PART1633—STANDARDFORTHEFLAMMABILITY（OPENFLAME）OFMATTRESSSETSSubpartA—TheStandard

§ 1633.1   Purpose,scopeandapplicability.

（a）Purpose.Thispart1633establishesflammabilityrequirementsthatallmattresssetsmustmeetbeforesaleorintroductionintocommerce.Thepurposeofthestandardistoreducedeathsandinjuriesassociatedwithmattressfiresbylimitingthesizeofthefiregeneratedbyamattresssetduringathirtyminutetest.

（b）Scope.

（1）Allmattresssets,asdefinedin§1633.2（c）,manufactured,imported,orrenovatedonoraftertheeffectivedateofthisstandardaresubjecttotherequirementsofthestandard.

（2）One-of-a-kindmattresssetsmaybeexemptedfromtestingunderthisstandardinaccordancewith§1633.13（c）.

（c）Applicability.Therequirementsofthispart1633shallapplytoeach“manufacturer”（asthattermisdefinedin§1633.2（k））ofmattresssetswhicharemanufacturedforsaleincommerce.

§ 1633.2   Definitions.

Inadditiontothedefinitionsgiveninsection2oftheFlammableFabricsActasamended（15U.S.C.1191）,thefollowingdefinitionsapplyforpurposesofthispart1633.

（a）Mattressmeansaresilientmaterialorcombinationofmaterialsenclosedbyaticking（usedaloneorincombinationwithotherproducts）intendedorpromotedforsleepingupon.Thisincludesmattressesthathaveundergonerenovationasdefinedinparagraph（d）ofthissection.

（1）Thistermincludes,butisnotlimitedto,adultmattresses,youthmattresses,cribmattresses（includingportablecribmattresses）,bunkbedmattresses,futons,flipchairswithoutapermanentbackorarms,sleeperchairs,andwaterbedsorairmattressesiftheycontainupholsterymaterialbetweenthetickingandthemattresscore.Mattressesusedinoraspartofupholsteredfurniturearealsoincluded;examplesareconvertiblesofabedmattresses,cornergroupmattresses,daybedmattresses,roll-awaybedmattresses,highrisers,andtrundlebedmattresses.See§1633.9Glossaryofterms,fordefinitionsoftheseitems.

（2）Thistermexcludesmattresspads,mattresstoppers（itemswithresilientfilling,withorwithoutticking,intendedtobeusedwithorontopofamattress）,sleepingbags,pillows,liquidandgaseousfilledtickings,suchaswaterbedsandairmattressesthatcontainnoupholsterymaterialbetweenthetickingandthemattresscore,upholsteredfurniturewhichdoesnotcontainamattress,andjuvenileproductpadssuchascarbedpads,carriagepads,basketpads,infantcarrierandloungepads,dressingtablepads,strollerpads,cribbumpers,andplaypenpads.See§1633.9Glossaryofterms,fordefinitionsoftheseitems.

（b）Foundationmeansatickingcoveredstructureusedtosupportamattressorsleepsurface.Thestructuremayincludeconstructedframes,foam,boxsprings,orothermaterials,usedaloneorincombination.

（c）Mattresssetmeanseitheramattressandfoundationlabeledbythemanufacturerforsaleasaset,oramattresslabeledbythemanufacturerforsalewithoutanyfoundation.

（d）Renovationmeansalteringanexistingmattresssetforthepurposeofresale.

（1）Thistermincludesanyone,oranycombinationofthefollowing:

replacingthetickingorbatting,strippingamattresstoitssprings,rebuildingamattress,orreplacingcomponentswithneworrecycledmaterials.

（2）Thistermexcludesalterationsifthepersonwhorenovatesthemattressintendstoretaintherenovatedmattressforhisorherownuse,orifacustomerorarenovatormerelyhirestheservicesoftherenovatorandintendstotakebacktherenovatedmattressforhisorherownuse.

（e）Tickingmeanstheoutermostlayeroffabricorrelatedmaterialofamattressorfoundation.Itdoesnotincludeanyotherlayersoffabricorrelatedmaterialsquiltedtogetherwith,orotherwiseattachedto,theoutermostlayeroffabricorrelatedmaterial.

（f）Upholsterymaterialmeansallmaterial,eitherlooseorattached,betweenthemattresstickingandthecoreofamattress.

（g）Edgemeanstheseamed,un-seamedortapedborderedgeofamattressorfoundationthatjoinsthetopand/orbottomwiththesidepanels.

（h）Tapeedgemeansanedgemadebyusingbindingtapetoencaseandfinishrawedges.

（i）Bindingtapemeansafabricstripusedintheconstructionofsomeedges.

（j）Seamthreadmeansthethreadusedtoformstitchesinconstructionfeatures,seams,andtapeedges.

（k）Manufacturermeansanindividualplantorfactoryatwhichmattresssetsaremanufacturedorassembled.Forpurposesofthispart1633,importersandrenovatorsareconsideredmanufacturers.

（l）Prototypemeansaspecificdesignofmattresssetthatservesasamodelforproductionunitsintendedtobeintroducedintocommerceandisthesameastheproductionunitswithrespecttomaterials,components,designandmethodsofassembly.Amattressintendedforsale
