcooperatewitheachotherinconductingeducationandprogramsonreproductivehealth,advocatinghealthylifestyles,enhancingself-healthcareawareness,andstrivingforpreventionandtreatmentofAIDSandotherdiseasesthataffectreproductivehealth.
