根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《上海市劳动合同条例》的有
关规定，双方遵循公平合法、平等自愿、协商一致、诚实信用原则，订立本合同。
1Contractpartners合同双方

2Employment雇佣关系
2.1PartyAherebyoffersformalemploymenttoPartyB,andPartyBherebyagreestobeemployedbyPartyA,withtheworkareaof______Tobedetermined_____________________,inaccordancewiththetermsandconditionssetforthinthisContract,thePerformanceEvaluation,JobDescriptionandtheRemunerationAgreementannexedtothisContractandHandbook.AcleanreleasefromPartyB'spreviousemployerisrequired;otherwisePartyAholdstherighttorevokethisoffer.
依照本合同及其附件的绩效考核,岗位描述及薪酬协议以及公司员工手册中所列的条款和要求，甲方正式雇佣乙方，乙方同意接受雇佣。
乙方的工作范围为____________________________相关的各种事务。
乙方必须与前雇主完全脱离雇佣关系，否则甲方有权撤回要约。
3Contracttermandprobationperiod合同期和试用期
3.1ThisContract,signedbyPartyAandPartyB,shallcontinuefrom__Signature____________

本合同由甲方和乙方共同签订。
除非其因合同相关条款的规定而提前终止，合同有效期（以下称为“合同期”）将从2013年月日起持续至年月日,为期年。
3.2PartyBshallberequiredtoundergoaperiodofprobationof__2_months.（theemployeeswhorenewcontractsareexceptionsifagreedtobyPartyA）.
乙方应当履行为期__3___个月的试用期。
（乙方经甲方同意续签合同的情况除外）
3.3PartyAmaydismissPartyBatanytimeduring,orattheendof,theprobationary
periodifPartyAconsidersthatPartyB'sperformancecannotsatisfytherecruitmentconditionsorthestandardsinthejobdescriptionduringtheprobationaryperiod.IfPartyAconsidersthatPartyB'sperformancehasbeensatisfactoryduringtheprobationaryperiod,PartyBshallbecomearegularemployeeofPartyAinaccordancewiththetermsofthisContract,andtheprobationperiodwillbewithinthecontractterm.
在试用期中的任何时间，甲方如果认为乙方的表现不符合录用的条件或岗位描述的标准，可以随时解雇乙方。
如果甲方对乙方在试用期间的表现满意，则根据合同条款乙方将成为甲方的正式员工，并将试用期计入合同期内。
3.4ExecutionofthisLaborContractshallterminateatitsexpiration.Atleast30dayspriortothescheduledexpirationoftheTerm,PartyAshallofferPartyBarenewaloftheContractifPartyAintendstorenewtheContract.IfPartyAofferstorenewtheContract,PartyBshallacceptorrefusetherenewalpriortotheexpirationoftheTerm.IntheeventthatPartyBfailstorespondpriortotheexpirationoftheTerm,PartyBshallbedeemedtohaverefusedtorenewtheContract.
合同期满后本合同将终止。
如果甲方有意向续签合同，应当在本合同期满之日至少30天前向乙方发出续签的要约。
在甲方发出续签合同的要约后，乙方应当在合同期满前接受或拒绝该要约。
如果乙方在本合同期满前没有回应，视为放弃续约。
4Workscopeandworktime工作范围与工作时间
4.1ThescopeofthePartyB’sdutiesshallbedeterminedfromtimetotimeinaccordancewiththeneedsofPartyAbytheLegalRepresentativeoramanagerofPartyAdesignatedbytheLegalRepresentative.PartyAhastheright,afterconsultingwithPartyB,toadjustthescopeofPartyB’sdutiesintermsofPartyA’sadministrativerequirements,andPartyB’sprofessionalcapabilityandworkingperformance.PartyBshalldiligentlyperformhis/herdutiestothebestofhis/herabilityinaccordancewiththeinstructionsofhis/hersupervisors,workinco-operationwithhis/hersupervisorsandcolleagues,andobservethetermsofthisContractandtheworkrulesofPartyAcontainedinHandbookofPartyAorcompanyrulesotherwiseissuedbyPartyA.
乙方的职责范围由甲方的法人或其指定的管理人员根据甲方的需要随时进行规定。
在与乙方商议后，甲方有权根据甲方的管理需要、乙方的专业能力与工作表现调整乙方的职责范围。
乙方应当按照上级的指示勤勉地履行职责并发挥最大能力，与上级和同事通力合作，遵守本合同的条款以及包括在甲方员工手册或甲方发布的其他公司规章制度。
4.2PartyBundertakestoacceptthearrangementorchangeofworkmadebyPartyA
inlightofPartyA’sworkrequirementsandPartyB’sworkingabilityand
performance;PartyBshallagreesthatthisAgreementmaynotbealteredunderanyof
thefollowingcircumstances:
乙方承诺，愿服从甲方根据工作需要、乙方工作能力及其表现而安排或调动的工
作岗位并同意在下列情况下本合同不作变更处理：
4.2.1PartyB’sworkingsiteistobearrangedbythedivisionheorsheworksin;Party
AistochangePartyB’sworkingsitewithinallitsbusinessofficesand
connectedsitesinthecitywherePartyAisdomiciled（includingPartyA’sown
propertyorotherpremisesleasedbyPartyA）,onthebasisofPartyA’sworking
requirement;
乙方的工作地点由所在部门安排。
今后因工作需要乙方在甲方所在本市的全
部经营办公场所及附属场所（包括公司自有产权的物业或租赁的物业，）之
间调整时。
4.2.2PartyAassignsPartyBtoworkathomeorabroadonbusinesstravelforashort
termonthebasisofPartyA’sworkingrequirement.
甲方因工作需要，临时指派乙方到境内外短期出差地点工作的。
4.2.3Inresponsetoworkingrequirement,PartyAtemporarilyassignsPartyBto
workatotherdivisionsofPartyAorotherentities.
甲方因工作需要，安排乙方临时外借到其它部门或其它他单位工作的。
4.3PartyBshallbeentitledtolegalholidays,annualleave,andotherpaidleavesofabsenceinaccordancewithapplicablelawandPartyA’sworkrules,whichareinforcefromtimetotime.ThetermsofleavesofabsenceatthedateofcommencementoftheTermisdescribedintheHandbookattachedtothiscontract.
乙方有权享受法定节假日、年假和其他不时生效的相关法律及甲方工作规章所规定的带薪假期。
有关合同生效日后假期的条款请参照本合同所附的员工手册。

5RemunerationandLeaveofAbsencePolicy劳动报酬及请假制度
5.1TheyearlysalaryofPartyBshallbe__________yuan,.

Afterthesatisfactorycompletionoftheprobationaryperiod,PartyAwillconductanassessmentofPartyB’scapability,workattitudeandefficiencyetc.ThereafterPartyAmaychangethewageofPartyBfromtimetotimebasedontheperformanceofPartyB.
如果乙方在试用期的表现令甲方满意，甲方将对其工作能力、工作态度、工作效率等进行评估。
此后，甲方可根据乙方的表现适时对其工资进行调整。
5.2DuringperiodoflegalholidaysandMarriageorBereavementLeaves,PartyAshallpaythewageinaccordancewiththelawsandregulations.
乙方在法定休假日和婚丧假期间，甲方将依法支付工资。
5.3TheEmployeewhohasworkedforPartyAforoveroneyear,isentitledto

Januaryandendon31stDecemberofthesameyear.Holidayswillbepaidatbasic
ratesofpayment.
员工每年享有_____个工作时的假期。

Allholidaysmustbepre-bookedinagreementwithmanagement.
为便于管理，所有休假都必须提前申请
TheEmployerreservestherighttoreimbursementbytheemployeeforanypayment
inexcessofholidayentitlementonterminationofservice.Allholidaysmustbe
takenintheholidayyear-noholidaysmaybecarriedforwardtothefollowingyear
withoutprioragreementwiththemanagement.
协议终止时，对于员工额外享有的假期福利，公司保留索取赔偿的权利。
所有
假期都必须在当年休完，未经管理方同意，来年不再补休。
5.4exceptionalleavewillbegivensympatheticconsiderationbytheEmployer.The
Employerhoweverdoesnotholditselfboundtomakeanypaymentfor
compassionateleaveunlesstakenaspartofcurrentholidayentitlement.
公司出于同情考虑会准许事假，但一般不带薪，除非现行假期福利另有规定
5.5BeforePartyBrequiresforsickleave,compassionateleave,oranyotherformofleave,heorsheshallformallyapplytothelinemanagerforapprovalinwritinginadvance,andforsickleave,itisalsorequiredtoprovidewithverificationofthedoctorfromhospitaldesignatedbyPartyA.
乙方如请病假、事假或任何形式的假，均应事先书面申请直接主管批准，病假还需提供由甲方指定医院开出的证明。
5.6PartyAwillpayallremunerationdirectlytoPartyBincash,lessanyamount
requiredtobewithheldbyPartyAasindividualincometax.PartyBshall,however,
havesoleresponsibilityforanyindividualincometaxandanyotherchargesortaxes
imposedonPartyB’sremuneration.
甲方将所有报酬在扣除依法由甲方代扣的诸如个人所得税等费用后以现金形式直接支付给乙方。
乙方将对缴纳个人所得税以及与报酬相关的其他任何费税义务承担全部责任。
6Socialinsuranceandwelfare社会保障和福利
6.1PartyAshallpaysocialinsurancepremiumandhousingaccumulationfundsforPartyBinaccordancewiththerelevantregulationsoftheStateandShanghaimunicipality.
甲方按国家和上海市有关规定，为乙方缴纳社会保险和住房公积金.
6.2PartyBagreesthatPartyAmay,fromtheremunerationpayabletoPartyB,withhold
thepartofsocialinsurancepremiumandpublicremunerationfundtobeborneby
PartyBandPartyAmaypaysuchwithheldpartonbehalf,inaccordancewiththe
relevantregulationsoftheStateandShanghaimunicipality.
乙方同意按照国家和上海市的有关规定，由个人承担的社会保险、住房公积金部
分由甲方在工资中代扣代缴。
6.3IncasePartyBisillorinjuredfornon-workreasons,PartyAshallofferPartyBaperiodofmedicaltreatmentaccordingtothepatient’scircumstancesandthelengthofhis/herserviceinPartyA.ThelivingexpensesandmedicalfeesarepaidinaccordancewithrelevantregulationsofP.R.C.
乙方患病或非因工负伤，甲方按其病情及在本单位工作时间长短，给予一定的医
疗期。
医疗期间的生活费用和医疗费用，按国家有关规定执行。
7Workconditionandlaborprotection劳动条件与劳动保护
7.1PartyAshallstrictlyobservelawsandregulationsofP.R.Conoccupationalsafetyandhygieneandregulationsonworkinghours,restandh
升级会员
