IMPLEMENTINGREGULATIONS

OFTHEPATENTLAWOFTHEPEOPLE'SREPUBLICOFCHINA

（PromulgatedbyDecreeNo.306oftheStateCouncilofthePeople'sRepublicofChinaonJune15,2001,amendedthefirsttimeonDecember28,2002accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChina,andamendedthesecondtimeonJanuary9,2010accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChina）

TranslatedbytheStateIntellectualPropertyofficeofthePeople'sRepublicofChina.Incaseofdiscrepancy,theoriginalversioninChineseshallprevail.

ChapterIGeneralProvisions

Rule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeople'sRepublicofChina（hereinafterreferredtoasthePatentLaw）.

Rule2.AnyformalitiesprescribedbythePatentLawandtheseImplementingRegulationsshallbecompliedwithinawrittenformorinanyotherformprescribedbythepatentadministrationdepartmentundertheStateCouncil.

Rule3.AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;thestandardscientificandtechnicaltermsshallbeusedifthereisaprescribedonesetforthbytheState;wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated.

WhereanycertificateorcertifyingdocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsisinaforeignlanguage,thepatentadministrationdepartmentundertheStateCouncilmay,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;wherethetranslationisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmitted.

Rule4.WhereanydocumentissentbymailtothepatentadministrationdepartmentundertheStateCouncil,thedateofmailingindicatedbythepostmarkontheenvelopeshallbedeemedtobethedateoffiling;wherethedateofmailingindicatedbythepostmarkontheenvelopeisillegible,thedateonwhichthepatentadministrationdepartmentundertheStateCouncilreceivesthedocumentshallbethedateoffiling,exceptwherethedateofmailingisprovedbythepartyconcerned.

AnydocumentofthepatentadministrationdepartmentundertheStateCouncilmaybeservedbymail,bypersonaldeliveryorbyotherforms.Whereanypartyconcernedappointsapatentagency,thedocumentshallbesenttothepatentagency;wherenopatentagencyisappointed,thedocumentshallbesenttothecontactingpersonnamedintherequest.

WhereanydocumentissentbymailbythepatentadministrationdepartmentundertheStateCouncil,the16thdayfromthedateofmailingshallbepresumedtobethedateonwhichthepartyconcernedreceivesthedocument.

Whereanydocumentisdeliveredpersonallyinaccordancewiththeprovisionsofthepatentadministration

departmentundertheStateCouncil,thedateofdeliveryisthedateonwhichthepartyconcernedreceivesthedocument.

Wheretheaddressofanydocumentisnotclearanditcannotbesentbymail,thedocumentmaybeservedbymakinganannouncement.Attheexpirationofonemonthfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.

Rule5.ThefirstdayofanytimelimitprescribedinthePatentLawandtheseImplementingRegulationsshallnotbecountedinthetimelimit.Wherethetimelimitiscountedbyyearorbymonth,itshallexpireonthecorrespondingdayofthelastmonth;ifthereisnocorrespondingdayinthatmonth,thetimelimitshallexpireonthelastdayofthatmonth;ifatimelimitexpiresonanofficialholiday,itshallexpireonthefirstworkingdayfollowingthatofficialholiday.

Rule6.WhereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofforcemajeure,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateonwhichtheimpedimentisremoved,atthelatestwithintwoyearsimmediatelyfollowingtheexpirationofthattimelimitrequestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.

Exceptforcircumstancesprescribedinprecedingparagraph,whereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnot
