OrdinanceonAdministrationofUndergroundUtilityTunnelofZhuhaiSpecialEconomicZone

第一章  总则

ChapterIGeneralProvisions

第一条 为了规范地下综合管廊（以下简称管廊）规划、建设和管理，保障地下管线的有序建设和安全运行，集约、节约利用土地和优化城市地下空间，根据有关法律、行政法规的基本原则，结合珠海经济特区实际，制定本条例。

Article1ThisOrdinanceisenactedinaccordancewithbasicprinciplesofrelevantlawsandadministrativeregulationsandinlightoftheactualconditionsofZhuhaiSpecialEconomicZone,withaviewtoregulatingtheplanning,constructionandmanagementofundergroundutilitytunnels（hereinafterreferredtoas“utilitytunnels”）,guaranteeingthewell-organizedconstructionandsafeoperationofundergroundpipelines,makingintensiveandeconomicuseoflandandoptimizingurbanundergroundspace.

第二条 本条例适用于本市行政区域内管廊的规划、建设、运营、维护和档案信息管理等活动。

本条例所称管廊，是指建于城市地下用于容纳两类及以上城市工程管线的构筑物及附属设施，包括干线管廊、支线管廊和缆线管廊。

Article2ThisOrdinanceshallbeapplicabletotheplanning,construction,operation,maintenanceandarchivesinformationmanagementofutilitytunnelswithintheadministrativedivisionofthismunicipality

TheutilitytunnelsasmentionedinthisOrdinancerefertostructuresandsubsidiaryfacilitiesconstructedunderthecityinordertoaccommodatetwoormorecategoriesofcityengineeringpipelines,includingmainutilitytunnels,branchutilitytunnelsandcableutilitytunnels.

第三条 管廊建设与管理坚持政府主导、规划先行、统筹建设、信息共享、安全运行、有偿使用的原则。

Article3Theconstructionandadministrationofutilitytunnelshallcomplywithprinciplesofgovernmentleading,planningfirst,integratedconstruction,informationsharing,safeoperation,andusewithcompensation.

第四条 市人民政府建立管廊工作领导协调机制，统筹协调管廊建设和管理工作。

各区人民政府、横琴新区和经济功能区管理机构负责本区域内管廊的建设和管理工作。

Article4TheMunicipalPeople’sGovernmentshallestablishutilitytunnelleadershipandcoordinationmechanismtobalanceandcoordinatetheconstructionandadministrationofutilitytunnels.

Districtpeople’sgovernmentsandadministrativeauthoritiesofHengqinNewAreaandeconomicfunctionalareasshallberesponsiblefortheconstructionandadministrationofutilitytunnelsinrespectiveadministrativearea.

第五条 市市政行政管理部门负责管廊的综合协调和监督管理工作,并组织实施本条例。

发改、规划、建设、国土、交通、公路、水务、城市管理行政执法等部门按照各自职责做好管廊的管理工作。

Article5Themunicipaladministrativedepartmentofcityaffairsshallberesponsibleforthecomprehensivecoordination,supervisionandadministrationofutilitytunnelsandshallorganizetheimplementationoftheOrdinance.

Departmentsofdevelopmentandreform,planning,construction,land,transport,road,water,administrativeenforcementofcityadministrationshall,inaccordancewiththeirresponsibilities,dowellintheadministrationofutilitytunnels.

第六条 城市新区、各类园区、成片开发区域的新建道路应当根据功能需求，规划以干线、支线管廊为主的管廊；老城区结合城市更新、道路改造、地下空间开发等要求，因地制宜、统筹规划以缆线管廊为主的管廊。

管廊建设按照管廊专项规划有序推进，并与道路建设同步进行。

Article6Newly-builtroadsinnewurbandistricts,variousparks,andvaststretchesofdevelopmentzonesshall,inaccordancewithfunctionrequirements,planforutilitytunnelsbasedonmainandbranchutilitytunnels;theoldurbandistrictsshall,inlightofrequirementsconcerningurbanrenewal,roadreconstructionandundergrounddevelopment,makeoverallplanningforutilitytunnelsbasedoncableutilitytunnelsaccordingtolocalconditions.

Theconstructionofutilitytunnelsshallbeimplementedorderlyaccordingtothespecializedutilitytunnelsplanningalongwiththeroadconstruction.

第七条 市、区人民政府，横琴新区和经济功能区管理机构加强对管廊建设资金的统筹，在年度预算和建设计划中安排管廊项目，并可以纳入地方政府采购范围。

鼓励社会资本投资建设和运营管理管廊，通过特许经营、投资补贴、贷款贴息等形式，推进政府和社会资本合作。

鼓励入廊管线产权单位、管理单位（以下称管线单位）参与管廊投资建设和运营管理。

Article7Themunicipalanddistrictpeople’sgovernmentsandadministrativeauthoritiesofHengqinNewAreaandeconomicfunctionalareasshallenhancetheoverallplanningofutilitytunnelconstructionfund,scheduleutilitytunnelprojectsintoannualbudgetandconstructionplan,andmayincorporatesuchprojectsintothelocalgovernmentprocurement.

Socialcapitalshallbeencouragedintheinvestment,construction,andoperationalmanagementofutilitytunnelsandthecooperationbetweengovernmentalandsocialcapitalshallbepromotedbyfranchise,investmentsubsidyanddiscountloanandotherwise.Thepropertyunitsandutilitypipelinemanagementunits（hereinafterreferredtoas“pipelineunits”）shallbeencouragedtoparticipateintheinvestment,construction,andoperationalmanagementofutilitytunnels.

第二章规划与建设

ChapterIIPlanningandConstruction

    第八条 管廊专项规划由市规划行政管理部门会同相关部门组织编制，报市人民政府批准实施。

编制管廊专项规划时，编制单位应当征询管线单位的意见。

Article8Thespecializedutilitytunnelplanningshallbeorganizedandformulatedbythemunicipalplanningadministrativedepartmentincollaborationwithrelevantdepartments,andbereportedtotheMunicipalPeople’sGovernmentforapproval.

Theunitsconcernedshall,informulationofspecializedutilitytunnelplanning,takeadvicefrompipelineunits.

第九条 管廊专项规划应当符合城市总体规划，与地下空间开发利用、各类地下管线、道路交通等专项规划相衔接，并纳入控制性详细规划。

管廊专项规划按照因地制宜、远近兼顾、分步实施的要求，确定管廊的建设布局、管线种类、断面形式、平面位置、竖向控制等，并明确建设规模和时序。

Article9Thespecializedutilitytunnelplanningshallcomplywiththeoverallurbanplanning,beconnectedwithspecializedplanningofundergroundspacedevelopment,undergroundpipelinesofvariouskinds,androadtransportation,andbeincorporatedintoregulatorydetailedplanning.

Thespecializedutilitytunnelplanningshall,inaccordancewithlocalconditions,considerationofbothshortandlong-termtargetsandstep-by-stepimplementation,determineitemsincludingtheconstructionlayout,varietyofutilitypipelines,sectionform,planimetricposition,andverticalcontrol,andspecifythescaleandtimesequenceoftheconstruction.

第十条 建设、交通、公路等行政管理部门、各区人民政府、横琴新区和经济功能区管理机构按照管廊专项规划，在编制道路年度建设计划和城市更新计划等建设方案时，应当统筹安排管廊建设工作。

Article10Administrativedepartmentsofconstruction,transportandroad,districtpeople’sgovernments,andadministrativeauthoritiesofHengqinNewAreaandeconomicfunctionalareasshall,inaccordancewithspecializedutilitytunnelplanning,makeoverallarrangementsabouttheconstructionofutilitytunnelswhileformulatingconstructionschemeslikeannualroadconstructionplanandurbanrenewalplan.

第十一条 管廊设计应当符合国家标准，满足所在区域应当入廊管线的需要，确保管廊安全运行。

Article11Thedesignofutilitytunnelshallcomplywithnationalstandard,meettherequirementsofpipelineincorrespondingarea,andensurethesafeoperationofutilitytunnels.

第十二条 管廊建设工程的设计应当征求管廊运营管理单位（以下称管廊运营单位）和入廊管线单位的意见。

Article12Thedesignofutilitytunnelconstructionprojectshalltakeadvicefromutilitytunneloperationmanagementunits（hereinafterreferredtoas“utilitytunneloperationunits”）andpipelineunits.

第十三条 已建管廊区域内的管线，除根据相关技术规范和标准无法纳入管廊的管线，以及管廊与外部用户的连接管线外，必须按照专项规划要求进入管廊。

有关行政管理部门和管线单位应当按要求做好管线入廊工作。

对应当进入管廊的管线，管线单位申请在管廊以外的位置新建管线的，规划部门不予规划许可，建设部门不予施工许可，市政、公路行政管理部门不予挖掘道路、公路许可。

Article13Pipelineswithintheareawhereutilitytunnelsareconstructedshall,exceptforpipelinesthatcannotbeincludedinutilitytunnelsaccordingtorelatedtechnicalspecificationandstandardsandtheassociatedpipelinesconnectingtheutilitytunnelsandexternalusers,beinstalledinsidetheutilitytunnelssubjecttothespecializedplanning.

Relevantadministrativedepartmentsandpipelineunitsshalldowellinpipelineinstallationasrequired.Wherethepipelineunitsapplyforoutsideinstallationofpipelinesthatshouldbeinstalledinsidetheutilitytunnels,theplanningdepartmentshallnotissueanyplanningpermit,theconstructiondepartmentshallnotissueanyconstructionpermit,andtheadministrativedepartmentsofcityaffairsandroadshallnotissueanyroadexcavationpermit.

第十四条 管廊工程应当按规定组织工程竣工验收，合格后方可交付使用。

Article14Theutilitytunnelprojectsshallbesubjecttofinalacceptanceoftheprojectinaccordancewithrelevantrulesandshallbeputintoserviceaftertheacceptance.

   第三章  运营与维护

ChapterIIIOperationandMaintenance

第十五条 管廊运营单位是管廊运营、养护管理的责任主体，对管廊进行运营和养护，并按约定向入廊管线单位提供管廊使用及养护管理服务。

管廊运营单位的确定办法由市人民政府另行规定。

Article15Theutilitytunneloperationunitsaretheresponsibleentitiesfortheoperation,maintenanceandadministrationofutilitytunnels,andshalloperateandmaintaintheutilitytunnels,andprovideutilitytunnelsutilization,maintenanceandadministrationservicesforpipelineunits.

ThedeterminationofutilitytunneloperationunitsshallbestipulatedseparatelybytheMunicipalPeople’sGovernment.

第十六条 管廊运营单位应当与入廊管线单位签订协议，明确入廊管线种类、时间、费用以及各方的责任和义务。

Article16Theutilitytunneloperationunitsshallsignagreementswithpipelineunitstospecifythevariety,time,andcostofpipelinesanddutiesandobligationsofpartiesconcerned.

第十七条 管廊实行有偿使用，入廊管线单位应当向管廊运营单位缴纳入廊费和日常维护费。

有偿使用费用标准原则上由双方协商确定，市人民政府在必要时可以依法实行政府定价或者政府指导价。

市价格部门会同市市政、财政等行政管理部门制定入廊费和日常维护费的指导意见，作为确定费用标准的参考依据。

入廊费主要根据各入廊管线单独敷设和更新改造成本确定，适当考虑管廊本体及附属设施建设成本。

日常维护费主要根据管廊本体及附属设施维修、更新等维护成本，以及管线占用管廊空间比例、对附属设施使用强度等因素合理确定。

Article17Theutilitytunnelsshallbeusedwithcompensation,andpipelineunitsshallpayadmissionfeesanddailymaintenancefeestotheutilitytunneloperationunits.Theexpensestandardofpaiduseshall,inprinciple,bedeterminedbybothpartiesthroughnegotiation,andtheMunicipalPeople’sGovernmentmay,ifnecessary,implementgovernmentpricingorgovernmentguidancepriceinaccordancewithlaws.Themunicipalpricingdepartmentshall,incollaborationwithmunicipaladministrationdepartmentsofcityaffairsandfinance,formulateaninstructiononadmissionfeesanddailymaintenancefeesasareferencefordeterminationofexpensestandard.

Theinstallationfeesaredeterminedmainlyinaccordancewiththecostsofindependentinstallation,renovationandreconstructionofpipelines,and
